[Psychopathological mechanisms of socially dangerous acts and the problem of responsibility].

The authors discuss the problems of forensic-psychiatric expert examination related to the responsibility of persons suffering from different mental disorders. In addition to the assessment of the clinical picture of a mental disease, it is necessary to take into consideration (as fully as possible) the genesis and character of the committed socially dangerous action (SDA). For this purpose it is recommended that the concept of the psychopathological mechanisms of SDA worded by the authors and their classification be made use of. The establishment in a mental patient of one of the distinguishe

[The Attitude of the Public Concerning Coercive Measures in Psychiatric Patients].

OBJECTIVE: To examine the attitude of the general public in Basel concerning the use of coercive measures while dealing with psychiatric patients. The common population indirectly governs the use of coercive measures in psychiatry by its stigmatization of people with psychiatric illnesses, and its attitude towards treatment in psychiatry and by local opinion leaders and reactions of social networks. METHODS: The answers of 1,112 persons from a representative population survey were evaluated. Participants were mailed case vignettes and questionnaires, and asked if they considered involuntary a

Loathing the sinner, medicalizing the sin: why sexually violent predator statutes are unjust.

In seventeen states, persons convicted of one or more sexually violent offenses may be involuntarily civilly committed at the end of their criminal terms if they suffer from a mental disorder that renders them likely to reoffend sexually. These statutes place the burden on states to show that the sex offender meets the United States Constitutional standard of dangerousness. The key to proving dangerousness is proof of a mental disorder. However, the United States Supreme Court recently found that the offender need not be mentally ill. He need only "suffer" from "mental abnormality" or "persona

[Absconding of a patient from an acute psychiatric ward. Whom do the courts hold liable?].

An involuntarily admitted patient absconds from a mental health hospital, which works on the open-door-system. Two days after leaving, he falls from a balcony on the fifth floor of a residential building and injures himself severely (paraplegia). The court case concerning damages and responsibility for paying the costs of the medical treatment eventually reaches the Kammergericht, the highest court of the state of Berlin. The main question in each trial was whether the hospital had violated its duty and was responsible for the accident and the resulting severe injuries. Relying on the hospital

Suicide attempts and psychiatric disorders in Edmonton.

The relationship between lifetime histories of attempting suicide, psychiatric disorders and other social problems was assessed by examining data from a random sample of 3,258 household residents of Edmonton who were administered the Diagnostic Interview Schedule (DIS) and the Goldberg General Health Questionnaire (GHQ) by trained lay interviewers. While the overall lifetime rate for suicide attempt was 3.6%, of particular interest was the finding that a lifetime history of a psychiatric disorder was 2.6 times more frequent in those who had made a suicide attempt than in those who had not. Exploring the nature and prevalence of targeted violence perpetrated by persons found not criminally responsible on account of mental disorder.

Although mental illness has a demonstrated link with violence, the prevalence of targeted (planned and goal-directed) violence perpetrated by individuals with mental illness and its association with psychiatric symptoms is relatively unexplored. File information was compared for all 293 individuals found not criminally responsible due to mental illness in British Columbia between 2001 and 2005, of whom 19% had committed targeted violence. Most individuals with targeted offenses displayed at least one warning behavior before their offense (93%); all displayed delusions and approximately one thi

Public mental health crisis management and Section 136 of the Mental Health Act.

The interface between mental health services and the criminal justice system presents challenges both for professionals and patients. Both systems are stressed and inherently complex. Section 136 of the Mental Health Act is unusual being both an aspect of the Mental Health Act and a power of arrest. It has a long and controversial history related to concerns about who has been detained and how the section was applied. More recently, Section 136 has had a public profile stemming from the use of police cells as places of safety for young, mentally disturbed individuals. This paper explores the c

Making the case for a model mental health advance directive statute.

Acute episodes of mental illness temporarily destroy the capacity required to give informed consent and often prevent people from realizing they are sick, causing them to refuse intervention. Once a person refuses treatment, the only way to obtain care is as an involuntary patient. Even in the midst of acute episodes, many people do not meet commitment criteria because they are not likely to injure themselves or others and are still able to care for their basic needs. Left untreated, the episode will likely spiral out of control. By the time the person finally meets strict commitment criteria,

Differences between elderly voluntary and involuntary admitted psychiatric patients in Greece.

BACKGROUND: Involuntary psychiatric admission is a controversial issue with legislation varying from country to country. Research on elderly individuals being involuntary admitted has been limited. This study aims first at assessing whether elderly involuntary admitted patients (IAPs) differ with regard to demographic, psychopathological, and behavioral characteristics from voluntary admitted psychiatric patients (VAPs) and second to assess whether the former group should be treated in a different (special) way. METHODS: Forty IAPs were compared to 39 VAPs with regard to sociodemographic data

Taking the wrong drugs: the role of substance abuse and medication noncompliance in violence among severely mentally ill individuals.

Increasing numbers of severely mentally ill individuals are being treated in nonhospital, community-based settings and public concern about potential violence by these individuals has increased, often as a result of tragic, albeit uncommon events. The present study examines potential predictors of serious violence among persons with severe mental illness (SMI), with a specific focus on the joint effect of substance abuse and medication noncompliance. Subjects in the study are involuntarily admitted inpatients with SMI awaiting a period of court-ordered outpatient treatment, termed "involuntary

Case Studies on Dissocial Personality-Bad or Ill?

Dissocial personality is understood as a personality that does not ideologize most social norms and is characterized by a lack of empathy. Precise criteria for diagnosing dissocial personality are included in the ICD-10 classification, which is still in force in Poland. This classification is widely available in both Polish and English. In Poland, there is a fairly wide range of assistance available for people with personality disorders in day care units and 24-h wards for the treatment of personality disorders. Unfortunately, due to some antisocial behaviors that violate the criminal law in f

Psychiatric and legal considerations in cases of Fetal Abduction by Maternal Evisceration.

Fifteen cases of Fetal Abduction by Maternal Evisceration (FAMAE) reported to the National Center for Missing and Exploited Children during 1987-2011 outline the findings from a review of the forensic psychiatric considerations and legal course of each of the cases. Most offenders confessed to law enforcement within a short time of being placed under arrest in statements reflecting a continued effort to manage impressions and minimize culpability. Psychiatric assessment is invariably central to the legal disposition of FAMAE cases, as the defendant's goal is to diminish the perception of culpa

Human Trafficking, Sexual Assault, or Something Else? A Complicated Case With an Unexpected Outcome.

This case report presents a patient who presented multiple times with vaginal injuries and bleeding, reporting sexual assault with a foreign object. Findings from her history and physical examination were consistent with sexual assault and human trafficking. The outcome of this case was not what we initially expected when the patient first presented for care. However, the patient ultimately received the care she needed. This case illuminates the need for excellent continuing education, interdisciplinary communication, and continuity of care.

Social support and risk of compulsory admission: part IV of the Amsterdam Study of Acute Psychiatry.

OBJECTIVE: Social support for patients with a mental illness has been associated with a lower rate of hospitalization. It is important to clarify the role played by a lack of social support as a possible predictor of emergency compulsory admission. METHODS: A random sample of 252 patients who were evaluated by two psychiatric emergency teams in Amsterdam from September 2004 to September 2006 were interviewed approximately one month later about their social networks and social interactions. The number of emergency compulsory admissions was recorded for 244 patients during a two-year follow-up

Psychiatric assessment of aggressive patients: a violent attack on a resident.

Aggressive patients often target psychiatrists and psychiatric residents, yet most clinicians are insufficiently trained in violence risk assessment and management. Consequently, many clinicians are reluctant to diagnose and treat aggressive and assaultive features in psychiatric patients and instead focus attention on other axis I mental disorders with proven pharmacological treatment in the hope that this approach will reduce the aggressive behavior. Unclear or nonexistent reporting policies or feelings of self-blame may impede clinicians from reporting assaults, thus limiting our knowledge
