What does it mean to call a medical device invasive?

Medical devices are often referred to as being invasive or non-invasive. Though invasiveness is relevant, and central, to how devices are understood and regarded in medicine and bioethics, a consensus concept or definition of invasiveness is lacking. To begin to address this problem, this essay explores four possible descriptive meanings of invasiveness: how devices are introduced to the body, where they are located in the body, whether they are foreign to the body, and how they change the body. An argument is offered that invasiveness is not purely descriptive, but implicates normative concep

[Neuroethics: new quality of medical ethics?].

During the last decade there has been a striking growth in interest in ethical issues arising from the development of neurosciences. It was as late as 2002 that the new discipline, called neuroethics, started. It was intended to be a new area of interdisciplinary discourse on moral dilemmas connected with recent advances in, broadly understood, neurosciences. Ten years after its launch neuroethics possesses a distinct body of knowledge and an institutional basis for its further development. As a very young discipline, however, neuroethics is still in a state offlux. Two essential theoretical c

Use of human fetal tissue for biomedical research in Australia, 1994-2002.

Human fetal tissue is a scarce resource that has been used in Australia for biomedical research since 1980. From 1994 to 2002, it has been used for research by 19 biomedical researchers at 12 separate Australian institutions (four universities, six major teaching hospitals and two research institutes). With an average of 265 samples distributed annually, researchers have conducted experiments in biomedical research with the approval of their Human Ethics Committees, and published 74 manuscripts in peer reviewed journals over the past decade. The tissue is obtained from therapeutic termination

Henry Knowles Beecher, Jay Katz, and the Transformation of Research with Human Beings.

The modern history of experimentation with human beings is notable for its ethical lacunae, when even the clearest directives fail to prevent violations of subjects' rights and welfare. One such lacuna occurred during the 25 years between 1947, when the Nuremberg Code was articulated in the judgment passed on the men who had performed medical experiments in the Nazi concentration camps, and 1972, when the revelation of the 40-year-long Tuskegee Syphilis Study shocked the public and pushed Congress to adopt legislation that eventually transformed the governance of human subjects research. Ethical issues in Nipah virus control and research: addressing a neglected disease.

Nipah virus is a priority pathogen that is receiving increasing attention among scientists and in work on epidemic preparedness. Despite this trend, there has been almost no bioethical work examining ethical considerations surrounding the epidemiology, prevention, and treatment of Nipah virus or research that has already begun into animal and human vaccines. In this paper, we advance the case for further work on Nipah virus disease in public health ethics due to the distinct issues it raises concerning communication about the modes of transmission, the burdens of public health surveillance, th

Chapitre 4. Autonomy of minors questioned: Russian case with the loss of medical secrecy.

What is the value of confidentiality? Russian society faced this issue in 2020, when minors aged 15 to 18 lost their privacy. The amendment to the Federal Law, caused the situation, was received ambiguously, but quickly ceased to be the subject of public discussion. In my article, I study this event in a bioethical context, considering the topics of privacy, autonomy and relativity. Social discussion was not productive, since the arguments of both sides contained a double-edged argument: depending on existing relations in a family, the amendment will have a positive or negative meaning. "The significance of clinical foetal autopsy for reproductive health care: an ethical analysis in the German context".

The clinical autopsy of foetuses, stillborn babies, or neonates and the examination of the placenta help to inform the mother's decision-making and her medical care for subsequent pregnancies. Indeed, these post-mortem examinations can identify unexpected congenital malformations or the cause of repeated miscarriage or stillbirth. However, the use of clinical pathology for diagnostic purposes in the context of family planning for bereaved parents with an unfulfilled desire to have a child, and IVF couples has received little attention to date. This article applies Beauchamp and Childress' bioe

Artificial Gametes and Human Reproduction in the 21st Century: An Ethical Analysis.

Artificial gametes, derived from stem cells, have the potential to enable in vitro fertilization of embryos. Currently, artificial gametes are only being generated in laboratory animals; however, considerable efforts are underway to develop artificial gametes using human cell sources. These artificial gametes are being proposed as a means to address infertility through assisted reproductive technologies. Nonetheless, the availability of artificial gametes obtained from adult organisms can potentially expand the possibilities of reproduction. Various groups, such as same-sex couples, post-menop

Ethical Concerns with Applied Behavior Analysis for Autism Spectrum "Disorder".

This paper has both theoretical and practical ambitions. The theoretical ambitions are to explore what would constitute both effective and ethical treatment of Autism Spectrum Disorder (ASD). However, the practical ambition is perhaps more important: we argue that a dominant form of Applied Behavior Analysis (ABA), which is widely taken to be far-and-away the best "treatment" for ASD, manifests systematic violations of the fundamental tenets of bioethics. Moreover, the supposed benefits of the treatment not only fail to mitigate these violations, but often exacerbate them. Warnings of the peri

Defending Informed Consent: Civil Society's Victory Against Emergency Research Deregulation in South Korea.

Informed consent is both a foundational principle of research ethics and a human right grounded in self-determination and bodily integrity. During the COVID-19 pandemic, legislative attempts were made in South Korea to bypass informed consent and ethics review requirements for research involving patients with infectious diseases. Framed as emergency measures to accelerate biomedical innovation, the proposals sparked resistance from a broad coalition of civil society actors, including human rights advocates, patient organizations, labor unions, medical professionals, and bioethics scholars. Precision Cancer Prevention Needs Both Implementation Science and Ethics.

As technological and genomic innovations continue to advance precision cancer prevention, psychosocial, ethical, and operational complexities increasingly accompany their development. Addressing these challenges will require intentional cross-disciplinary collaboration. We argue that the distinct yet complementary lenses of bioethics and implementation science will be crucial as precision cancer prevention technologies move toward clinical integration. We provide a framework for how this joint effort can be accomplished and sustained across the translational pipeline.

Separated after birth.

Bioethics has developed against a backdrop of increased concern for human and civil rights, including the rights of patients to decide about their own treatment. The recent case of Laleh and Ladan Bijani, the twenty-nine-year old Iranian conjoined twins who died in a Singapore hospital on Jul 8, after more than fifty hours of surgery aimed at separating them, highlights the tensions between respect for patient autonomy and professional medical judgment.

What Goes in the Bag: Emergency Time and the Ethics of Retrospective Proof.

A "go-bag" assumes an emergency with a beginning, a peak, and an end. This editorial asks what a family needs to keep for the years after that ending - not to survive the emergency, but to survive its administrative afterlife. Drawing on a decade of research with families living with congenital Zika syndrome in Northeast Brazil, and on Alagoas's compensation law, we examine how states convert the diagnostic limits of an emergency into an evidentiary burden borne by individual families. A decade after exposure, families are asked to reconstruct causation from medical fragments never designed to

Using Electroconvulsive Therapy (ECT) in emergency clinical situations against patient's autonomy: A case study analysis.

In this paper, we present a comprehensive case study analysis of a specific legal order issued by the Court of First Instance Number 6 of Santiago de Compostela on March 21, 2023. The focal point of the case study is the utilization of Electroconvulsive Therapy (ECT), a specific neurotechnology, in an emergency clinical situation. The objective of this article is to examine the legal and bioethical dimensions surrounding the use of ECT, shedding light on the ethical implications and decision-making processes involved in such cases. The analysis delves into the legal aspects of the case, consid

Immersive ethical role-play in undergraduate nursing ethics education: a qualitative descriptive study.

BACKGROUND: Nursing ethics teaching often relies on lectures and paper-based cases, which may not adequately prepare students for ethically ambiguous clinical practice. Evidence on low-resource, narrative, immersive approaches for nursing ethics education remains limited. OBJECTIVE: To explore how undergraduate nursing students described their ethical reasoning, ethical positioning, and perceived learning after participating in an immersive ethical role-play simulation (IERS). DESIGN: Qualitative descriptive study. SETTING AND PARTICIPANTS: A total of 102 second-year undergraduate nursing s

Navigating ethical and legal challenges in the HEALthy Brain and Child Development Study: Lessons learned from the ethics, law, policy working group.

The HEALthy Brain and Child Development (HBCD) Study, a multi-site prospective longitudinal cohort study, will examine human brain, cognitive, behavioral, social, and emotional development beginning prenatally and planned through early childhood. The HBCD study has faced several ethical and legal challenges due to its goal of enrolling pregnant people (including those with substance use disorder) and their newborns. Challenges not fully anticipated at the outset emerged from the rapidly changing legal landscape around reproductive rights in the United States. By embedding scholars in bioethics

Time to reinvent the science of dementia: the need for care and social integration.

OBJECTIVES: The increasing number of older adults with dementia is a large and growing public health problem. Alzheimer's disease, the prevailing form of dementia, is projected to quadruple worldwide. To date, the care and social integration of individuals with dementia is complicated by limited collaborations between biomedicine and other disciplines. The objective of this paper is therefore to reflect on the orientation of biomedicine with regard to the science of dementia, and to articulate a path for moving forward. METHODS: The authors drew upon, and expanded, the insights of an interdis

What can European Principlism Teach about Public Funding of IVF? The Israeli Case.

Fertility treatments, which are part of "assisted reproductive technologies" (ART), mainly undertaken through in vitro fertilization (IVF), offer the opportunity to infertile couples to conceive. IVF treatments are undertaken in Israel in significantly higher numbers than in the rest of the world. As such, Israel provides an important case-in-point for examining the validity of the actual claims used to justify the more generous public funding of IVF treatments at the policy level. In this article, we utilize an analytical philosophy approach to conduct this examination. First, we highlight tw

Generalization-a key challenge for responsible AI in patient-facing clinical applications.

Generalization – the ability of AI systems to apply and/or extrapolate their knowledge to new data which might differ from the original training data – is a major challenge for the effective and responsible implementation of human-centric AI applications. Current debate in bioethics proposes selective prediction as a solution. Here we explore data-based reasons for generalization challenges and look at how selective predictions might be implemented technically, focusing on clinical AI applications in real-world healthcare settings.
