A longitudinal description of incompetent to stand trial admissions to a state hospital.

OBJECTIVE: Evidence is clear that the nation is experiencing an increasing number of incompetent to stand trial (IST) admissions to state hospitals. As a result, defendants in need of treatment can wait in jail for weeks for admission for restoration. This study was conducted to better understand this growing population and to inform hospital administration about the characteristics of IST admissions. METHODS: The study was conducted at the Department of State Hospitals (DSH) facility in Napa (DSH-Napa), a 1200-bed primarily forensic inpatient psychiatric facility located in northern Californ

Pyromania in court: Legal insanity versus culpability in Western Europe and the Netherlands (1800-1950).

This article provides an overview of medico-legal views concerning pathological firesetting in Western Europe and the Netherlands in the period 1800-1950. This article aims to answer the question how changing views on firesetting as either a culpable act or an excusable expression of pathology have influenced the actual court decisions over time. The focus will be on the notion of pyromania and its implications on criminal responsibility and relevant developments concerning pathological firesetting are placed in a judicial context. In particular, the legal effects of changing views on firesett

Treatment as punishment: forensic psychiatry in The Netherlands (1870-2005).

This article provides an overview of the development of forensic psychiatry in the Netherlands from the late nineteenth to the early twenty-first century. The first part addresses the ways forensic psychiatry established itself in the period 1870-1925 and focuses on its interrelatedness with forensic practice, psychiatry's professionalization, the role of the government, the influence of the so-called New Direction in legal thinking and (Italian and French) anthropology of crime, and the debates among physicians as well as between psychiatrists and legal experts on the proper approach of menta

Mania, homicide and severe violence.

BACKGROUND: Mania has been reported to be a risk factor for aggression and violence in psychiatric hospitals, but the extent of any association between mania and severe interpersonal violence in community settings is not known. AIM: To examine the association between mania and severe violence in a series of patients found not guilty by reason of mental illness (NGMI). METHODS: A review of the court documents of those found NGMI of offences involving severe violence, including homicide, attempted homicide and assault causing wounding or serious injury, in New South Wales between 1992 and 2008

From stack-firing to pyromania: medico-legal concepts of insane arson in British, US and European contexts, c. 1800-1913. Part I.

This article surveys evolving and competing medico-legal concepts of pyromania and insane arson. Exploiting evidence from medical jurisprudence, medico-legal publications, medical lexicography and case histories, it seeks to explicate the key positions in contemporary professional debates concerning arson and mental derangement. A major focus is the application of the doctrines of moral and partial insanity, monomania, instinctive insanity and irresistible impulse to understandings of pyromania and insane arson. The limited extent to which mental defect provided a satisfactory diagnosis and ex

Axis I and Axis II diagnostic parameters of homicide.

A series of 100 murderers was examined to discern overall patterns of psychopathology. In addition, demographic and other discriminating factors were used to test the hypothesis that murderers do not constitute a homogenous population and that subgroups will differ diagnostically. DSM-III diagnostic criteria were used to make each diagnosis. The sample was found to be representative of the universe from which it was drawn at least as could be determined by available comparative criteria. Four Axis I (psychoses, substance abuse, dysthymia, no Axis I) and three Axis II (antisocial, borderline, n

Criminal responsibility and solvent exposure.

This case report contains the history of a man's exposure to benzene, trichloroethylene, and toluene. J suffered acutely from classic symptoms of toxic exposure to these compounds, such as fatigue, clumsiness, staggering, and hematopoietic depression. During his medical hospitalization, he was exposed to further organic insults, such as being treated with medications like Cytoxan and medications to treat an abscess in his right parietal lobe. After the acute exposure and after the abscess had resolved, his functioning on neuropsychological testing was still depressed, as he had a Full Scale IQ

Emerging problems for staff associated with the release of potentially dangerous forensic patients.

Mental health professionals have been concerned recently about their liability for the actions of patients in their outpatient practices. The history of suits against clinicians for negligent release of inpatients extends back several decades since before the Tarasoff decision. The authors suggest that the same consumerism/victims' rights trends that resulted in Tarasoff and its progeny are likely to rebound again on forensic clinicians and that such pressures are likely to add to other political and social pressures that already complicate the treatment of forensic inpatients. They present th

Without thinking: impulsive aggression and criminal responsibility.

In the U.S. the decision to impose criminal responsibility rests on an assumption about the defendant's decision to engage in proscribed conduct. We punish only those who we believe had the capacity to make a choice. In an increasingly violent world, the criminal law and the assumptions upon which it rests are relentlessly tested. A new generation of neuro-imaging technologies offers to provide insights into structural and functional abnormalities in the brain that may limit the autonomy of many dangerous offenders and unravel the fabric of the criminal justice system. How will the results of

Brains in context in the neurolaw debate: the examples of free will and "dangerous" brains.

Will neuroscience revolutionize forensic practice and our legal institutions? In the debate about the legal implications of brain research, free will and the neural bases of antisocial or criminal behavior are of central importance. By analyzing frequently quoted examples for the unconscious determinants of behavior and antisocial personality changes caused by brain lesions in a wider psychological and social context, the paper argues for a cautious middle position: Evidence for an impending normative "neuro-revolution" is scarce and neuroscience may instead gradually improve legal practice in

Are there lessons to be learned from a more scientific approach to mental condition defences?

The timing of the English Law Commission's consideration of reform to the law of insanity coincides with increasing scientific and in particular neuroscientific understanding of the brain. The work of researchers is leading to a greater comprehension of what had been termed irresistible impulses to commit crime and of the impact of brain damage, particularly evidence of brain lesions and frontal lobe damage on behaviour. There remain problems in establishing causal relationships which might diminish or eliminate criminal responsibility for crimes committed by those suffering from pre existing

[Medical expert assessment in psychiatry].

Especially regarding two respects, the psychiatric expert assessment differs from the expert assessment of other medical specialties: (1) No laboratory tests or technical equipment are available for the psychiatrist except for mental disturbances due to physical impacts such as brain injuries or intoxications. The psychiatrist depends on a carefully compiled case history and a differentiated psychodiagnostic. This may lead to a wrong assessment due to a lack of objectiveness. (2) There are a lot of legal areas where only the psychiatric or psychological expert opinion is required: i.e., the qu

The behavioral variant of frontotemporal dementia: An analysis of the literature and a case report.

The aim of this case report is to underline the importance of possible legal consequences of the behavioral variant of frontotemporal dementia (bvFTD). This disease is associated with antisocial behavior, impulse control disorder and cognitive and personality impairment, which are often the earliest manifestations of the bvFTD. One of the antisocial behaviors possibly associated with this neurodegenerative disease is pathological stealing. This case report is about a 50-year-old Italian man who had a regular life until 2010. In 2010 and 2011, some critical events occurred: he lost his job, his

Dynamic and static factors associated with discharge dispositions: the national trajectory project of individuals found not criminally responsible on account of mental disorder (NCRMD) in Canada.

The majority of individuals found not criminally responsible on account of mental disorder (NCRMD) in Canada spend some time in hospital before they are conditionally or absolutely (no conditions) discharged to the community by a legally mandated review board. By law, the decision to conditionally discharge an individual found NCRMD should be guided by the need to protect the public, the mental condition of the accused, and the other needs of the accused, especially regarding his/her community reintegration. At the time of this study, Canadian legislation and case law required that the review

Trends and challenges in forensic research on offenders with intellectual disability.

BACKGROUND: The Journal of Intellectual & Developmental Disability has a well-respected history of establishing the parameters and contributing to developments in the field of offenders with intellectual disability (ID). METHOD: The field has seen a number of developments over the past 15 years, and this paper identifies several trends that have emerged in the research during this period, including work on prevalence of ID in prison populations, development of risk assessment, consideration of staff issues, developing the psychometrics of offence-specific assessments, evaluating treatment met

Urinary excretion of bufotenin (N,N-dimethyl-5-hydroxytryptamine) is increased in suspicious violent offenders: a confirmatory study.

We previously reported that violent offenders with paranoid symptoms or whose violent actions had been directed against family members had higher urinary levels of bufotenin than other violent offenders. In the present study, patients were evaluated with the Karolinska Scales of Personality (KSP), and urinary levels of bufotenin were determined by mass spectrometry. In drug-free patients suspiciousness was positively correlated, and socialization was negatively correlated, with urinary bufotenin excretion. These two personality variables were strongly interdependent. In drug users, bufotenin e

The psychometric assessment of alcoholism in forensic groups: the MacAndrew scale and response bias.

Although the MacAndrew Alcoholism scale is the most widely used Minnesota Multiphasic Personality Inventory (MMPI) measure of vulnerability to alcohol abuse, its accuracy has not been studied in patients intrinsically motivated to exaggerate or minimize psychopathology. We examined the usefulness of the MAC in predicting alcohol abuse in a forensic clinical sample. Results indicate the MAC (a) was not more effective than direct inquiry in this group, (b) scores were correlated negatively with minimization and positively with exaggeration for subjects with histories of alcohol abuse, (c) offere

[Criminal responsibility in schizophrenia with special attention to the mental state during the criminal act--a study based upon the activation-recurrence phenomenon].

In this article, psychiatric arguments regarding criminal responsibility in schizophrenia are reviewed, and it is pointed out that the arguments have been influenced by the theory of process psychosis. Moreover, two cases judged on the basis of the activation-recurrence phenomenon are exemplified, and fundamental issues are discussed. Investigating the mental state just before the crime helps when deliberating over criminal responsibility. A study of the activation-recurrence phenomenon, conducted by Shinkai and Miyasaka, contributes toward clarifying the recurrence of the micropsychotic state
