Artificial womb technology, pregnancy, and EU employment rights.

This article considers challenges for the European Union (EU) maternity and pregnancy rights framework when faced with advances in reproductive technology. Specifically, we consider how the introduction of the 'artificial womb' technology, an alternative to bodily gestation, would impact the availability of rights that exist under the maternity and discrimination framework. Employment rights in the EU context have already been confronted by the challenges of advancements in reproduction. We use the case law on in vitro fertilization (IVF) and surrogacy as a baseline for unpacking the challenge

Falling short of universal access to reproductive health: unintended pregnancy and contraceptive use among Mexican women with HIV.

A favourable context for women with HIV to prevent unintended pregnancy is a cornerstone of reproductive rights and will contribute to achieving universal access to reproductive health, a Millennium Development Goal target. This analysis explores the reproductive trajectories of Mexican women with HIV post-diagnosis and their access to reproductive counselling and use of contraceptives. In-depth interviews and short surveys were conducted with women of reproductive age living with HIV. Results indicate that sexual and reproductive health counselling in HIV care focuses on the male condom and d

Deanda v. Becerra: The Implications of the New Legal Attack on Longstanding Title X Policy.

This commentary analyzes the recent attacks on adolescents' access to contraception by religious and parental rights activists and the conservative legal movement. Specifically, we focus on Deanda v. Becerra, a 2024 case in which the Fifth Circuit Court of Appeals held that a Texas state law requiring parental consent for minors to access contraception is not preempted by a longstanding policy under Title X of the federal Public Health Service Act that prohibits clinics receiving federal funding from requiring parental consent or notification. We first describe existing laws governing minors'

Reconceiving Reproduction: Removing "Rearing" From the Definition-and What This Means for ART.

The predominant position in the reproductive rights literature argues that access to assisted reproductive technologies (ART) forms part of an individual's right to reproduce. On this reasoning, refusal of treatment by clinicians (via provision) violates a hopeful parent's reproductive right and discriminates against the infertile. I reject these views and suggest they wrongly contort what reproductive freedom entitles individuals to do and demand of others. I suggest these views find their origin, at least in part, in the way we define "reproduction" itself. This paper critically analyses two

What Should Physicians Consider About American Indian/Alaska Native Women's Reproductive Freedom?

Historically, American Indians and Alaska Natives (AI/AN) have been subjected to a lack of control over various aspects of their lives, including their reproductive health. In discussions of family planning with AI/AN patients, clinicians must consider past violations of reproductive rights and the need for transparent consent. This article explores the following questions: What were historical violations of AI/AN women's reproductive rights? How should physicians express respect for this history and for the autonomy of AI/AN female patients regarding surgical sterilization procedures today?

Precarious Lives: Forced sterilisation and the struggle for reproductive justice in Peru.

It is estimated that more than 200,000 women were sterilised without giving free, prior and informed consent in Peru between 1996 and 2000 during the Fujimori regime. This paper places forced sterilisation within the frameworks of precarity and reproductive justice to understand policies that legitimised the violation of women's rights irrespective of the type of political regime: forced sterilisations during a dictatorial regime and denial of access to sexual and reproductive rights during a period of democracy. Through document analysis, this paper examines narratives around sterilisation an

Legal subtleties of the Indian Assisted Reproductive Technology Act of 2021.

Infertility is a widespread medical issue that profoundly affects couples, subjecting them to a roller coaster of emotions often marked by grief and loss. For many, the natural occurrence of conception holds a sense of miraculous success, often overshadowing the prospects of surrogacy or assisted reproductive technology (ART). Diverse factors contribute to infertility, including unidentified causes, age-related concerns, lifestyle choices and medical conditions. ART treatments are vital in aiding infertile couples facing these challenges. The Government of India introduced The ART (Regulation)

Human rights as a framework for eliminating female genital schistosomiasis.

Female genital schistosomiasis (FGS) affects tens of millions of women and girls in sub-Saharan Africa, yet this inequitable threat is often overlooked by advocates in both the neglected tropical disease (NTD) and sexual and reproductive health and rights (SRHR) communities. FGS causes both acute infection and long-term sexual and reproductive health harm to marginalized women and girls, with gender, poverty, and rurality combining to invisibilize the disease. Human rights and gender imperatives can help to galvanize efforts to control and eliminate FGS, as they have for other NTDs. Specifical

Understanding the role of female sterilisation in Indian family planning through qualitative analysis: perspectives from above and below.

Since the 1990s, the global approach to family planning has undergone fundamental transformations from population control to addressing reproductive health and rights. The Indian family planning programme has also transitioned from being vertical, target-oriented, and clinic-based to a supposedly target-free, choice-based programme that champions reproductive rights. Despite contraceptive choices being offered and voluntary adoption encouraged, there is a heavy reliance on female sterilisation. Community health workers, known as ASHAs, are responsible for on-ground implementation of family pla

From blame to belonging: Social and behavior change strategies to address infertility-related stigma in sub-Saharan Africa.

Infertility-related stigma remains a significant yet often overlooked issue in sexual and reproductive health programming, particularly in sub-Saharan Africa. Although awareness of infertility's prevalence and social, psychological, and health impacts is growing, efforts to address the associated stigma remain insufficient. Drawing on a synthesis of existing evidence, this commentary examines the multi-level nature of infertility-related stigma, highlighting its roots in social norms and structures that undermine the ability of individuals and couples to exercise their sexual and reproductive

Between demographic targets and personal desire: lived experiences of infertility.

Infertility is a globally prevalent disease affecting approximately 1 in 6 people at some stage in their lives. Despite its profound personal significance, access to fertility care remains uneven, shaped by legal, financial, cultural and infrastructural barriers. While declining fertility rates have prompted some policymakers to frame medically assisted reproduction within demographic strategies, we argue that fertility care must be fundamentally understood as a matter of individual rights, reproductive autonomy and self‑fulfilment. International human rights instruments increasingly recognize

The special programme of research in human reproduction: forty years of activities to achieve reproductive health for all.

The Special Programme of Research in Human Reproduction (HRP), co-sponsored by the UNDP, UNFPA, WHO, and the World Bank, is celebrating 40 years of activities with an expansion of its mandate and new co-sponsors. When it began, in 1972, the main focus was on evaluating the acceptability, effectiveness, and safety of existing fertility-regulating methods, as well as developing new, improved modalities for family planning. In 1994, HRP not only made major contributions to the Plan of Action of the International Conference on Population and Development (ICPD); it also broadened its scope of work

Conceptualising a child-centric paradigm : do we have freedom of choice in donor conception reproduction?

Since its inception, donor conception practices have been a reproductive choice for the infertile. Past and current practices have the potential to cause significant and lifelong harm to the offspring through loss of kinship, heritage, identity, and family health history, and possibly through introducing physical problems. Legislation and regulation in Australia that specifies that the welfare of the child born as a consequence of donor conception is paramount may therefore be in conflict with the outcomes. Altering the paradigm to a child-centric model, however, impinges on reproductive choic

Conscientious objection in reproductive health care: Analysis of Pichon and Sajous v. France.

This article explores the issue of conscientious objection invoked by health professionals in the reproductive and sexual health care context and its impact on women's ability to access health services. The right to exercise conscientious objection has been recognized by many international and European scholars as being derived from the right to freedom of thought, conscience and religion. It is not, however, an absolute right. When the exercise of conscientious objection conflicts with other human rights and fundamental freedoms, a balance must be struck between the right to conscientious obj

Reproductive identity expression, reinforcement and defence: A constructivist grounded theory of non‑normative pregnancy and childbirth decisions in the UK.

Increasingly, women in the United Kingdom decline routine or recommended maternity care, give birth outside clinical guidelines, or make other non-normative choices. Despite policy commitments to personalised, rights-based care, such decisions often generate anxiety within maternity systems. Understanding women's motivations is essential for safe, rights-respecting care and informed policy. Existing approaches are predominantly shaped by clinician and system perspectives, often assuming motivations without evidence from women themselves. Current evidence frequently reduces lived experiences to

Public health agencies' obligations and the case of Zika.

This article focuses on the initial reactions to the Zika epidemic by national and international public health agencies. It presents and analyzes some responses public officials made about sexual and reproductive health at the inception of the epidemic. It also describes the different challenges and obligations faced by local and international public health agencies, as these have not been clearly outlined. The article argues that these agencies have different obligations and should fulfill them despite existing obstacles. While international agencies should honor their leadership role and mak

Evaluating participant engagement in a preconception cohort study in relation to the Dobbs decision.

BACKGROUND: On June 24th, 2022, the United States (US) Supreme Court's ruling in Dobbs v. Jackson, et al. (hereafter, the Dobbs decision) removed federal-level protections for induced abortion, sparking concerns about reproductive rights and health privacy. Although other pregnancy outcomes (e.g. spontaneous abortion, ectopic pregnancy) are not explicit targets of post-Dobbs abortion bans, study participants may be worried about how their reproductive health data are used by researchers in the post-Dobbs era. OBJECTIVE: To evaluate the extent to which the Dobbs decision influenced participant

Connecting Female Genital Schistosomiasis and Menstrual Hygiene Initiatives.

Effective future control of female genital schistosomiasis (FGS) requires an integrated and multisectoral approach, bringing together HIV, sexual and reproductive health, and reproductive rights sectors. In this article, an underappreciated but important connection between FGS and menstrual hygiene initiatives in Africa is highlighted.

"Even if you have the right, it won't be an easy path": Challenges and potentials of primary health care for legal abortion care in Brazil - a qualitative study.

Access to legally permitted abortion depends not only on the legal framework, but also on policy implementation, health system organisation, and professional practices. In Brazil, abortion is legally permitted in specific circumstances, but access remains highly limited. This qualitative study aimed to understand how Primary Health Care (PHC) professionals in São Paulo deal with cases eligible for abortion in everyday practice, focusing on conditions that constrain or enable the realisation of reproductive rights. Thirteen semi-structured interviews were conducted with professionals engaged wi
