Legal consciousness and LGBT research: the role of the law in the everyday lives of LGBT individuals.

The law occupies a prominent place in the everyday lives of lesbian, gay, bisexual, and transgender (LGBT) individuals, and the continuing regulation and policing of sexuality and gender weighs heavily on many people who identify as LGBT. Despite remarkable progress in the area of LGBT civil rights, LGBT individuals in the United States still lack formal equality and are denied many of the protections that are afforded other historically disadvantaged groups. These legal disabilities represent an ongoing source of minority stress and can produce a correspondingly high degree of legal conscious

Criminal and legal responsibilities in Tourette's syndrome.

Tourette's Syndrome (TS) is a neuropsychological disorder characterized by the presence of multiple involuntary motor tics accompanied by one or more vocal tics. Articles about TS and criminal responsibility and the restriction of civil rights are limited. A person with TS was evaluated to consider his criminal responsibility after swearing at a referee during a football game. He was also evaluated as to whether or not he was capable of professionally driving a service bus. Additionally, medico-legal situations regarding military service, obtaining a shotgun license and marriages of patients w

AIDS: screening of possible carriers and human rights.

Like other serious infectious diseases, AIDS gives rise to a fundamental conflict between personal rights and public health. The recently developed test to detect antibody to the viral agent for AIDS is now predominantly being used to screen blood donors but it may spread to other settings. The possibility to demonstrate who is positive for the AIDS virus has raised a number of questions concerning the report-ability and confidentiality of test results; the right not to know and not to be informed about carrier status; the importance of informed consent as a requirement for testing; and the ci

Fetal syndromes and the charter: the Winnipeg glue-sniffing case.

The relationship between scientific knowledge and legal discourse is raised once again by a recent decision of the Supreme Court of Canada, a case involving a young Aboriginal woman who was pregnant and ordered by the court to remain in a drug treatment program at a health center until the baby was born. Her glue-sniffing habit was deemed dangerous to the normal development of the fetus. The Court held that her solvent-dependency did not justify the original court action, but both the Court and the various interveners disregarded the current state of our knowledge on the fetal syndromes. There

Lesbian, gay, bisexual, and transgender health issues and nursing: moving toward an agenda.

In a recent article, Eliason et al raise important questions regarding the need for nursing to focus greater attention on lesbian, gay, bisexual, and transgender (LGBT) issues. The present article discusses aspects of the profession's record on issues related to LGBT health and equality in the United States, focusing on civil rights, military discrimination, and human immunodeficiency virus/AIDS. It suggests an initial agenda focusing on public policy, nursing practice, education, and research. It then identifies potential organizational strategies for increasing the profession's visibility an

Psychosocial Effects of Health Disparities of Lesbian, Gay, Bisexual, and Transgender Older Adults.

The 1.5 million older adults who self-identify as lesbian, gay, bisexual, and transgender (LGBT) are expected to double in number by 2030. Research suggests that health disparities are closely linked with societal stigma, discrimination, and denial of civil and human rights. More LGBT older adults struggle with depression, substance abuse, social isolation, and acceptance compared to their heterosexual counterparts. Despite individual preferences, most health care providers recognize the right of any individual to have access to basic medical services. The U.S. Department of Health and Human S

Commentary: Disclosure in oncology -- to whom does the truth belong?

The term "therapeutic nondisclosure" refers to a clinician's decision to withhold diagnostic or prognostic information from a patient to protect him or her from perceived harm. We present a vignette in which the son of a 75-year-old Italian born immigrant asks her physician to withhold her new diagnosis of advanced myeloma. In the U.S., trends over the last 30 years have been toward more complete disclosure of cancer-related information. This can be attributed to the evolution of research subject protections, the "war on cancer," the civil rights and patient rights movements, and the rise of h

Compulsory Psychotropic Medication in the California State Prison System.

In Washington v. Harper, the U.S. Supreme Court established that an administrative review conducted by prison staff was the minimum constitutionally appropriate due process for the administration of compulsory nonemergent antipsychotic medication. California's current process, Penal Code section 2602 (PC2602), uses a judicial review allowing for either emergent (medication beginning with application) or nonemergent routes. This article describes the history culminating with PC2602, beginning with the notion of civil death enacted in 1850, followed by the 1986 Keyhea injunction. Framed by probl

Sex reassignment surgery in France: analysis of the legal framework and current procedures and its consequences for transsexuals.

MAIN OBJECTIVES: In France there is no specific law that recognizes either sex reassignment surgery (SRS) or changes in civil status. This practice is based on a set of rules that have been devised by those practitioners in the disciplines involved. This study has been directed to evaluate the perceptions of French surgeons regarding their own activity in the area of the SRS with the implications that these perceptions may have on the management of patients and to contribute to a useful international collection of material on this difficult topic in terms both of report and interpretation. Voting rights for persons with serious mental illnesses in the U.S.

OBJECTIVE: Voting is a fundamental right in democratic societies. Despite this fact, persons with serious mental illnesses (SMIs) frequently encounter barriers to exercising this right. The purposes of this Brief Report are to emphasize the importance of electoral participation in this population, to describe common barriers, and to outline relevant federal and state laws. METHOD: We conducted a review of the relevant psychological and legal literature. FINDINGS: Due to the structural barriers that they encounter, individuals with SMIs are less likely to vote than the general population. Fed

Citizenship and Learning Disabled People: The Mental Health Charity MIND's 1970s Campaign in Historical Context.

Current policy and practice directed towards people with learning disabilities originates in the deinstitutionalisation processes, civil rights concerns and integrationist philosophies of the 1970s and 1980s. However, historians know little about the specific contexts within which these were mobilised. Although it is rarely acknowledged in the secondary literature, MIND was prominent in campaigning for rights-based services for learning disabled people during this time. This article sets MIND's campaign within the wider historical context of the organisation's origins as a main institution of

Therapeutic policing: How public-order homelessness policy reconfigures psychiatric nursing work.

On July 24, 2025, a U.S. executive order reframed unsheltered homelessness around public order, encouraged broader civil commitment, prioritized enforcement of camping restrictions, and directed agencies away from Housing First. This policy paper analyzes how those levers may shift coercion and administrative burden into psychiatric settings. Likely nursing effects include role drift toward legal-interface work, thinner voluntariness, documentation pressure, moral distress, and capacity strain. Canadian Housing First evidence and World Health Organization rights-based guidance provide internat

Disrupting the Reproductive Lives of Japanese American Families During Wartime: The Overlapping Histories of Removal, Incarceration, and Eugenic Sterilization, 1942-1946.

The World War II mass incarceration of 120,000 Japanese Americans disrupted families, enacted intergenerational trauma, and characterized Japanese Americans as inherent racial threats. This federal exercise in biopolitical management intersected with state-sponsored eugenic sterilization in California institutions. Linking War Relocation Authority and California Department of Institutions records, we document 32 Japanese American sterilization survivors during the wartime incarceration period (1942-1946). We show how federal and state authority converged to deprive Japanese Americans of civil

Challenges in Assessment and Management of Postoperative Agitation and Delirium in a Stroke Patient with Limited English Proficiency: Case Report.

While Title VI of the Civil Rights Act of 1964 mandates use of interpreters for patients with limited English proficiency, significant disparities persist in intensive postsurgical care. We present the case of a 60-year-old Vietnamese-speaking man with a Type A aortic dissection requiring postoperative mechanical ventilation and stroke care. Despite use of a remote video interpreter, our language-discordant nursing and physician providers faced challenges in managing agitation and delirium and assessing neurological function. This case highlights the need for adequate interpretation equipment,

COVID-19 and the ethics of quarantine: a lesson from the Eyam plague.

The recent outbreak of the SARS-CoV-2 coronavirus is posing many different challenges to local communities, directly affected by the pandemic, and to the global community, trying to find how to respond to this threat in a larger scale. The history of the Eyam Plague, read in light of Ross Upshur's Four Principles for the Justification of Public Health Intervention, and of the Siracusa Principles on the Limitation and Derogation Provisions in the International Covenant on Civil and Political Rights, could provide useful guidance in navigating the complex ethical issues that arise when quarantin

Mental Health in Sexual Minority and Transgender Women.

Although sexual minority women (SMW) and transgender women have become increasingly visible in recent years and have made progress in achieving civil rights, they continue to face significant levels of discrimination, stigma, and physical violence. As a result, each group faces a wide variety of health disparities, including mental illness and substance use disorders. Overall, both SMW and transgender women experience higher rates of mood and anxiety disorders, suicidality, and substance use disorders than their heterosexual and cisgender counterparts. This article is a general introduction to

An analysis of the vascular injuries and attempted resuscitation surrounding the assassination of Martin Luther King Jr.

Martin Luther King Jr was the most prominent civil rights leader in the United States in the 1960s. He was shot by an assassin in Memphis, Tennessee, on April 4, 1968. After the shooting he was taken to a local hospital where he had an unsuccessful resuscitation for a right subclavian artery transection. Despite the fact that the circumstances around the assassination have been frequently reported and reviewed in the past 50 years, the specific vascular care of the traumatic injury has not been analyzed. This paper reviews the medical aspects of the King assassination and the management of his
