Some international jurisdictions route individuals for whom criminal responsibility is foreclosed because of mental disorder from the penal system into a forensic psychiatry regime. Such rerouting might be presumed preferable for such individuals, because it is intended to offer a humane alternative to incarceration and is often viewed by the public as an avenue for accused individuals to avoid accountability. Our clinical experience corroborates European findings that at least some individuals who have been placed into forensic psychiatric care would have preferred to remain in the penal syst

Although sex and gender differences are well-known in psychiatry, their research in the forensic psychiatric population is still limited. This study is aimed at bridging this gap by examining gender-specific factors and treatment needs among forensic psychiatric patients who are highly dangerous. By retrospectively analyzing data from a 1-year observational study on the Italian Residences for the Execution of Security Measures (REMS) patients (n = 730), we compared the main sociodemographic, clinical, and criminological variables between n = 80 female and n = 650 male patients. Female offender

The use of recent psychiatric research in the defense of the 'Unabomber' (United States vs. Theodore Kaczynski) is a compelling example of how the gap between research and practice can have profound consequences on the practice of forensic psychiatry, psychology and the judicial process. In this case, educating the lawyers and the court about the research on poor insight in schizophrenia changed the defense strategy and ultimately the course of the trial.

Although test manuals and professional guidelines universally specify that forensic assessments should take place in quiet, private, and distraction-free environments, such absences of distractions are rare in jail and prison settings. In this article, four aspects of this problem are examined. First, compelling examples of noise and distractions are described to give a sense of the nature of the problem. Second, the portions of guidelines from the American Academy of Psychiatry and the Law and the American Psychological Association regarding distractions are presented, along with associated e

Despite the central role in criminal trials, there is little research on the decision-making processes of experts in forensic psychiatry. We aimed to investigate the role of sociodemographic, psychopathological, and criminological characteristics in forensic psychiatric decisions on criminal responsibility and social dangerousness in criminal trials. We analyzed 302 forensic psychiatric reports provided by 16 forensic psychiatrists from the North, Central and Southern Italy. Defendants' psychiatric symptom severity was evaluated through the 24-item Brief Psychiatric Rating Scale (BPRS), the Cl

Within the fields of psychiatry, psychology, and neuropsychology, medical examiners are often tasked with providing an opinion about an injured individual's health prognosis and likelihood of returning to work. Traditionally, examiners have conducted such assessments by employing clinical intuition, expert knowledge, and judgment. More recently, however, an accumulation of research on factors predictive of disability has allowed examiners to provide prognostications using specific empirically supported evidence. This paper integrates current evidence for four common clinical issues encountered

Individuals housed in prisons or forensic hospitals experience significant restrictions on their sexual rights. There is a lack of data on how sexual behavior and sexual health of institutionalized persons are managed and to what extent they are based on shared guidelines or decisions of the individual staff. Using a standardized online questionnaire, the heads of 35 prisons and 32 forensic psychiatric hospitals across 14 German federal states were surveyed, reflecting the situation of 16,902 inmates and patients. The findings reveal an absence of shared guidelines as well as an institution-sp

The authors propose and discuss approaches to the expert evaluation of the severity of harm to the health in the form of mental disorder associated with the traumatic impact. The following qualifying signs of the degree of harm to the health included in the current legislation are considered in terms of forensic psychiatry: "life-threatening harm" (Criminal Code of the Russian Federation, article 111) and "length/brevity of impairment of the health" (Criminal Code of the Russian Federation, articles 112, 115). The well-grounded proposals of changes in the existing legislation envisage that the

OBJECTIVE: The writer Elsa Asenijeff was placed under guardianship based on the diagnosis paranoia querulans in 1921. The aim of this study was to commemorate her case and to question how this clinical picture was understood at the time in order to contribute to the history of this little researched disorder.
METHODS: We illustrate the essence of Asenijeffs forensic examinations and of the descriptions of paranoia querulans in selected German psychiatric literature of the beginning of the 20th century.
RESULTS: The literature describes paranoia querulans as a delusional disorder provoked by

This naturalistic exploratory study describes the characteristics of women prisoners referred to the forensic psychiatry service of the largest women's prison in New Zealand. Forensic psychiatrists diagnosed more than one-third of the referred female inmates with psychotic disorders, and they diagnosed post-traumatic stress disorder in one-fifth. The majority of the women reported substance use prior to incarceration, as well as a history of personal victimization by family violence. Of the women prisoners referred to community mental health services at release, two-thirds attended the arrange

Virtual reality (VR) is increasingly being used as an innovative technology for assessment, treatment, and training within psychiatric settings. However, little work has been done to synthesize existing literature on the use and benefits of VR in forensic-correctional settings. This review was conducted in accordance with the Preferred Reporting Items for Systematic Reviews and Meta-Analyses guideline. Protocol is available at Open Science Framework (https://osf.io/3m6p2). A total of 1317 articles were screened, and 32 reports were included in the final review. VR interventions were identified

The authors present an important two-part study as they strive to provide an empirical analysis of psychiatric diagnoses in criminal case reports in Australia. In the first part, they compare the level of agreement or correlation of diagnoses between pairs of experts who prepared reports for either the prosecution or defense with other reports prepared for the same and opposing sides and by profession (i.e., psychiatrists and/or psychologists). In the second part, they compare the level of agreement or correlation between experts retained by either the prosecution or defense and treating pract

Mass murder is the result of the complex interaction of several factors. What seems ubiquitous within mass murder are extreme feelings of anger and revenge. Yet despite these intense affective states, mass murders are, as a rule, not behaviorally impulsive, but rather prepared. The presence of extreme hate and anger evokes an impulsive outburst of rage, whereas planning and premeditation point in the direction of a cognitive, rather unemotional deed. This inconsistency is also reflected in reports of offenders' emotional states during the execution of their crimes: while some mass murderers ha

In this article, the author explores the relationship between the lawyer as advocate and the psychiatrist as expert. He argues that the role of the psychiatrist in aiding the Court in the determination of relevant issues is one of increasing importance. Often the diagnostic opinions offered by the psychiatrist border on conclusory legal determination. As such, those opinions must necessarily be subjected to the testing of adversarial processes. The role of the psychiatrist is to proffer a relevant opinion while nevertheless realizing that the inexact nature of the science limits the use such a

A 51-year-old woman with a psychiatric history of depression and drug abuse was found hanged in her bedroom. The ligature was a scarf attached to the door handle. The autopsy findings suggested that two methods of suicide had been used one after the other. In the first stage, numerous nails, pins and needles were swallowed; in the second stage, the suicide was completed by hanging.

With the advent of psychotropic medications and with the deinstitutionalization of psychiatry starting in 1968, patients were prematurely discharged from forensic state hospitals. Due to lack of resources, psychiatric forensic patients ended up in the correctional system or homeless with the reduction of psychiatric beds in forensic and civil state hospitals. Lacking proper training and medication management, the recidivism rate of this population was close to 10% for rearrest and about 35% for revocation of conditional release (CR; Manguno-Mire et al., ). A new treatment modality was created

INTRODUCTION: Criminal responsibility evaluation represents one of the most controversial and debated issues in forensic psychiatry. Although clear procedures have been recommended, little research exists on decision-making process by forensic psychiatrists. We present a case assessing the criminal responsibility of a murderer who committed femicide as a result of chloroform poisoning and suffocation after a drug-facilitated sexual assault.
MATERIALS AND METHODS: A.S., a 30-year-old female, was found dead in the home of S.P., a 50-year-old male. S.P. recounted killing A.S. by forced inhalatio

Assessment of decision-making capacity and guardianship in hospitalized patients represents a critical interface between forensic psychiatry, clinical medicine, and law. In Turkiye, such evaluations are frequently requested by courts or notaries; however, empirical data describing their forensic characteristics remain limited. This study examined hospitalized patients referred for forensic psychiatric evaluation of decision-making capacity and guardianship and identified factors influencing medico-legal outcomes. This retrospective study included all inpatient consultations requested for foren
