The history of medicine this century is darkened by the downfall of the German medical profession, exposed during the doctors' trial at Nuremberg in 1946. This paper reviews objections to the proposal to allow parents of anencephalics to donate their infant's organs for transplantation and finds them unpersuasive. Instead, interpretations of 'Baby Doe' legislation, a 'higher-brain' functional conception of death, the idea of 'viability' in many abortion statutes, and the wishes of many patients, give strong support for the proposal for organ transplantation using anencephalics.

We present 95 cases of aortic valve incompetence (AI) due to a dystrophic aneurysm of the ascending aorta; the aneurysm was idiopathic in 83 cases and associated with Marfan's syndrome in 12 cases. The invocation of moral rights in moral/social debate today is a recipe for deadlock in our consideration of substantive issues. How we treat animals and humans in part should derive from the value of their lives, which is a function of the quality of their lives, which in turn is a function of the richness of their lives. We will set the stage for our analysis by reviewing selected medical aspects of anencephaly, outlining the history of the use of anencephalics as organ sources, and summarising the results of an important study recently completed at Loma Linda University. We will then employ some of the arguments and justifications underlying the Uniform Determination of Death Act (UDDA) to claim that anencephaly is morally equivalent to brain death, i.e., the reasons for considering brain-dead patients to be dead also apply to anencephalics. Finally, we will critique our proposal and discuss its implications.
