Retained placental tissue as an emerging cause for malpractice claims.

BACKGROUND: Removal of retained placental tissue postpartum and retained products of conception (RPOC) abortion is done by uterine curettage or hysteroscopy. Trauma to the endometrium from surgical procedures, primarily curettage, can cause intrauterine adhesions (Asherman's syndrome) and subsequent infertility. The incidence of malpractice claims relating to intrauterine adhesions is rising, justifying reevaluation of the optimal way of handling these complications. OBJECTIVES: To review malpractice claims regarding intrauterine adhesions, and to explore the clinical approach that might redu

Trends in malpractice premiums for dermatologists: results of a national survey.

OBJECTIVE: To analyze professional liability premiums in dermatology and factors associated with premium variation. DESIGN: This study examines data from a survey of dermatologists conducted in 2004. RESULTS: Survey respondents (n = 1095) reported mean medical liability premiums of $10,898 in 2004 (95% confidence interval, $10,295-$11,501). Premiums increased by 24.4% in 2003 and 16.7% in 2004. There was substantial variation by state, and mean premiums were higher in American Medical Association (AMA)-declared "crisis states" than in those states listed as "currently OK" ($11,669 vs $9527;

When Software Becomes Medicine: Ignoring It May Soon Be Malpractice.

The convergence of mobile software, artificial intelligence, and biomedical science is ushering in a new era of precision medicine, defined not only by personalization but by real-time adaptability. This shift is exemplified by the evolution of Prescription Digital Therapeutics (PDTs): smartphone-based applications that treat a disease or condition and are regulated in the US by the FDA. Early PDTs (PDT 1.0) such as reSET for substance use disorder, reSET-O for opioid use disorder, and Somryst for chronic insomnia digitized cognitive behavioral therapy (CBT) into a smartphone app and laid the

Medical Malpractice Trends in Thyroidectomies among General Surgeons and Otolaryngologists.

OBJECTIVES: This study aims to examine litigation trends with thyroidectomies in the United States from 1984 to 2018. METHODS: We used the Westlaw legal database to collect data on the defendant, plaintiff, case demographics, alleged reasons for malpractice, additional complications, and case outcomes. RESULTS: The most common reason for litigation was vocal cord paralysis (51%, n = 28), with the majority ruling in favor of the defendant (64%, P = .042). Of those, 43% of cases (n = 12) were due to unilateral recurrent laryngeal nerve (RLN) injury, and 39% (n = 11) were due to bilateral RLN i

Forensic - Pathological SEM/EDX analysis in prosecution of medical malpractice.

The retention of gauze within the mediastinum is considered an exceptional finding. We are presenting the case of a woman, affected by aorto-mitral valvulopathy, in whose mediastinum was found, during the autopsy, a gauzome without signs of active phlogosis, which had been "forgotten" in a previous surgery, acted 14 years before the death. A 39 y.o. woman had received surgical treatment of double aorto-mitral valve substitution and tricuspid plastic. At age 53, she successfully received surgery once again at a different hospital; she then started rehabilitation therapy, during which she deceas

Medication errors: 1977 to 1988. Experience in medical malpractice claims.

MIIENJ has paid $30,144,636 in indemnity from 1977 through 1988 for medical malpractice suits arising from medication errors. A review of these files revealed that patients incurred death and serious morbidity, and that several specific behavior errors accounted for the majority of patient injury. Among the damages that occurred during that time period were 88 deaths, 15 patients with profound brain damage, 15 patients who alleged that they had become addicted to medications prescribed for pain, 10 patients who required amputations of limbs, and 12 patients who suffered some degree of hearing

No-fault malpractice insurance: Swedish plan shows us the way.

No-fault medical accident insurance could help solve some of the medical malpractice insurance problems that plague American physicians and hospitals. In Sweden, the Patient Injury Insurance Plan has been working for two years, and, with the statistics that are now available, the claims experiences under the new Swedish system can be compared with the claims experience in the United States under the traditional liability system. The author believes that an insurance system similar to the Swedish plan can work in the United States, but only if certain conditions are created.

Malpractice outcomes of perioperative ischaemic optic neuropathy after nonocular surgery.

BackgroundPerioperative vision loss following nonocular surgery is a rare but devastating complication. It typically occurs following spinal, cardiac, or head and neck procedures with ischaemic optic neuropathy being the primary cause. Despite increased understanding of potential risk factors, such as prolonged prone positioning, anaemia and hypotension, the legal implications remain underexplored. This study investigates malpractice litigation outcomes related to perioperative ischaemic optic neuropathy in the US.MethodsWe conducted a retrospective analysis of US malpractice cases involving p
