BACKGROUND: Achilles tendon rupture (ATR) is among the most common foot and ankle injuries, with a rising incidence of up to 50 per 100 000 persons. We sought to investigate the medicolegal characteristics associated with ATR.
METHODS: Westlaw Precision, an online, legal database from across the United States, was queried for all jury verdicts and settlements pertaining to "malpractice" and "Achilles" tendon rupture from 1980 to 2024. Data extracted included date and state of claim filing, patient and defendant demographics, jury verdict, monetary payments, basis of litigation, and listed pat

Ovarian cysts are commonly encountered during pregnancy, often being benign and asymptomatic. However, in some cases, surgical intervention may be necessary. This case report presents a patient who underwent ovarian cyst removal during a cesarean section. We discuss the indications for surgery, surgical approach, potential complications, and outcomes. This case aims to contribute to the limited literature on this subject and evaluate whether this practice is justified or constitutes malpractice.

BACKGROUND: Issues related to wound assessment, treatment, and wound etiology are frequently scrutinized in medical malpractice cases. As patients and their families become increasingly knowledgeable about wound care, specialists must adopt evidence-based practices and engage patients in care planning to reduce litigation risks. Practical communication skills are critical when interacting with patients with wounds, and meticulous documentation of these interactions can assist clinical staff to avoid potential medical malpractice claims. This article focuses on identifying the essential compone

BACKGROUND: Litigation impacts physicians financially, reputationally, and professionally. Although thyroid surgery has favorable patient outcomes, litigation persists. We aimed to characterize malpractice claims after thyroidectomy and investigate which factors favor physicians.
METHODS: We queried the Westlaw legal database using the terms "thyroidectomy" and "medical malpractice" to identify malpractice cases brought against surgeons from 1949 to 2022. We collected and analyzed demographic; clinical; surgical; and legal data, including year, cause for initiating litigation, verdict, state

BACKGROUND: Malpractice lawsuits following percutaneous coronary and peripheral interventions are not uncommon. Understanding the most common causes of medical legal action can inform clinicians and prevent future injury and litigation.
METHODS: LexisNexis is a legal database that compiles all publicly available court records for state and federal jury verdicts and settlements in the United States. We analyzed LexisNexis for malpractice cases involving percutaneous coronary and peripheral interventions between January 1, 2005 and December 31, 2020.
RESULTS: We found a total of 89 cases over

BACKGROUND: Clinicians are motivated to provide safe, high-quality care to patients with chronic liver disease. This includes the desire to avoid litigation. Data are limited regarding the actual sources of medicolegal risk in chronic liver disease.
METHODS: We conducted a review of a national liability insurer (Candello) with an additional granular analysis of our institution's registry of liability claims. We included closed cases involving chronic liver disease-related encounters between 2012 and 2021. We determined rates of legal claims from a denominator of unique patients with cirrhosis

OBJECTIVE Spinal epidural abscesses (SEAs) can be difficult to diagnose and may result in neurological compromise or even death. Delays in diagnosis or treatment may worsen the prognosis. While SEA presents a high risk for litigation, little is known about the medicolegal ramifications of this condition. An enhanced understanding of potential legal implications is important for practicing spine surgeons, emergency medicine physicians, and internists. METHODS The VerdictSearch database, a large legal-claims database, was queried for "epidural abscess"-related legal cases. Demographic and clinic

BACKGROUND: The litigious nature of the American medical environment is a major concern for physicians, with an estimated annual cost of $10 billion.
OBJECTIVE: The purpose of this study is to identify causes of litigation in cases of testicular torsion and what factors contribute to verdicts or settlements resulting in indemnity payments.
METHODS: Publicly available jury verdict reports were retrieved from the Westlaw legal database (Thomson Reuters, New York, NY). In order to identify pertinent cases, we used the search terms "medical malpractice" and "testicular torsion" with date ranging

BACKGROUND: Medication management is an integral part of chronic pain management. Prompted by an increase in the role of medication management in anesthesia chronic pain liability, we investigated the characteristics of malpractice claims collected from 2005 to 2008.
METHODS: After Institutional Review Board approval, we compared medication management claims with other chronic pain claims from the American Society of Anesthesiologists Closed Claims Database of 8,954 claims. Claims for death underwent in-depth analysis.
RESULTS: Medication management represented 17% of 295 chronic non-cancer

As the Bush administration pushes Congress to place a $250,000 cap on pain and suffering awards in medical malpractice lawsuits, other moves quietly afoot by state medical boards, state medical associations, and specialty societies may reduce liability insurance premiums by limiting the number of suits.

All medical malpractice lawsuits filed in Cook County, IL, from January 1, 1980, through June 30, 1986, were reviewed and compared with similar data for the period of January 1, 1975, through December 30, 1979. A total of 11,203 suits were filed during the 11.5-year period; of these, 1391 (12%) were radiology related. The latter were categorized into six groups. The largest was missed radiologic diagnoses, which accounted for 40% of the total. The remaining groups included complications, 19%; failure to order, 17%; radiation therapy, 11%; slip and fall, 5%; and miscellaneous, 8%. Over the 1975

BACKGROUND: The management of acute angioedema is challenging and involves providers in multiple specialties. Timing of evaluation and intervention is imperative and requires effective communication between these groups, as treatment delays and improper management can lead to airway compromise and death. We aim to identify factors that contribute to malpractice litigation in the management of angioedema.
MATERIALS AND METHODS: The Westlaw comprehensive legal database was queried for angioedema malpractice cases from 1993 to 2022. Angioedema misdiagnoses were excluded. Root cause analysis was
