An amicus brief in favor of allowing race-based decisions in health professions schools.

An amicus curia, translated from the Latin means 'friend of the court', is a brief submitted to the court by an individual or interest groups who are not party to a court ruling, but have a strong interest in the matter under consideration by the court. This article represents such an endeavor as it relates to the recent Supreme Court decision barring the use of race-conscious admissions in colleges and universities. Though much has changed since this article was submitted, the thesis of this paper remains relevant: that, like military academies, health profession schools should be allowed to

Insight and capacity to consent to electroconvulsive therapy.

OBJECTIVE: To critically examine a recent decision of the Victorian Supreme Court that found that the Mental Health Tribunal and the Victorian Civil and Administrative Tribunal erred in the application of the capacity test in the Mental Health Act 2014 (Vic) and that compulsory electroconvulsive therapy would infringe upon the human rights of two patients who had no insight into their chronic schizophrenia. CONCLUSIONS: After considering the concepts of insight and capacity to consent to treatment, the paper concludes that the decision in NJE and PBU v Mental Health Tribunal [2018] VSC 564 is

Employer liability in work accident: A machine learning application from the health and safety at work perspective in Colombia.

BackgroundWork accidents have been studied from the perspective of outcome indicators, quantifying the frequency and severity of the occurrences. However, accidents at work continue to be a problem. In 2019, 611,275 accidents occurred in Colombia. All of this led workers to file lawsuits against employers, resulting in rulings by the Supreme Court of Justice's Labor Cassation Chamber-a topic that has been little studied.ObjectiveThis paper aims to develop and evaluate a machine learning model, the Surface Tension Neural Net-Decision Tree (STNN-DT), for classifying and predicting the favorabili

Fetal syndromes and the charter: the Winnipeg glue-sniffing case.

The relationship between scientific knowledge and legal discourse is raised once again by a recent decision of the Supreme Court of Canada, a case involving a young Aboriginal woman who was pregnant and ordered by the court to remain in a drug treatment program at a health center until the baby was born. Her glue-sniffing habit was deemed dangerous to the normal development of the fetus. The Court held that her solvent-dependency did not justify the original court action, but both the Court and the various interveners disregarded the current state of our knowledge on the fetal syndromes. There

California v. Texas: Avoiding an Antidemocratic Outcome.

The Affordable Care Act ("ACA") contains a section titled "Requirement to Maintain Essential Minimum Coverage." Colloquially known as the Individual Mandate, this section of the Act initially established a monetary penalty for anyone who did not maintain health insurance in a given tax year. But with the passage of the Tax Cuts and Jobs Act, the monetary penalty was reset to zero, inducing opponents of the ACA to mount a legal challenge over the Individual Mandate's constitutionality. As the third major legal challenge to the ACA, California v. Texas saw the Supreme Court punt on the merits an

Sterilization Rates of Pregnancy-Capable People at a Single Institution in Wisconsin Before and After Dobbs v Jackson Women's Health Organization.

INTRODUCTION: On June 24, 2022, the United States Supreme Court decided Dobbs v Jackson Women's Health Organization (Dobbs), overturning Roe v Wade and banning abortions in almost all circumstances in Wisconsin. We tested the hypothesis that the rate of interval tubal sterilizations in people capable of pregnancy increased after the Dobbs decision. METHODS: We conducted a retrospective cohort study of all pregnancy-capable patients ages 18 to 55 years old who underwent interval surgical sterilization at an academic hospital in Wisconsin from June 24, 2016, through June 23, 2023. We defined th

Banning Gender-Affirming Treatment for Minors: The Supreme Court Speaks.

In United States v. Skrmetti, the U.S. Supreme Court considered the constitutionality of a Tennessee law prohibiting certain medical procedures for the treatment of minors with gender dysphoria. A majority of the justices agreed that the law failed to violate the U.S. Constitution's equal protection provision. Because the law failed to distinguish among patients on the basis of sex, they said, it required only a rational basis to survive constitutional scrutiny. A lack of solid evidence on appropriate treatment for transgender minors supplied this rational basis. The Skrmetti majority strained

How the Dobbs Decision Shapes Postpartum Permanent Contraception Decision-Making Among Birthing People and Their OB-GYNs.

The Supreme Court's Dobbs decision in June 2022, which overturned the federal protection of abortion, has been associated with increases in patient requests for female permanent contraception (i.e., tubal ligation, salpingectomy). Our objective is to understand perspectives of postpartum patients and their delivering obstetrician-gynecologists on the impact of Dobbs on patient decision-making surrounding permanent contraception. From March 2022 to January 2023, we interviewed postpartum women with a documented desire for permanent contraception (n = 81) and their delivering obstetrician-gyneco

Changes in female permanent contraception at academic medical centers following the Dobbs decision.

OBJECTIVES: To compare the volume of female permanent contraceptive procedures before and after the Supreme Court Dobbs decision, and to assess the impact of political factors on patient decision-making. STUDY DESIGN: We conducted a multicenter retrospective study of interval permanent female contraceptive procedures at four academic medical centers in New York, Pennsylvania, Florida, and Tennessee, comparing a pre-Dobbs (July 1, 2021-June 30, 2022) and post-Dobbs cohort (July 1, 2022-June 30, 2023). The primary outcome was a change in procedure volume, with secondary outcomes including diffe

The risk of birth defects: Jacobs v. Theimer and parents' right to know.

This Article discusses the Texas Supreme Court's holding in Jacobs v. Theimer that the parents of a defective child had a cause of action for damages against a physician for alleged negligent failure to inform the mother during pregnancy that she had contracted rubella and therefore might have a defective child, thereby causing her to lose the opportunity to have an abortion. The Article raises a number of questions that post-Jacobs courts probably will confront concerning the duty of physicians and genetic counselors to keep their clients informed; describes some social and medical developmen

Health Equity in a Post 'Roe Versus Wade' America.

For almost five decades, the US Supreme Court had protected the right to abortion care in the United States. However, the Court's decision in 'Dobbs versus Jackson Women's Health Organization' in 2022 established that the US Constitution does not confer a right to abortion, effectively overturning the Court's own previous judgment in 'Roe versus Wade' from 1973. How could a decision that overturns the precedent for nationwide access to abortion affect women, children, and physicians? How will state laws impact healthcare equity regarding reproductive rights going forward? How will geography af

The criminalisation of women's healthcare in the post-Dobbs era: an analysis of the anti-abortion trigger law statutes.

On 24 June 2022, the U.S. Supreme Court's decision in Dobbs v. Jackson Women's Health Organisation held that:'The Constitution does not confer a right to abortion; Roe and Casey are overruled; and the authority to regulate abortion is returned to the people and their elected representatives.'Since the ruling, thirteen states have enacted 'trigger laws' that restrict access to abortion except in specified circumstances, such as to save the life of the pregnant patient in a medical emergency. These laws not only inappropriately insert the State into the physician-patient relationship, but create

Commentary: Involuntary Antipsychotics in Prison—Extending Harper, Contracting Care?

This commentary on Salem et al. provides background for their study by reviewing Washington v. Harper and outlining some areas that were not addressed by that decision. It contrasts Harper holdings with those in other U. S. Supreme Court decisions in parallel cases and in United States v. Loughner. It provides cautions about extensions of some holdings in Loughner regarding the use of Harper-type administrative procedures. This article also reviews the methods and findings of Salem et al. and encourages further work. Finally, it raises cautions and voices a call to action concerning potential

Anticipated Negative Impact of Dobbs v. Jackson Women's Health Organization Among Young Adult Black Women in the US.

PURPOSE: The United States Supreme Court case Dobbs v. Jackson Women's Health Organization overruled federal protections for abortion in 2022. Young adult Black women (YABW) are expected to be among those most impacted directly by abortion restrictions and indirectly by effects on broader sexual and reproductive health access. This study assessed the extent to which this population anticipates negative impacts of the ruling. METHODS: A nationwide convenience sample of 500 YABW 18-22 years participated in an online sexual and reproductive health survey in November-December 2023. Participants r

Justice, Disability, and Law: A Neurological and Ethical Assessment of Multiple Sclerosis in Turkey.

BACKGROUND: This study analyzes Supreme Court decisions involving parties diagnosed with Multiple Sclerosis (MS) between 2008 and 2024, focusing on disability justice and the normative evaluation of judicial practice. MS is a chronic neurological disease with potential physical and neurocognitive consequences that may affect legal capacity, employment, and social participation. The study is grounded in the United Nations Convention on the Rights of Persons with Disabilities (CRPD), Daniels’ principle of Fair Equality of Opportunity, and Fricker’s concept of epistemic injustice. METHODS: A qual

Issues surrounding lethal injection as a means of capital punishment.

Lethal injection as a method of state-sanctioned capital punishment was initially proposed in the United States in 1977 and used for the first time in 1982. Most lethal injection protocols use a sequential drug combination of sodium thiopental, pancuronium bromide, and potassium chloride. Lethal injection was originally introduced as a more humane form of execution compared with existing mechanical methods such as electrocution, toxic gassing, hanging, or firing squad. Lethal injection has not, however, been without controversy. Several states are considering whether lethal injection meets con

A chill wind blows: Webster, obstetrics, and the health of women.

The Supreme Court decision in Webster v Reproductive Health Services permits states to regulate abortion in fashions that may be medically unsound and may significantly restrict access. This decision challenges the contemporary practice of obstetrics and threatens to curtail access to needed services, particularly for poor women, who are at highest risk of pregnancy-associated medical complications and death. Governmental restrictions on abortion interfere with the obstetrician's basic goal of providing optimal care for the patient. Obstetricians dedicated to providing the best care to their p
