During the past decade, interest in medical malpractice has increased both by the public and the authorities. Malpractice is likely to be considered if an adverse effect occurs shortly after medical intervention, but complications might lead to impairment or death of the patient even years after surgical treatment. Two unusual cases of such late complications are described. In the first case, the patient died from a complication, which was due to an unnoticeable malfunction of a surgical device. The second case concerns a retained surgical towel, which had remained within the abdominal cavity

PURPOSE: To identify causes of purported malpractice in diagnosis and treatment of breast cancer.
MATERIALS AND METHODS: The authors reviewed cases from The New York Jury Verdict Reporter listed between 1985 and 1991 to look for those in which there was alleged delay in diagnosis or treatment of breast cancer.
RESULTS: Of 34 cases identified, 32 (94%) were based on presumed delay in diagnosis and only two (6%) on claims of therapeutic malpractice. Delay in diagnosis was commonly claimed in patients younger than 50 years (76%). Palpable masses were present in 94% of these cases. Either mammog

BACKGROUND: Spine surgery is a high-risk specialty for litigation, with most practicing surgeons encountering at least 1 malpractice claim during their careers. This systematic review aimed to evaluate the trends and characteristics of medical malpractice claims after spine surgery.
METHODS: A systematic search was conducted on PubMed, Scopus, Embase, and Web of Science to find studies reporting on patients who underwent spine surgery and sued their surgeons. Studies that included original extractable data on litigation after spine surgery were included without date or geographical restrictio

The aim of the present study was to review orbital fracture malpractice litigation, including case outcomes and compensatory damages.
METHODS: The Westlaw and Lexis Nexis databases were queried for jury verdicts and settlements related to orbital fracture malpractice lawsuits. The Boolean terms included "orbit! /10

Malpractice claims involving robot-assisted surgical procedures have increased more than 250% in the past 7 years compared to the seven years prior. We examined robotic surgery malpractice claims to identify trends in claimed liabilities, describe legal outcomes, and determine strategies to minimize future litigation. The Westlaw legal database was queried retrospectively for U.S. state and federal trials regarding robot-assisted surgical procedures from 2006 to 2013 and 2014 to 2021. Data abstracted from verdict reports included year, state, court type, defendant specialty, procedure performe

BACKGROUND: Pancreatic operations are technically complex with a significant risk of morbidity and mortality. Analysis of litigation following surgery can disclose avoidable errors.
METHODS: Two legal databases, Westlaw and Lexis Nexis, were queried for jury verdicts, settlements and appeal cases in the United States related to pancreatic surgery and malpractice between 1980 and 2020.
RESULTS: Thirty-four cases were analyzed. Pancreaticoduodenectomy (n = 22, 65%) was the most common procedure litigated. Claims most commonly involved malpractice in the postoperative (n = 16) setting. The most

PURPOSE: To identify patient-, provider-, and claim-related factors of medical malpractice claims in which physician trainees were directly involved in the harm events.
METHOD: The authors performed a case-control study using medical malpractice claims closed between 2012-2016 and contributed to the Comparative Benchmarking System database by teaching hospitals. Using the service extender flag, they classified claims as cases if physician trainees were directly involved in the harm events. They classified claims as controls if they were from the same facilities, but trainees were not directly

BACKGROUND: Because acute compartment syndrome is one of the few limb-threatening and life-threatening orthopaedic conditions and is difficult to diagnose, it is a frequent source of litigation. Understanding the factors that lead to plaintiff verdicts and higher indemnity payments may improve patient care by identifying common pitfalls.
METHODS: The VerdictSearch legal claims database was queried for the term "compartment syndrome." After 46 cases were excluded for missing information or irrelevancy, 139 cases were reviewed. The effects of plaintiff demographics, mechanism of injury, and com

Despite the recognition by many researchers that cerebral palsy (CP) is rarely related to obstetric malpractice, there are many instances where obstetricians face litigation when a child is diagnosed with cerebral palsy following a difficult delivery. The aim of this paper is to review relevant research papers to aid practitioners involved in obstetric malpractice litigation. It is also prudent to question the feasibility of costs for long-term care for children with disabilities being met through the legal process.

De Clérambault's Syndrome or Erotomania was originally described as a delusional disorder in which a woman believes that an older man of higher social status is passionately in love with her. The patient's relentless pursuit of the delusional love object, often with escalating intrusiveness, may eventually involve threats or overt acts of retaliation, in response to repeated rejection, unrequited love, or alleged betrayal. Cases from the literature are reviewed in which the delusional romantic attachment involves the patient's psychiatrist or another medical specialist. The authors present a c

BACKGROUND: Tumors that affect the visual system are a significant cause of liability claims involving eyecare practitioners. Individuals with brain tumors or intraocular tumors may seek examination for associated binocular vision disorders such as strabismus and reduced acuity. A disporportionate number of these individuals are children.
METHODS: A review of malpractice claims was performed to identify representative clinical presentations in which binocular vision disorders were the cause for examination.
RESULTS: Strabismus and amblyopia in children, if not promptly diagnosed and properly

Ovarian cysts are commonly encountered during pregnancy, often being benign and asymptomatic. However, in some cases, surgical intervention may be necessary. This case report presents a patient who underwent ovarian cyst removal during a cesarean section. We discuss the indications for surgery, surgical approach, potential complications, and outcomes. This case aims to contribute to the limited literature on this subject and evaluate whether this practice is justified or constitutes malpractice.
