Comorbid mental illness and criminalness implications for housing and treatment.

The relationship between mental illness, violence, and criminal behavior is complex, and involves a multifaceted interaction of biological, psychological, and social processes. In this article, we review the emerging research that examines the neurobiological and psychological factors that distinguish between persons with mental illness who do and who do not engage in crime and violence. Additionally, a novel model for understanding the interaction between mental illness and criminalness is proposed. (As defined by Morgan and colleagues, criminalness is defined as behavior that breaks laws and

The Psychology of Testimony and the Interrogation of Children: Contesting the Expertise of Teachers and Female Police Officers, circa 1922-1944.

In this case study, I focus on two previously underresearched groups in the history of police interrogation: officers of the Female Criminal Police, established around 1926, and schoolteachers who, beginning in 1924, collaborated with the Leipzig Criminal Office as so-called criminal aides (Kriminalhelfer). Both the Female Criminal Police and the criminal aides of the Leipzig Criminal Office claimed a distinct niche within the domain of interrogation practices. They publicly asserted a superior aptitude for questioning children and adolescents, particularly in cases involving the sexual abuse

[The issue of irresponsibility or mitigation of criminal responsibility].

In France, perpetrators of criminal offenses who have one or more mental or neuropsychiatric disorders at the time of the alleged offense may be found criminally irresponsible or have their criminal responsibility mitigated. In the first case, they are not tried in criminal court and are treated in a psychiatric facility. In the second case, they are tried and a reduction in sentence is applicable according to certain criteria. In order to inform the courts, pre-sentence psychiatric and psychological assessments are systematic in criminal cases.

Diagnosing psychopathy in an intercultural setting: Applications and implications in postcolonial contemporary Mayotte.

International scientific research has extensively studied psychopathy, but few studies focus on an intercultural and postcolonial context. Mayotte, a French overseas collectivity located in East Africa, offers a unique opportunity to study the application and effects of psychopathy diagnosis in the criminal justice field within a social context shaped by colonial legacy. This research uses a mixed-method approach, combining quantitative and qualitative data, to show that in Mayotte, the majority of individuals diagnosed with psychopathy are young, low-income individuals who act in groups. Amon

New perspectives in the legal psychiatry of cocaine-related crimes.

The legal criteria for the insanity defense as it applies to cocaine-related crimes remains elusive because of cocaine's unique spectrum of effects on human thought and action. This paper discusses the literature relevant to cocaine and forensic psychiatry/psychology, and summarizes the results of a survey of forensic psychiatrists on the topic of drug-induced psychosis. A conceptual framework is posited for the expert witness to distinguish the separable effects of cocaine on human behavior and to clarify their relationship to criminal responsibility.

The Impossibility of Criminal Justice Ethics: Toward a Phenomenology of the Possible.

Regardless the specific theoretical perspective, all ethical formulations for criminal justice practice in some way construct the ontological character of the offender, which, in turn, situates both epistemology and method. How this ethical process ultimately constructs the offender will likely help to establish the degree of ethical worth such an individual is deemed worthy to receive. Whether based upon the seriousness of the crime or based upon the specific configuration of the architecture of incarceration, the very possibility of legitimate ethical practice is greatly compromised. Such re

Psychological predictors of retention in a low-threshold methadone maintenance treatment for opioid addicts: a 1-year follow-up study.

This study investigated the role of psychological variables and judicial problems in treatment retention for a low-threshold methadone program in Montreal, Canada. Logistic regression analyses were computed to examine associations between psychological variables (psychological distress, self-esteem, stages of change), criminal justice involvement, and treatment retention for 106 highly-disorganized opioid users. Higher methadone dosage was associated with increased odds of treatment retention, whereas criminal charges and lower self-esteem decreased these odds. Psychological variables could be

Child maltreatment and adult criminal behavior: does criminal thinking explain the association?

Criminal thinking styles were examined as mediational links between different forms of child maltreatment (i.e., sexual abuse, physical abuse, and physical neglect) and adult criminal behaviors in 338 recently adjudicated men. Analyses revealed positive associations between child sexual abuse and sexual offenses as an adult, and between child physical abuse/neglect and endorsing proactive and reactive criminal thinking styles. Mediation analyses showed that associations between overall maltreatment history and adult criminal behaviors were accounted for by general criminal thinking styles and

[Criminal responsibility in schizophrenia with special attention to the mental state during the criminal act--a study based upon the activation-recurrence phenomenon].

In this article, psychiatric arguments regarding criminal responsibility in schizophrenia are reviewed, and it is pointed out that the arguments have been influenced by the theory of process psychosis. Moreover, two cases judged on the basis of the activation-recurrence phenomenon are exemplified, and fundamental issues are discussed. Investigating the mental state just before the crime helps when deliberating over criminal responsibility. A study of the activation-recurrence phenomenon, conducted by Shinkai and Miyasaka, contributes toward clarifying the recurrence of the micropsychotic state

Three Central Dimensions of Sexual Recidivism Risk: Understanding the Latent Constructs of Static-99R and Static-2002R.

The most commonly used risk assessment tools for predicting sexual violence focus almost exclusively on static, historical factors. Consequently, they are assumed to be unable to directly inform the selection of treatment targets, or evaluate change. However, researchers using latent variable models have identified three dimensions in static actuarial scales for sexual offenders: Sexual Criminality, General Criminality, and a third dimension centered on young age and aggression to strangers. In the current study, we examined the convergent and predictive validity of these dimensions, using psy

From Bacillus Criminalis to the Legalome: Will Neuromicrobiology Impact 21st Century Criminal Justice?

The idea that gut microbes or a "bacillus of crime" might promote criminal behavior was popularized in the early 20th century. Today, advances in neuromicrobiology and related omics technologies are lending credibility to the idea. In recent cases of dismissal of driving while intoxicated charges, courts in the United States and Europe have acknowledged that gut microbes can manufacture significant amounts of systemically available ethanol, without a defendant's awareness. Indeed, emergent research is raising difficult questions for criminal justice systems that depend on prescientific notions

The social organization of violence toward hostages: does violence in captivity indicate which kidnappers will kill?

It is questionable whether violence toward a hostage varies according to criminal or radical orientation of their kidnappers who hold them for ransom. This notion is important because it relates to the assumption that how the hostage is treated may indicate whether the victim may survive the ordeal. To investigate, 181 kidnappings cases were cross-tabulated with four previously identified violent tactics (inflicting pain, terror, psychological torture, and reward tactics) and three distinctive type of kidnappers (common criminal, organized criminal, and radical/terrorist groups). The results i

Compliant victims of the sexual sadist.

This is a descriptive summary of the experiences of a sample of women who have been consensually involved with criminal sexual sadists. The paper details the physical, sexual, and psychological abuse to which the women were subject as well as the process by which they were transformed from independent, competent women to the compliant appendages of their criminally active partners. Similarities in the sexual sadist's criminal and consensual sexual activities as they reflect a specific paraphilic preference are discussed.

Forensic Psychiatry versus the Varieties of Delusion-Like Belief.

The available categorical constructs within the Diagnostic and Statistical Manual of Mental Disorders, Fifth Edition, do not allow forensic psychiatrists to distinguish easily between the varieties of delusion-like belief. This dilemma is especially challenging when seemingly delusional beliefs are shared online. Although the term "extreme overvalued belief" has been proposed to aid with such distinctions, its definition has conceptual problems, including diagnostic overlap with shared delusions, "extremism" that refers to behavior rather than belief, and the potential to be applied with prose

Pathological gambling: forensic issues.

OBJECTIVE: The aim of this paper is to review the literature describing the hypothesised link between crime and pathological gambling and its relevance to arguments of diminished responsibility. METHOD: An attempt was made to include all publications in the psychiatry and psychology literature which made reference to pathological gambling and criminal behaviours. Given the limited research in this field, specific unpublished conference papers were also included in the review. RESULTS: Evidence supports the contention that pathological gamblers are at high risk for committing criminal offence

Challenging the prescientific frameworks of criminal justice: neurobiology and criminolytic interventions in the legalome era.

Contemporary systems of criminal justice are rooted in prescientific folk psychology assumptions related to moral fiber, free will, agency, and near-universal levels of willpower. For instance, people often believe that morally "defective" people make voluntary choices, failing to utilize their own self-control capacities. Given the wide acceptance of such beliefs, they are considered "normative" within law, serving to underpin retributive punishment. However, rapid advances in biological sciences-aided by multi-omics technologies-have illuminated the ways in which brain architecture and curre

Deficient fear conditioning in psychopathy: a functional magnetic resonance imaging study.

CONTEXT: Psychopaths belong to a larger group of persons with antisocial personality disorder and are characterized by an inability to have emotional involvement and by the repeated violation of the rights of others. It was hypothesized that this behavior might be the consequence of deficient fear conditioning. OBJECTIVE: To study the cerebral, peripheral, and subjective correlates of fear conditioning in criminal psychopaths and healthy control subjects. DESIGN: An aversive differential pavlovian delay conditioning paradigm with slides of neutral faces serving as conditioned and painful pre
