Genetic information privacy and discrimination.

As rapidly evolving technologies provide more information about disease-related genes in human DNA, there is an increase in genetic screening for predisposition for a variety of diseases. Knowledge of genetic information provides significant benefits and drawbacks. Potential misuse of genetic information, particularly by employers or insurance companies, is a realistic possibility. Genetic information is often attainable via electronic medical information databases, heightening concerns that these data will be accessed by third parties and used for discriminatory purposes. Many lawmakers belie

Germline genetic testing and privacy concerns in patients with mesothelioma.

PURPOSE: Mesothelioma, a disease overwhelmingly driven by asbestos exposure, is also associated with germline genetic changes that interact with asbestos to cause cancer. Very little about barriers to genetic counseling and germline sequencing in mesothelioma patients is known. METHODS: We collected DNA, demographic data, and asbestos exposure data from 551 patients with mesothelioma at our center. As part of an Institutional Review Board-approved study, we sequenced 85 genes associated with hereditary cancer syndromes. RESULTS: We identified germline pathogenic or likely pathogenic variants

Between personal and relational privacy: understanding the work of informed consent in cancer genetics in Brazil.

Drawing from perspectives of both bioethics and anthropology, this article explores how the boundaries between personal and relational privacy are negotiated by patients and practitioners in the context of an emerging domain of cancer genetics in Brazil. It reflects on the place of informed consent in the history of bioethics in North America in contrast to the development of bioethics in Brazil and the particular social cultural context in which consent is sought in Brazilian public health care. Making use of empirical research with families and individuals receiving genetic counselling relat

The medical examination in United States immigration applications: the potential use of genetic testing leads to heightened privacy concerns.

The medical examination has been an integral part of the immigration application process since the passing of the Immigration Act of 1891. Failing the medical examination can result in denial of the application. Over the years the medical examination has been expanded to include questioning about diseases that are scientifically shown to be rooted in an individual's genetic makeup. Recent advances in the fields of genomics and bioinformatics are making accurate and precise screening for these conditions a reality. Government policymakers will soon be faced with decisions regarding whether or n

Lethal privacy: Quantifying life years lost if the right to informational self-determination guides genetic screening for Lynch syndrome.

Genetic relatives of hereditary colorectal cancer patients with Lynch syndrome (LS) are at risk of cancer. Testing both colorectal cancer patients and relatives of mutation carriers for LS allows targeted prevention. However, this could mean disclosing sensitive health data to family members. In light of potential trade-offs between cost-effectiveness and patient privacy, this study investigates the implications of increasing test uptake in Germany. Out of 22 screening strategies for LS, the non-dominated and current German strategies were assessed from the perspective of the statutory health

Thinking ethically about genetic inheritance: liberal rights, communitarianism and the right to privacy for parents of donor insemination children.

The issue of genetic inheritance, and particularly the contradictory rights of donors, recipients and donor offspring as to the disclosure of donor identities, is ethically complicated. Donors, donor offspring and parents of donor offspring may appeal to individual rights for confidentiality or disclosure within legal systems based on liberal rights discourse. This paper explores the ethical issues of non-disclosure of genetic inheritance by contrasting two principle models used to articulate the problem--liberal and communitarian ethical models. It argues that whilst the latter provides a mor

[The interpreter role of clinical geneticist in the process of genetic testing].

Due to the progress in genetic research, development and rapid introduction of new genetic tests into clinical practise can be expected. This is raising many ethical issues which need to be carefully considered. First, genetic information is a familial. Thus, the test result of one person may have direct health implications for others who are genetically related. Second, the risks of genetic testing are also psychological, social and financial. Third, due to complex ways of genes interactions, genetic information often has limited predictive power. Finally, many genetic conditions remain diffi

Disclosure of Genetic Results to At-risk Relatives without Consent: Issues for Health Care Professionals in Australia.

Disclosure of genetic information without consent of the patient (proband) challenges the legal frameworks of privacy and confidentiality. Changes to privacy legislation enable and provide guidelines for undertaking disclosure, with the purpose of reducing the harm to genetic relatives who, armed with such information, may seek predictive testing themselves. Nevertheless, significant uncertainty remains for health care professionals in the application of the discretion to disclose genetic information to at-risk relatives. First, jurisdictional inconsistencies in privacy legislation present cha

Addressing Privacy Concerns Surrounding Oocyte Donation in the United States: Gone With Anonymity.

Oocyte donation has greatly expanded in the past several decades since the first procedure was performed in 1983. According to the Centers for Disease Control, the number of cycles using donor oocytes increased from 18,011 cycles in 2010 to 27,131 cycles in 2019. Oocyte donation has become an important reproductive option for women with diminished ovarian reserve, recurrent failed in vitro fertilization, or heritable genetic conditions. It is also particularly important for single men, same-sex male couples, and men with a transgender woman partner. More recently, societal changes accompanying

[Social and family considerations in genetic counselling].

Genetic knowledge can be viewed as an important tool in the prevention of hereditary disease. This article discusses the social issues that the link between genetics and prevention raises in cancer genetic counselling and testing. In particular, the moral dilemmas which health professionals and patients face in relation to disclosing genetic information to kin are described. The authors argue that questions about disclosing information and balancing autonomy and responsibility are not only ethical questions but biopolitical issues.

Genetic discrimination in India: Constitutional challenges and ethical implications.

BACKGROUND: This paper examines the emerging challenge of genetic discrimination (GD) in India, through constitutional, judicial, and ethical perspectives. GD is a critical issue driven by increasing accessibility to genetic testing and insufficient legal safeguards against misuse. METHODS: The study adopts a qualitative research design grounded in doctrinal analysis involving the interpretation of legal texts, case law, and principles, to investigate the emerging challenge of GD in India. RESULTS: The analysis interprets Articles 14 and 15 of India's Constitution as foundational protections

What was privacy?

Why is that question in the past tense? Because individuals can no longer feel confident that the details of their lives--from identifying numbers to cultural preferences--will be treated with discretion rather than exploited. Even as Facebook users happily share the names of their favorite books, movies, songs, and brands, they often regard marketers' use of that information as an invasion of privacy. In this wide-ranging essay, McCreary, a senior editor at HBR, examines numerous facets of the privacy issue, from Google searches, public shaming on the internet, and cell phone etiquette to pas

Adoption and the communication of genetic risk: experiences in Huntington disease.

Adoption agencies can use genetic information to determine the eligibility of prospective adoptive parents and to establish a child's suitability for adoption. We describe experiences and implications of communicating genetic risk for Huntington disease (HD) in the context of adoption. A secondary analysis was employed using data collected from a cross-sectional survey (n = 233) and two qualitative studies on the psychosocial effects of predictive testing for HD. We demonstrate several ethical and practical challenges in the search for and communication of genetic information for adoptees and

Professional duties are now considered legal duties of care within genomic medicine.

The legal duty to protect patient confidentiality is common knowledge amongst healthcare professionals. However, what may not be widely known, is that this duty is not always absolute. In the United Kingdom, both the General Medical Council governing the practice of all doctors, as well as many other professional codes of practice recognise that, under certain circumstances, it may be appropriate to break confidentiality. This arises when there is a wider duty to protect the health of others, and when the risk of non-disclosure outweighs the potential harm from breaking confidentiality. We dis

Rethinking the 'right not to know'.

The idea that an individual has a 'right not to know' genetic information about himself or herself is entrenched in both the policy sphere and the genetic counselling ethos. In this paper, I interrogate this idea of a 'right not to know', questioning particularly its status as a right. I identify the conception of rights that seems to underlie the posited 'right not to know' as a conception of rights in which they are prioritised non-outweighable interests. Turning to a series of hypothetical situations in which the 'right not to know' is invoked, I argue that the 'right not to know' is not a

Attitudes regarding polygenic risk testing for lung cancer: a mixed-methods study.

BACKGROUND: Polygenic risk scores (PRS) hold promise for early lung cancer detection and personalized treatment, yet factors influencing patient interest in PRS-based genetic testing are not well understood. PURPOSE: Grounded in the health belief model, this mixed-methods study explored knowledge, attitudes, perceived benefits and barriers to lung cancer PRS, and preferences for receiving PRS results. RESULTS: The study included 141 individuals (41% African American, 63% female) recruited from two hospital affiliates of a comprehensive cancer center in the Southwestern United States. Althoug

Privacy-preserving pangenome graphs.

The human pangenome reference, often represented as a graph, promises to capture genetic diversity across populations, but open release of individual haplotypes raises significant privacy concerns, including risks of re-identification and inference of sensitive traits. To address these challenges, we introduce PanMixer, a framework for privacy-preserving pangenome graph releases that selectively obfuscates an individual's haplotypes while retaining the utility of the reference graph. PanMixer formulates the privacy-utility trade-off as a knapsack problem, where privacy risk is quantified using
