[HIV antigen test of blood donors].

The importance of an optimal diagnostic standard for the prevention of transfusion-associated AIDS (TAA) was recently enforced by a decision of our Supreme Court. Although only 18 transfusion-associated HIV infections following transfusion of approximately 30 million blood units were officially reported since 1985, HIV-1 p24 antigen testing of blood donors was introduced in Hamburg and by the Bavarian Red Cross in summer 1992. So far, no p24 antigen-positive, HIV antibody-negative blood donor has been found (May 1993).

Using litigation to defend women prosecuted for abortion in Mexico: challenging state laws and the implications of recent court judgments.

While women in Mexico City can access free, safe and legal abortion during the first trimester, women in other Mexican states face many barriers. To complicate matters, between 2008 and 2009, 16 state constitutions were amended to protect life from conception. While these reforms do not annul existing legal abortion indications, they have created additional obstacles for women. Health providers increasingly report women who seek life-saving care for complications such as haemorrhage to the police, and some cases eventually end up in court. The death of Roe and the future of ex vivo embryos.

This article examines the possible effects of the end of a federal constitutional right to abortion on clinical practice and research involving ex vivo human embryos. It first analyzes the likely outcomes of Dobbs v. Mississippi, concluding the Supreme Court will either overrule the federal constitutional abortion right or restrict it in a way that leads to its rapid disappearance. Next, the article discusses a possible increase in use of preimplantation genetic testing as one result. It then forecasts the likely ramifications of such a court decision on state legislation affecting ex vivo hum

[Rethinking criminal responsibility: practical application of operational diagnosis and gnostic into expert testimony].

There had been argument concerning the difference between the agnostic approach and the gnostic approach to the psychiatric perspective of criminal responsibility until the landmark ruling by the 3rd court of the Japanese Supreme Court in 1984. The decision upheld the gnostic approach and affirmed that the defendant's criminal responsibility should be based on such factors as psychopathology, motive, modus operandi, situation surrounding the crime, and pre-morbid personality, as long as the offense was not directly motivated by the delusion or hallucination. The gnostic explanation includes so

How Foundations of Carceral Health Care Came From a Right to Sue.

The focus of the American Medical Association (AMA) on health care for persons who are incarcerated was in response to the US Supreme Court's 1964 Cooper v Pate holding. This article summarizes key points from AMA work during the 1970s that led to further development of carceral care standards by the National Commission on Correctional Health Care.

LabCorp v. Metabolite Laboratories: The Supreme Court listens, but declines to speak.

In the United States, a longstanding legal rule exists against patenting natural phenomena. The Supreme Court recently had an opportunity to help define the boundaries and clarify the implications of this "natural phenomenon doctrine" in Laboratory Corporation of America v. Metabolite Labs., dismissed as improvidently granted. This article argues that the natural phenomenon doctrine renders both the patent claim at issue in LabCorp, and the patents that directly or indirectly claim biological correlations between genotypes and medical phenotypes, invalid or unenforceable under U.S. patent law.

Institutionalization, involuntary sterilization, and mental retardation: profiles from the history of the practice.

For much of the 20th century, the practice of sterilization was a common accompaniment to institutionalization for individuals with mental retardation. Following the Supreme Court's decision in Buck v. Bell (1927) supporting the practice, numerous states passed legislation and, consequently, over 60,000 individuals with mental retardation were sterilized in this country. In the present study we analyzed data on 212 individuals in Virginia who were sterilized. Our focus included gender, age at and date of sterilization, level of mental retardation, and location of subsequent discharge. The natu

[Association between Minamata disease status and activities of daily living among inhabitants in previously methylmercury-polluted areas].

OBJECTIVES: Minamata disease (MD), first discovered in 1956, is a neurological disorder caused by mercury poisoning due to daily intake of fish and shellfish that have been contaminated by methylmercury discharged from chemical factories. However, reports of ill health increased sharply following the 2004 Supreme Court ruling instructing the Japanese government to pay damages to MD patients. We examined the distribution of disability in activities of daily living (ADL), and the association between MD status in terms of compensation system and ADL disability among the general population of prev

Pregnancy, drug testing, and the fourth amendment: legal and behavioral implications.

In its efforts to protect the health of unborn children, the government is increasingly attempting to regulate pregnant women's conduct. As with other policies affecting pregnant women's autonomy, these policies have constitutional overtones. In Ferguson v. City of Charleston (2001), the Supreme Court struck down a South Carolina hospital's policy of testing pregnant women for cocaine and turning positive results over to law enforcement for prosecution. This article discusses the basis of the decision and its legal and behavioral implications. Although the decision came down on the side of pre

Changes in tubal permanent contraception rates in South Carolina following the Dobbs decision: a retrospective cohort study.

BACKGROUND: The Supreme Court finalized its decision in Dobbs v Jackson Women's Health Organization on June 24, 2022, overturning nearly 50 years of constitutional protection for abortion in the United States under Roe v Wade (1973) and Planned Parenthood v Casey (1992). This subsequently allowed states to implement or enforce more restrictive abortion policies and bans. Multiple studies have demonstrated increased demand for permanent contraception at the national level and across institutions in states with varying degrees of abortion policies. Whether a similar increase occurred in South Ca

We Might Have a Sports Gambling Problem and It Is Not What You Think: A Commentary.

The 2018 Supreme Court decision on Murphy v. National Collegiate Athletic Association brought not only a change in the United States commercial gambling landscape, but also considerable speculation across public forums about whether expanded sports gambling causes new, distinct, and greater harm than existing legal forms of gambling. This commentary brings into the focus that the definition of this form of gambling has recently begun to shift without a theoretical basis or empirical evidence. To bring evidence to bear, there is a need for a precise operational definition of sport gambling and

Updates since Brown v. Plata: alternative solutions for prison overcrowding in California.

With the number of inmates under the care of the California Department of Corrections and Rehabilitation (CDCR) swelling over the past few decades, California faces a challenge. The U.S. Supreme Court ruled in their 2011 decision in Brown v. Plata that overcrowding violates inmates' Eighth Amendment rights, specifically that they are denied adequate medical and mental health care. Federally mandated release programs have historically raised some concerns regarding public safety and fiscal efficiency. Given the large number of mentally ill inmates in the United States, alternatives such as assi

Abortion-related crowdfunding post-Dobbs.

Previous research on abortion-related crowdfunding campaigns found that they are impacted by stigma around abortion and rarely successful. This paper analyzes crowdfunding activity in the US following a leak of the Supreme Court decision in Dobbs. V. Jackson Women's Health Organization, a time period that saw increased financial support of abortion access funds. Crowdfunding campaigns that included "abort" or "abortion" and were created between May 2 and November 8, 2022 were recorded from the GoFundMe and GiveSendGo crowdfunding platforms. These campaigns were reviewed for whether they were U

Abortion in context: historical trends and future changes.

Reform of abortion laws in the United States stemmed from concern over the health consequences of illegal abortion. Feminists were relative latecomers to the movement, and abortion did not become a major political issue until after the Roe v. Wade decision by the Supreme Court. Most social scientists began to study public attitudes toward abortion, which have been relatively stable since that 1973 decision, only after the Supreme Court ruling, and they thus probably missed documenting the period in which the major attitudinal changes occurred. Polls showed that the American public is most like

Pharmacist conscience clauses and access to oral contraceptives.

The introduction of conscience clauses after the 1973 US Supreme Court decision in Roe v. Wade allowed physicians and nurses to opt out of medical procedures, particularly abortions, to which they were morally opposed. In recent years pharmacists have requested the same consideration with regard to dispensing some medicines. This paper examines the pharmacists' role and their professional and moral obligations to patients in the light of recent refusals by pharmacists to dispense oral contraceptives. A review of John Rawls's concepts of the "original position" and the "veil of ignorance", alon

OBJECTIVE: To educate pharmacists regarding the hypothesis that the measles-mumps-rubella (MMR) vaccine is linked to the development of autism. DATA SOURCES: Articles published from 1998 to 2009 were identified through electronic searches of Medline. STUDY SELECTION: Articles were included if they evaluated or reviewed a possible link between the MMR vaccine and autism or discussed MMR epidemiology, legal proceedings involving the MMR vaccine and autism, or health professionals' impact on immunization decisions. DATA SYNTHESIS: A total of 27 articles were identified. Of the articles, 74% (2

Is the foetal alcohol syndrome child protected by South African law?

It is scientifically indisputable that excessive use of alcohol or drugs during pregnancy causes defects in the children who are subsequently born to the abusing mothers. In the United States any legislative intervention by a state during the pregnancy would affect the rights of both the mother and the foetus. In order to remain within the bounds of constitutionality any maternal health legislation would have to strike a clear balance between the mother's rights to reproductive and familial privacy and bodily integrity guaranteed by the Fourteenth Amendment and the state's right to protect the
