Providers issue brief: certificate of need.

At one time, every state was required by the federal government to have a certificate of need (CON) program. The process was intended to keep down costs associated with the construction of new health facilities in the state, and prevent overdevelopment. When the federal requirement was lifted, however, a number of states did away with their programs. Some later restored it in some form, and many have kept their programs alive for years, requiring a governmental seal of approval for building new facilities such as hospitals and long-term care facilities or for acquiring major medical equipment.

Certificate-of-need deregulation and indigent hospital care.

For almost twenty years certificate-of-need (CON) regulations have protected existing hospitals from unrestricted competition in services. Although the explicit purpose of CON regulation was to prevent hospitals from duplicating services and investing in costly excess capacity, it has been unsuccessful in accomplishing this goal. On the other hand, CON policies have, we suggest, been pursued with the implicit aim of "cross subsidization," that is, regulators have used their power to issue licenses and restrict competition in order to create an incentive to hospitals to provide high levels of c

Reevaluating Certificate-of-Need: Outcomes after Gastrointestinal Cancer surgery.

BACKGROUND: Certificate-of-Need (CON) programs regulate hospital expansion to align capacity with community needs and may centralize complex surgery. We sought to characterize the association between state CON status with postoperative outcomes among Medicare beneficiaries undergoing gastrointestinal cancer (GI) surgery. METHODS: Medicare beneficiaries undergoing GI cancer resection (2014-2021) were identified and stratified by state CON status. Hospital density was defined as hospitals per state per 100,000 people and compared with the national means. Multivariable logistic regression assess

Certificate-of-Need State Laws and Total Knee Arthroplasty.

BACKGROUND: Many states in the United States have certificate-of-need (CON) programs designed to restrain health care costs and prevent overutilization of health care resources. The goal of this study was to characterize the associations between CON regulations and total knee arthroplasty (TKA) by comparing states with and without CON programs. METHODS: Publicly available data were used to classify states in to CON or non-CON categories. The 100% Medicare Standard Analytical Files from 2005 through 2014 were then used to compare primary TKA procedure volumes, charges, reimbursements, and dist

What Are the Impacts of Certificate-of-Need Laws? A Review of the Evidence.

This study reviews the literature on the impacts of Certificate-of-Need (CON) laws on outcomes related to hospitals. CON laws require the approval of states' health planning agencies for health care providers to engage in regulated actions such as opening or expanding facilities or purchasing equipment. Economic theory suggests that barriers to entry should reduce competition, leading to higher prices, greater per-firm quantity but lower market quantity, and larger net revenues for incumbent providers. However, defenders of CON laws argue that they ensure high quality standards for new entrant

The Impact of Certificate of Need Status on the Utilization and Reimbursement of Open and Endoscopic Carpal Tunnel Release.

A certificate of need (CON) permits a healthcare organization to build new facilities only if significant medical needs exist. Many states have implemented CON programs to prevent procedure overutilization and price inflation. We hypothesized that there are no differences in reimbursement or utilization for open and endoscopic carpal tunnel release (CTR) when comparing states with and without CON programs. We queried a private-payer database to identify open and endoscopic CTRs performed between 2007 and 2015. In total, 82,689 CTRs were identified: 70,160 open, 12,529 endoscopic. Reimbursement

Examining the Impact of Certificate of Need Laws on the Utilization and Reimbursement of Cataract Surgeries Among Medicare Beneficiaries.

Background: Cataract surgery is an effective and commonly utilized procedure and can significantly improve quality of life and restore economic productivity. Certificate of need (CON) laws aim to regulate healthcare facility expansion and equipment acquisition to curtail costs, enhance quality, and ensure equitable access to care. However, little is known about the impact of CON laws on cataract surgery utilization and reimbursement. Objectives: To compare utilization and reimbursement for non-complex cataract surgery in CON and non-CON states. Methods: This retrospective database review analy

Physician wound certification: a much-needed reality too long denied.

Over the past 20 years, the number of physicians who focus their practice on wounds and wound care has grown slowly but significantly. It is estimated that there are >13,000 physicians who practice wound care but who have no 'home' to nurture their discipline and ensure, through standards and best practices, quality in the care they deliver. Unlike most others, these physicians pursue patient care without a certifying medical board to confirm the quality of their care and the scope of their practice. Because organised medicine correctly insists on quality in the care physicians deliver, it is

Biorisk Management in High-Containment Laboratories: Assessment of Certification Systems and Need for Global Standardization.

Laboratory-acquired infections (LAIs) and accidental pathogen escape from laboratory settings (APELS) are still a significant concern, even with biosafety guidelines and manuals in place. The actual number of these events is probably underestimated because there are no mandatory reporting systems or standard surveillance frameworks. In this review, a clear overview is given about the evolution of biosafety, the worldwide distribution and governance of high-containment laboratories (BSL-3 and BSL-4), and the key factors that lead to laboratory incidents. The focus is specifically on human error

Contemporary impact of state certificate-of-need regulations for cardiac surgery: an analysis using the Society of Thoracic Surgeons' National Cardiac Surgery Database.

BACKGROUND: Prior research using administrative data associated certificate-of-need (CON) regulation for open heart surgery with higher hospital coronary artery bypass grafting (CABG) volume and lower CABG operative mortality rates in elderly patients. It is unclear whether these findings apply in a general population and after controlling for detailed clinical characteristics and region. METHODS AND RESULTS: Using the Society of Thoracic Surgeons' (STS) National Cardiac Surgery Database, we examined isolated CABG surgery volume, operative mortality, and the composite end point of operative m

Do we need a critical care ultrasound certification program? Implications from an Australian medical-legal perspective.

Medical practitioners have a duty to maintain a certain standard of care in providing their services. With critical care ultrasound gaining popularity in the ICU, it is envisaged that more intensivists will use the tool in managing their patients. Ultrasound, especially echocardiography, can be an 'easy to learn, difficult to manage' skill, and the competency in performing the procedure varies greatly. In view of this, several recommendations for competency statements have been published in recent years to advocate the need for a unified approach to training and certification. In this paper, w

Risk factors for hospital death in conditions needing palliative care: Nationwide population-based death certificate study.

BACKGROUND: Most people would prefer to die at home as opposed to hospital; therefore, understanding mortality patterns by place of death is essential for health resources allocation. AIM: We examined trends and risk factors for hospital death in conditions needing palliative care in a country without integrated palliative care. DESIGN: This is a death certificate study. We examined factors associated with hospital death using logistic regression. SETTING/PARTICIPANTS: All adults (1,045,381) who died between 2003 and 2012 in Portugal were included. We identified conditions needing palliativ

Availability of home palliative care services and dying at home in conditions needing palliative care: A population-based death certificate study.

BACKGROUND: Avoiding inappropriate care transition and enabling people with chronic diseases to die at home have become important health policy issues. Availability of palliative home care services may be related to dying at home. AIM: After controlling for the presence of hospital beds and primary care physicians, we examined the association between availability of home palliative care services and dying at home in conditions requiring such services. DESIGN: Death certificate data in Japan in 2016 were linked with regional healthcare statistics. SETTING/PARTICIPANTS: All adults (18 years o
