Drugs, discrimination and disability.

Whether addiction to prohibited drugs should be classified as a disability for the purposes of disability discrimination is a controversial question in Australia. The leading Australian case of Marsden v Human Rights Equal Opportunity Commission & Coffs Harbour & District Ex-Servicemen & Women's Memorial Club Ltd (HREOC, No H98/51, 30 August 1999); [2000] FCA 1619 concerned a disability discrimination complaint brought by Mr Marsden as a result of his treatment by the club. The case was brought as a public interest test case by the New South Wales Legal Aid Commission. Mr Marsden was on a meth

Disability discrimination, disability permanence, and mental health among U.S. adults.

PURPOSE/OBJECTIVE: Disability is often framed as an inherently negative experience that harms the mental health and well-being of disabled individuals. This perspective, however, ignores the impact of disability discrimination. The relationship between disability discrimination and mental health has been documented in several cultural contexts, but not yet in a large-scale, nationally representative sample in the United States. Additionally, limited research has explored moderators of the relationship between disability discrimination and mental health. The purpose of the present study was to

Disability discrimination in healthcare services and employment.

This article discusses the meaning and philosophical basis of disability discrimination in health care. It focuses on aspects of language that influence discourse about disability and affect the experiences of people with disabilities. Reference is made to the experiences of those who have an autism spectrum condition, with a specific focus on three NHS employees with Asperger syndrome, in relation to disability discrimination. The implications for nurses and nursing are discussed. Recommendations are made for awareness raising and training.

Learning disabilities, employment discrimination, and the ADA.

The Americans with Disabilities Act (ADA) of 1990 was intended to prohibit discrimination against individuals with disabilities. Although the scope of this legislation is broad, there are aspects of Title I and Title II of the ADA that may be of particular interest to persons with learning disabilities who are preparing for employment. This article discusses those aspects and presents case studies to demonstrate how the ADA could potentially be applied to typical situations. Suggestions are given for individuals with learning disabilities, their parents, and teachers with regard to employment

Challenging Disability Discrimination in the Clinical Use of PDMP Algorithms.

State prescription drug monitoring programs (PDMPs) use proprietary, predictive software platforms that deploy algorithms to determine whether a patient is at risk for drug misuse, drug diversion, doctor shopping, or substance use disorder (SUD). Clinical overreliance on PDMP algorithm-generated information and risk scores motivates clinicians to refuse to treat-or to inappropriately treat-vulnerable people based on actual, perceived, or past SUDs, chronic pain conditions, or other disabilities. This essay provides a framework for challenging PDMP algorithmic discrimination as disability discr

UNEQUAL BRAINS: DISABILITY DISCRIMINATION LAWS AND CHILDREN WITH CHALLENGING BEHAVIOUR.

At a time when brain-based explanations of behaviour are proliferating, how will law respond to the badly behaved child? In Australia, children and youth with challenging behaviours such as aggression, swearing, or impulsivity are increasingly understood as having a behavioural disability and so may be afforded the protections of discrimination law. A brain-based approach to challenging behaviour also offers a seemingly neutral framework that de-stigmatises a child's 'bad' behaviour, making it a biological or medical issue rather than a failure of discipline or temperament. Yet this 'brain-bas

Neuropsychological assessment of learning disabilities: a discriminant analysis.

The neuropsychological test scores of 23 learning disabled children were compared with those of a matched population of normal children in the 9-1 to 13-1 age range. All children were administered the Wechsler Intelligence Scale for Children-Revised (WISC-R), a dichotic listening task involving both free and directed recall conditions, a handedness inventory, the Tactile Performance Test and the Category Test from the Halstead-Reitan Neuropsychological Test Battery. A multivariate analysis of variance resulted in a significant separation between groups (p less than .001) using these procedures

Religion, culture, and discrimination against persons with disabilities in Nigeria.

BACKGROUND: There is not a lot in the literature on disability in Nigeria concerning the role that religion, culture and beliefs play in sustaining discriminatory practices against persons with disabilities. OBJECTIVES: Many of these practices are exclusionary in nature and unfair. They are either embedded in or sustained by religion, culture and beliefs about disability and persons with disabilities. METHODS: Drawing on various resources and research on disability, this paper looks at these practices in respect of these sustaining factors. Some of the discriminatory practices that constitut

Disability, discrimination and death: is it justified to ration life saving treatment for disabled newborn infants?

Disability might be relevant to decisions about life support in intensive care in several ways. It might affect the chance of treatment being successful, or a patient's life expectancy with treatment. It may affect whether treatment is in a patient's best interests. However, even if treatment would be of overall benefit it may be unaffordable and consequently unable to be provided. In this paper we will draw on the example of neonatal intensive care, and ask whether or when it is justified to ration life-saving treatment on the basis of disability. We argue that predicted disability is relevan

Discrimination of ADHD and reading disability in adults using the D-KEFS.

Attention deficit/hyperactivity disorder (ADHD) is posited to be the result of a deficit in executive functions (EFs). The presence of EF deficits in adults with ADHD is not consistent, and EF deficits are not unique to ADHD, thus adding a level of complexity to differential diagnoses. The current study used three measures of EF to discriminate between college-level adults diagnosed with ADHD and reading disability (RD). The RD group performed below ADHD on all EF tasks and logistic regression analyses demonstrated poor sensitivity and adequate specificity of the EF measures to categorize the

Reading fluency and pitch discrimination abilities in children with learning disabilities.

BACKGROUND: Pitch perception and pitch matching may link to individual reading skills. OBJECTIVE: In this study, we examined pitch perception and pitch matching tasks in children with learning disabilities to determine whether there was any connection between these tests and the reading fluency in these children. METHOD: The study used different types of pitch discrimination tests and reading fluency tests to compare the two groups. RESULTS: Results indicated that the accuracy of pitch discrimination and reading fluency was significantly different in these children with learning disabilitie

The effect of anti-discrimination legislation on individuals with disabilities in Nordic countries.

Nordic countries are renowned for progressive welfare systems and a high quality of life, yet disparities persist between individuals with and without disabilities. This study investigates whether anti-discrimination legislation in these nations enhances socioeconomic outcomes for individuals with disabilities, focusing on subjective well-being, self-rated health, institutional trust, political engagement, labour market participation, and material conditions. The study uses a quasi-experimental design with a difference-in-differences approach, analysing data from the European Social Survey acr

Is slowness a better discriminator of disability than frailty in older adults?

BACKGROUND: The trajectory of incident disability that occurs simultaneously with changes in frailty status, as well as how much each frailty component contributes to this process in the different sexes, are unknown. The objective of this study is to analyse the trajectory of the incidence of disability on basic and instrumental activities of daily living (BADL and IADL) as a function of the frailty changes and their components by sex over time. METHODS: Longitudinal analyses of 1522 and 1548 of the English Longitudinal Study of Ageing study participants without BADL and IADL disability, resp

Mental health and inequity: a human rights approach to inequality, discrimination, and mental disability.

Mental disability and mental health care have been neglected in the discourse around health, human rights, and equality. This is perplexing as mental disabilities are pervasive, affecting approximately 8% of the world population. Furthermore, the experience of persons with mental disability is one characterized by multiple interlinked levels of inequality and discrimination within society. Efforts directed toward achieving formal equality should not stand alone without similar efforts to achieve substantive equality for persons with mental disabilities. Structural factors such as poverty, ineq
