Post-traumatic stress disorder, human rights and access to healthcare: an analysis of judgments of the European Court of Human Rights from an ethical perspective.

Background: Human rights violations such as torture are associated with a high risk of post-traumatic stress disorder (PTSD). The judgements of the European Court of Human Rights (ECtHR) include a normative perspective on PTSD and address central ethical questions. Objective: To help bridge the gap between the psycho-medical and the legal discourse on human rights violations and to illustrate their medico-ethical implications by systematically assessing and categorizing all judgements by the ECtHR dealing with PTSD. Method: The ECtHR database was searched for 'post-traumatic stress disorder'.

Damned if you do, damned if you don't? The Lundbeck case of pentobarbital, the guiding principles on business and human rights, and competing human rights responsibilities.

In 2011 it emerged that to induce the death penalty, United States authorities had begun giving injections of pentobarbital, a substance provided by Danish pharmaceutical company Lundbeck. Lundbeck's product pentobarbital is licensed for treatment of refractory forms of epilepsy and for usage as an anaesthetic, thus for a very different purpose. The Lundbeck case offers a difficult, but also interesting Corporate Social Responsibility (CSR) dilemma between choices facing a pharmaceutical company to stop the distribution of a medical substance in order to avoid complicity in human rights violat

Informed Consent as a Human Right in the Inter-American Human Rights System (IAHRS).

Informed consent is presented as a fundamental right and principle in modern medical practice. It involves obtaining permission from a patient before any medical procedure, treatment, or research protocol. Although not explicitly recognized as a standalone right in international human rights instruments, informed consent in healthcare is considered a right derived from other rights, such as the rights to health and freedom. The jurisprudence of international human rights courts has permitted the reinterpretation of informed consent beyond just a bioethical principle. This article argues for th

The nexus of mental health, human rights and sustainability: interdisciplinary approach.

This paper explores the direct and indirect effects of climate change on mental health. It then goes on to describe recent judgements in human rights courts globally on climate change and its mental health implications, holding national governments to account for the mental health implications of climate change. It then explores ways in which psychiatrists can start to influence this nexus of mental health, sustainability and human rights in their clinical practice, in research and education as well as in policy making. This influence can be at the level of the individual patient and at the lo

Tuberculosis in Tibetan refugee settlements in India: a human rights perspective.

The statelessness and political vulnerability of Tibetans-in-exile in India are crucial drivers of tuberculosis (TB) in this population. The violent and forced displacement of Tibetans from Tibet into India in 1959 led to overcrowded and poorly resourced settlement camps that sparked a micro-epidemic of TB among exiled Tibetans, which persists to this day. This paper focuses on the diversity and precarity in legal status among Tibetans in exile in India, human rights implications and impacts on drivers of TB particularly access to housing, health care, nutrition, and employment. The absence of

[COVID-19 measures and human rights guaranteed by the Japanese Constitution].

Since March 2020, the Act on Special Measures for Pandemic Influenza and New Infectious Diseases Preparedness and Response has been a significant statute in dealing with COVID-19 in Japan. The Act mandates requests, instructions and orders for business suspension and shortened business hours, as well as stay-at-home requests. These measures limit freedom of movement and establishment, guaranteed rights under the Japanese Constitution. This article poses the following research question: "Does the Japanese Constitution allow measures against COVID-19 such as requests, instructions and orders for

Patterns and evidence of human rights violations among US asylum seekers.

BACKGROUND: Asylum seekers report exposure to human rights violations associated with a range of psychological and medical sequelae. Clinical evaluators can provide forensic evaluations that document evidence associated with their reports of persecution. The aim of this study was to characterize the forms of abuse experienced by asylum seekers, the psychological consequences of abuse, and the frequency with which clinician-evaluators found evidence that corroborated asylum seekers' reports. METHOD: We completed a retrospective chart review of 121 asylum seekers who received pro bono medical-l

Human rights and health disparities for migrant workers in the UAE.

Systematic violations of migrant workers' human rights and striking health disparities among these populations in the United Arab Emirates (UAE) are the norm in member countries of the Gulf Cooperation Council (GCC). Migrant laborers comprise about 90 percent of the UAE workforce and include approximately 500,000 construction workers and 450,000 domestic workers. Like many other GCC members countries, the UAE witnessed an unprecedented construction boom during the early 2000s, attracting large numbers of Western expatriates and increasing demand for cheap migrant labor. "We are not aliens, we're people, and we have rights." Canadian human rights discourse and high school climate for LGBTQ students.

Canadian law protects people from discrimination on the grounds of sexual orientation, but our public schools do not fulfill their ethical and legal obligations where sexual and gender minority youth are concerned. This article reports on a national survey study on homophobia and transphobia in Canadian high schools. Participants (n = 3,607) were questioned about school climate, harassment, school attachment, and institutional interventions. We found that schools were neither safe nor respectful for sexual and gender minority students, and we argue that ongoing exposure to this situation under

Addressing a Human Rights Crisis: Health Care for Prisoners in Australia.

People are sent to prison as punishment and not to experience additional punishment. Nevertheless, this principle is habitually violated in Australia: prisoners frequently receive health care that is inferior to health care that is available in the general community. Numerous official inquiries have identified deficiencies in prisoner health services, notwithstanding the apparent intention of legislative provisions and non-statutory guidelines and policies in various jurisdictions to ensure prisoners receive appropriate health care. This article proposes law reforms to address this human right

Family homelessness viewed through the lens of health and human rights.

Families with children, many of whom are headed by a single mother, are the fastest growing segment of the homeless population. Guided by Leininger's Culture Care Theory and the ethnonursing research method, the purpose of this study was to discover the care meanings and expressions for a group of 12 Appalachian mothers living with their children in an urban homeless shelter. Reflected in each mother's words and embedded within the 3 universal themes that emerged was the need to be treated with human dignity and respect. This need was seen as vital to the health and well being of these familie

Integrating women's human rights into global health research: an action framework.

This article uses Scale of Change theory as a framework to guide global health researchers to synergistically target women's health outcomes in the context of improving their right to freedom, equity, and equality of opportunities. We hypothesize that health researchers can do so through six action strategies. These strategies include (1) becoming fully informed of women's human rights directives to integrate them into research, (2) mainstreaming gender in the research, (3) using the expertise of grass roots women's organizations in the setting, (4) showcasing women's equity and equality in th

Public health and human rights: questions from an epidemic in Prato.

This article uses Carlo Cipolla's account of the plague epidemic in Prato in 1630-1631 to identify several key questions in public health. The article goes on to observe that the underlying problems posed for public health by the plague epidemic in Prato are similar, in important respects, to those encountered in addressing contemporary public health concerns. Questions of inequalities in health and socio-economic differentials in mortality; the relationship between economic wellbeing and health; the relevance of access to effective interventions; the significance of knowledge concerning disea

Family physicians and human rights: a case example from former Yugoslavia.

BACKGROUND: The role of family physicians in the protection of human rights is unclear. The purpose of this article is to explore this role through examination of the specific case of former Yugoslavia. METHODS: In January/February 1993, we investigated medical aspects of human rights abuses as part of a fact-finding mission for the Physicians for Human Rights organization. We used primarily qualitative methods, including direct observation, key informant interviews, focus groups, and key document review. RESULTS: We observed pervasive violations of medical neutrality, as indicated by the sh

[The right to food as a human right].

The right to adequate food is included as a human right in Article 25 of the Universal Declaration of Human Rights, in which dignity and equality are recognized as inherent to all people. The objective of the present work is to summarize the main statements contained in the international instruments related to this right. The text tries to clarify -according to such instruments and the derived thoughts in the international human rights system- what is the right to adequate food, what are the guarantees that can make it possible, what are the States commitments, what actions should be taken by

Engaging Human Rights in the Response to the Evolving Zika Virus Epidemic.

In late 2015, an increase in the number of infants born with microcephaly in poor communities in northeast Brazil prompted investigation of antenatal Zika infection as the cause. Zika now circulates in 69 countries, and has affected pregnancies of women in 29 countries. Public health officials, policymakers, and international organizations are considering interventions to address health consequences of the Zika epidemic. To date, public health responses have focused on mosquito vector eradication, sexual and reproductive health services, knowledge and technology including diagnostic test and v
