Case Law Considerations in the Use of ASPD in SVP/SDP Evaluations.

The use of antisocial personality disorder (ASPD) as a qualifying mental disorder for a sexually violent predator (SVP) or a sexually dangerous person (SDP) commitment continues to arouse controversy. Two common questions arise. Is ASPD considered a qualifying mental disorder in statutory or case law definitions? Can ASPD be the sole qualifying mental disorder? We review case law for guidance as to when ASPD may serve as a sole qualifying diagnosis in SVP/SDP evaluations. Other than the federal government and New York, all other jurisdictions with SVP/SDP commitments permit the use of ASPD as

Psychiatric commitment of the elderly.

Involuntary hospitalization of the elderly has been the focus of controversy. In many jurisdictions, commitment criteria are stringently and narrowly defined, require a showing of "dangerousness," and are difficult to apply toward securing proper treatment for the elderly. In other areas, broader criteria apply, but some authors argue that such criteria are inappropriately used with the elderly and leave them vulnerable to the abuse of unnecessary institutionalization. The authors examined 274 consecutive admissions aged 55 years and over, comparing voluntary and involuntary patients. Patients

Involuntary Treatment of Patients With Life-Threatening Anorexia Nervosa.

Anorexia nervosa has the highest mortality rate of any psychiatric illness. Predictors of mortality include chronicity of the illness, critically low body weight, and binging and purging behavior. Delusional beliefs body image, coupled with impaired judgment and cognition caused by starvation, often result in these patients adamantly resisting efforts to treat them. Guardianship, although useful in assisting with medical treatment decisions for patients with anorexia nervosa who are critically medically ill, is usually an inadequate intervention with respect to psychiatric treatment for these

Considerations in civil commitment of individuals with substance use disorders.

Several states currently have enacted laws that allow for civil commitment for individuals diagnosed with severe substance use disorders. Civil commitment or involuntary commitment refers to the legal process by which individuals with mental illness are court-ordered into inpatient and/or outpatient treatment programs. Although initially civil commitment laws were intended for individuals with severe mental illness, these statutes have been extended to cover individuals with severe substance use disorders. Much of the recent legislation allowing for civil commitment of individuals with substan

A follow-up of chronic patients committed to outpatient treatment.

Data collected in a statewide study of psychiatric patients involved in civil commitment hearings in North Carolina were used to evaluate the effectiveness of outpatient commitment as a less restrictive alternative to involuntary hospitalization. Six months after the commitment hearings, outcome data for patients who were committed to outpatient treatment were compared with outcome data for patients who were released and patients who were involuntarily hospitalized. All three groups comprised patients who were chronically mentally ill, had previously been hospitalized, and had histories of med

Social Determinants and Trends in Involuntary Psychiatric Detentions: A Decade of Population-Based Data.

OBJECTIVE: Involuntary psychiatric detentions have been increasing in Ontario, raising concerns about patient rights and health equity. Social determinants such as immigration status, indigeneity, housing instability, and socioeconomic disadvantage are known to contribute to this trend. However, population-level evidence on how these factors influence involuntary admissions remains limited. METHODS: Using data from the Ontario Mental Health Reporting System (2013-2023), the authors analyzed 53,088 adult psychiatric detentions. Sociodemographic and clinical variables from the Resident Assessme

Analysing risk factors for involuntary admission from an intersectional perspective: A latent class analysis.

BACKGROUND: Involuntary admission (IA) is a contentious practice in mental healthcare, justified only to prevent harm to self or others. Previous studies have identified individual sociodemographic characteristics as risk factors for IA. Intersectional theories argue that such approaches overlook the complexities of social identities and related health inequalities. Intersectionality stresses the interconnected nature of social identities, such as race or class, and analyses how these overlapping factors create unique experiences of marginalisation and discrimination. This study aimed to adopt

Closed venereology wards in postwar Hamburg.

BACKGROUND: A number of research results on closed venereology facilities in the Soviet Occupation Zone (SOZ) and the German Democratic Republic (GDR) have been presented in recent years. However, little is known about similar facilities in the Western Occupation Zones (WOZ) and in the early Federal Republic of Germany (FRG). METHOD: We have researched the records of the State Archive in Hamburg. Subsequently, the analysed sources were evaluated using the historically critical method. RESULTS: Three closed venereology wards existed in Hamburg. Compulsory commitments were conducted according

[Characteristics of patients who received an indication of involuntary admission, with or without the involvement of a third party, in a Parisian psychiatric emergency unit].

BACKGROUND: The French mental health law, first enacted on July 5, 2011, introduced the possibility of psychiatric commitment in case of extreme urgency (imminent peril - ASPPI). The decision of involuntary admission can then be made by the hospital director based on a medical certificate, without the need of a third party request. This procedure was intended to be applied on an exceptional basis, but its use is steadily increasing against the other types of involuntary care. Our study aimed at comparing the characteristics of patients who had received an indication for involuntary admission d

The imperfect fit: Fetal alcohol spectrum disorder as the basis to commit individuals involuntarily as sexually violent predators/persons.

Prenatal alcohol exposure produces a broad range of primary disabilities that lead to adverse life course outcomes in children raised in adverse environments. Inappropriate sexual behaviors are a commonly occurring secondary disability, with a large minority of individuals with fetal alcohol spectrum disorder (FASD) displaying sexual aggression. Adults with FASD who commit repeated criminal sexual acts may be subject to legal proceedings for indefinite involuntary civil confinement as sexually violent predators/persons (SVP) in certain jurisdictions in the United States. Factors predictive of changes in the legal status of psychiatric inpatients.

The objective of this study was to identify factors predictive of duration of involuntary hospitalization, i.e., factors that would predict early versus late conversion to voluntary status. Charts of 209 patients admitted involuntarily to an acute psychiatric inpatient unit were studied using a naturalistic, prospective design. Multivariate regression analysis was used to determine the effect of a number of variables in predicting duration of involuntary hospitalization. Of all variables studied, only smoking preference was found to be a statistically significant predictor of duration of invol

Legislative differences in compulsory mental health care for children and adolescents across European countries.

There is growing concern about the protection of children's rights in compulsory psychiatric care. To examine procedural and legal variations in compulsory mental health care for children and adolescents across European nations, the European Society for Child and Adolescent Psychiatry (ESCAP) commissioned this study. A structured questionnaire was developed using Google Forms and distributed via email to representatives of all 36 ESCAP member countries. The survey gathered information on legislation, commitment criteria, and procedural requirements for compulsory mental health care in minors.

Organophosphate intoxication-related coital-like involuntary movements: report of A case.

The neurologic manifestations of organophosphate intoxication are many, and different pathophysiologic mechanisms are responsible for the different presentations occurring at different stages of the disease process. Movement disorders constitute one of the neurologic manifestations, which may include Parkinsonism or other dyskinetic movements. However, involuntary coital-like movements have not been reported as one of the organophosphate intoxication-related movement disorders. In this case report, we describe a 71-year-old man who developed involuntary coital-like movements about one and a ha

[Involuntary hospitalization: A survey of liberty and custody judges].

The procedure of involuntary hospitalization in France has been recently modified by the law of 5 July 2011. Since that time, a liberty and custody judge has been appointed to guarantee the rights of psychiatric inpatients and to prevent abusive hospitalizations. Currently, for one involuntary hospitalization in ten a release is decided by the liberty and custody judge although psychiatrists consider that psychiatric care is necessary. In order to improve our understanding of the role of liberty and custody judges, and how they make their decisions, we conducted a qualitative survey of liberty

Civil commitment perspectives and experiences among friends and family of people who use illicit opioids in Massachusetts, USA.

BACKGROUND: Civil commitment statutes allow qualified individuals to petition for court-mandated commitment for someone with a substance use disorder (SUD). Despite a lack of empirical evidence showing efficacy of involuntary commitment, these statutes are prevalent worldwide. We examined perspectives on civil commitment among family members and close friends of people who use illicit opioids in Massachusetts, U.S.A. METHODS: Eligible individuals were Massachusetts residents, ≥18 years of age, did not use illicit opioids but had a close relationship with someone who did. We used a sequential
