Bad law or implementation flaws? Lessons from the implementation of the new law on epidemics during the response to the first wave of COVID-19 in Switzerland.

After the 2009-2010 H1N1 pandemic, Switzerland overhauled its 1970 law on epidemics. The reform aimed at improving early detection, surveillance, and preparedness for future outbreaks of infectious diseases. Notably, the law introduced stronger coordination between Federal and Cantonal authorities, better management tools and international cooperation. The new law entered into force in 2016 after a long legislative process. During the process, the law survived a referendum fuelled by concerns about vaccine safety and pharmaceutical industry interference. The law was first applied during the CO

The impact of third-party authorization requirements on abortion-related outcomes: a synthesis of legal and health evidence.

OBJECTIVES: This review synthesizes legal and health evidence to demonstrate the health and human rights impacts of third-party authorization requirements (TPAs) on abortion seekers. RESULTS: The synthesized evidence substantiates the pre-existing position in international human rights law that requirements that abortion be authorized by third parties like parents, spouses, committees, and courts create barriers to abortion, should not be introduced at all, or should be repealed where they exist. CONCLUSIONS: The review establishes that rights-based regulation of abortion should not impose T

Incidence of liver injury among cancer patients receiving chemotherapy in an integrated health system.

PURPOSE: Using liver laboratory tests (LLTs), Hy's law is a method used to identify drug-induced liver injury (DILI), after excluding other causes. Elevated LLTs in chemotherapy-exposed patients may result from tumor effects or comorbidities. This study evaluated incidence of Hy's law in chemotherapy-treated cancer patients. METHODS: We identified breast, colorectal, and lung cancer patients diagnosed in 1 January 2000 to 31 December 2007 at a Midwestern health system. Using automated data, potential Hy's law (PHL) cases were defined by patterns of elevated LLTs suggestive of DILI. Among thos

Is drug-use stigma a breach of human rights law?: Insights from Australia.

Whilst international drug policy increasingly recognises the need to address drug-use stigma, there is limited consideration of how drug-use … evolution and testing of these arguments are needed to harness the possibilities of Australian and international law to address drug-use stigma.

International Human Rights and the Mistreatment of Women During Childbirth.

International human rights bodies have played a critical role in codifying, setting standards, and monitoring human rights violations in the context of sexual and reproductive health and rights. In recent years, these institutions have developed and applied human rights standards in the more particular context of maternal mortality and morbidity, and have increasingly recognized a critical human rights issue in the provision and experience of care during and after pregnancy, including during childbirth. However, the international human rights standards on mistreatment during facility-based chi

Eighty years of postwar multilateralism: Global health law's emergence and its contemporary challenges.

Founded on the postwar conviction that health is 'fundamental to the attainment of peace' and that its enjoyment constitutes 'a fundamental human right', the WHO has embodied the UN's ambition to constitutionalise solidarity through law. Nearly eight decades later, this normative order faces a profound legitimacy crisis. The tension between sovereignty and universality has reemerged, and the ethical foundations of global health law are increasingly contested and fragmented. From several revisions of the International Health Regulations to the WHO Framework Convention on Tobacco Control and, mo

The implementation of European animal welfare standards in Turkish animal protection legislation and case law.

INTRODUCTION: In this study, by examining the compatibility of Turkish legislation with the European convention on animal welfare through quantitative analysis and case law, the purpose is to fill a significant gap in the literature. METHODS: The study employs a mixed-method approach encompassing quantitative legislative evaluation, case law review, and a strategic SWOT analysis. The compatibility of national laws with the Convention was quantitatively measured. Furthermore, a comprehensive analysis of 250 Supreme Court decisions was systematically conducted to assess the practical implementa

Ecological rule of law and enterprise green innovation - Evidence from China's environmental courts.

Strengthening the rule of law is the cornerstone of ecological environmental protection. In the context of sustainable development, countries generally recognize the key role of the legal system in the protection of the ecological environment. Based on the perspectives of management, economics, and jurisprudence, this paper explores the impact and internal mechanism of the ecological legal system represented by the environmental protection court on the green innovation of enterprises. The study revealed that the ecological rule of law elevates enterprises' green innovation. The cost of environ

Attacks on sexual, reproductive, maternal and newborn healthcare in armed conflict: Accountability for the gendered reverberating effects.

Attacks on sexual, reproductive, maternal and newborn healthcare are an increasingly prominent feature of contemporary armed conflict, yet their gendered effects remain underexamined. This narrative review synthesizes evidence from global health, humanitarian practice, conflict studies, and international law, drawing on examples from Gaza/occupied Palestinian territory, Ukraine, Sudan, and Ethiopia. It argues that attacks on health care produce reverberating harms that extend beyond immediate destruction, disrupting reproductive autonomy, maternity care, neonatal services, referral pathways an…

Postmortem sperm procurement: a legal perspective.

PURPOSE: Postmortem sperm procurement with subsequent artificial insemination has become a technically feasible method for posthumous conception. A variety of legal questions exist involving the rights and relationships of the deceased, his family and his issue. We addressed these questions and designed a workable protocol for postmortem sperm procurement. MATERIALS AND METHODS: MEDLINE, WESTLAW and LEXIS medical literature, and case law searches were conducted. United States and international case law, United States (federal and state) statutes, Uniform Law Commissions Acts, and law review c

Probing the potential for anti-Kasha behavior through direct measurements of S2 lifetimes in xanthione and thioxanthone.

Several examples of "anti-Kasha" emission from higher excited electronic states (Sn, n ≥ 2) have been reported recently for a variety of aromatic organic molecules. Even a modest suppression of the fast Sn → S1 internal conversion expected from the energy gap law, which underlies typical Kasha behavior, would have many advantages in photochemistry and in the development of photonic materials. Thus, it seems important to reassess the extent and reliability of the energy gap law. Here, we apply ultrafast spectroscopy and quantum chemical calculations to measure and interpret the S2 relaxation ti

The "double punishment" of transgender prisoners: a human rights-based commentary on placement and conditions of detention.

PURPOSE: The incarceration of transgender people is described as a "double punishment" based on lack of gender recognition and ability to gender affirm, and with their experiences and conditions in prison tantamount to torture. The purpose of this study is to illustrate the continued "double punishment" of incarcerated transgender people (in particular trans-women) and identify and describe breaches in human and gender rights and minimum standards of care. DESIGN/METHODOLOGY/APPROACH: There is limited global data on the numbers of incarcerated transgender people, an identified vulnerable pris

Issues of Japanese speech therapy education considering the 1995 Guidelines of International Association of Logopedics and Phoniatrics (IALP).

The historical background of the educational system for Japanese speech and language therapists (pathologists) and the challenge facing us today are reviewed. It took nearly 30 years for speech therapists and physicians to come to a consensus in defining the status of speech therapists (pathologists) and their educational curriculum before the 1997 national law for Japanese speech therapists was passed. Despite the formulation of the International Association of Logopedics and Phoniatrics (IALP) Education Guidelines of 1995, little attention was paid to incorporate it into the 1997 national la

This article also situates the CRPD in the context of Singapore's dualist view of international law and communitarian approach to disability policy. [Chapter 5. Militarisation and arsenalisation of outer space: strategic and ethico-legal perspectives.].

According to Carl Schmitt, the antonym of ‘The ethics of mankind’ contained in outer space law is nomos and polemos, ie the idea that (international) law and politics have as their respective nuclei the sharing of territory and a relation of hostility, both of which combine in conquest, in the sense of taking possession of a territory by the use of armed force. The big question is knowing if outer space escapes or will escape the nomos and polemos, or if it also experiences or will experience the struggle for domination. In order to answer this question, the article examines outer

Mandatory Prescription Limits and Opioid Utilization Following Orthopaedic Surgery.

BACKGROUND: Since 2016, over half of the states in the United States have passed mandatory limits on opioid prescriptions, with limited evidence of effectiveness. In this study, we evaluated postoperative opioid prescriptions following orthopaedic surgery before and after the implementation of one of the earliest such laws. METHODS: Following the implementation of state legislation limiting opioid prescriptions for opioid-naïve patients, 2 patient cohorts (pre-law and post-law) were compared. Both opioid-tolerant and opioid-naïve patients undergoing 6 common orthopaedic procedures (total knee

Adolescent noncompliance with age-specific versus universal US motorcycle helmet laws: Systematic review and meta-analysis.

INTRODUCTION: The U.S. experience with motorcycle helmets affords an important insight into the responses of adolescents to age-specific laws. Political contention has led to a number of U.S. state law changes back and forth between universal and age-specific laws. Because both kinds of law require adolescent motorcyclists to wear helmets, relatively few studies have focused on how the law type affects their behavior. METHOD: Differential behavior is tested by a systematic review of literature, leading to a meta-analysis, in relation to the experience of various states' motorcycle helmet laws

Using laws to further public health causes: the Healthy Prisons Agenda.

In this commentary, we propose using laws in implementing the Healthy Prisons Agenda. We evaluate the efficacy of laws in tackling health inequalities in prisons, provide recommendations on how states can uphold their international commitments that safeguard prisoners' right to healthcare, and frame prisons as health-promoting settings. We also assess the challenges that can thwart this proposal, such as the non-binding nature of international obligations, global prison overcrowding and the dependency on prison governors and staff for implementation of the Agenda. The commentary concludes by r

Qatar mental health law: Knowledge and attitude among healthcare workers.

BACKGROUND: Qatar's mental health law (MHL) is designed to regulate the management of individuals with mental illness and to safeguard their rights and is currently in the process of implementation. Studies from countries with established MHL systems reveal varying attitudes of stakeholders towards this law. This study aimed to assess awareness and attitudes of healthcare workers (HCWs) to proposed MHL provisions in Qatar. METHOD: A cross-sectional survey using a specially designed online questionnaire was carried out. In addition to socio-demographic information, responses to questions explo

[Performance of in vitro fertilization in Germany].

In Germany the application of assisted reproductive techniques (ART) is regulated by federal legislation. Compared with the international situation the "German Embryo Protection Law" is very "restrictive" and various methods of ART are prohibited, e.g. oocyte/embryo donation, embryo cryopreservation and Preimplantation Genetic Diagnosis (PGD). Furthermore, in Germany only 1 to 3 fertilized oocytes may be cultured to embryo. All these embryos then have to be transferred into the uterus of a particular patient. Additional fertilized oocytes can only be cryopreserved in a pronuclear state. The su
