Between 1989 and 1994, Disability Insurance and Supplemental Security Income, the 2 federal programs that provide disability benefits, expanded rapidly. The largest growth has been among recipients with mental disorders in the Disability Insurance program and among children with learning disabilities in the Supplemental Security Income program. The expansion was partly due to changes in eligibility rules and partly to other factors including outreach efforts by the Social Security Administration and a lack of funds to review and terminate cases. Factors that keep many of the disabled from seek

An expert opinion on occupational disability insurance is not a common occurrence and because of this represents a challenge for the appointed specialist. The peculiarities of the eligibility requirements for this type of insurance are described in detail in this article, including case examples. Besides the medical considerations, there are detailed, specific occupational aspects which must be considered in order to reach an expert judgment which is comprehensible for both, the contracting party and the claimant.

Occupational exposure to HIV is becoming a daily hazard in many emergency departments. Emergency physicians who are protected by disability insurance policies are likely to believe that if they are unable to continue working because of HIV-positive status, their disability policies will provide them with a source of income. Unfortunately, analysis of case law regarding claims under disability policies shows that the law is unlikely to consider an asymptomatic, HIV-positive physician disabled for purposes of payments under disability policies. Therefore, it is necessary for emergency physicians

Personalized health predictions are developing rapidly across a wide range of diseases, challenging the existing legal frameworks for life and disability insurance. These frameworks were originally developed with a focus on presymptomatic genetic testing for severe monogenic diseases such as Huntington's disease. The rapid expansion of personalized medicine raises questions about whether existing legal frameworks remain adequate. This paper examines the underlying ethical values of current legal frameworks that rely on financial thresholds to balance stakeholders' interests and explores how th

In the Netherlands, people with familial hypercholesterolaemia (FH) have been actively screened since 1994 by means of DNA analysis. Recently, the Stichting Opsporing Erfelijke Hypercholesterolemie (Foundation for the Detection of Familial Hypercholesterolaemia) initiated a large scale-screening programme aimed at finding all 40,000 people. The Dutch ministry of Health, Welfare and Sport is providing the financial support. Genetic screening has social implications and raises questions on insurability. The Dutch Medical Examination Act prohibits insurers from posing questions about untreatable,

This study examines the long-run economic consequences of disability, distinguishing conditions by the activities they impair. Using linked Canadian survey and administrative tax data, I estimate the effects of disability onset on detailed income components over a ten-year horizon and assess gaps in partial income insurance across disability types. Mental-cognitive disabilities lead to larger and more persistent losses in market income than physical disabilities. Despite this, both groups experience similar levels of partial insurance and comparable declines in after-tax income. Importantly, s

BACKGROUND: Social Security Disability Insurance (SSDI) beneficiaries who work are often overpaid, with a median overpayment amount of over $9000. These overpayments occur when the Social Security Administration (SSA) pays benefits to beneficiaries not entitled to them because of work; beneficiaries are required to repay the debt to SSA. Work-related overpayments most often occur because beneficiaries work but do not follow SSDI program rules to report earnings and evidence suggests that SSDI beneficiaries are often unaware of reporting requirements.
OBJECTIVE: To assess written earnings repo

According to Croatian legislation disability, risk of disability and altered work capacity are prerequisites for recognition of job injuries, occupational diseases, and, consequently, of the worker's special rights. That is also valid for all areas of insurance. The legislation, if applied, would make it impossible for a great number of insured workers to realize their particular rights based on work related health damage, especially in the field of health insurance and reinsurance of health care costs. Health insurance boards, along with insurance companies, manage by evading the condition of

There are marked differences between the public health system and the private insurance system. This paper shows how to evaluate the degree of permanent disability according to "The General Rules for Private Insurances (AUVB 1965)". At the beginning the evaluation of the degree of permanent disability after the visus naturalis or the visus corrected and at unilateral and bilateral aphakia will be discussed. The paper gives detailed information on the degree of disability for: one injured eye, one injured eye with preexisting ocular lesion, bilateral injury, one injured eye with preexisting les

OBJECTIVE: To identify opportunities to improve care value for children with disabilities (CWD), we examined CWD prevalence within a commercially insured population and compared outpatient care quality and annual health plan spending levels for CWD relative to children with complex medical conditions without disabilities; children with chronic conditions that are not complex; and children without disabling, complex, or chronic conditions.
METHODS: This cross-sectional study comprised 1,118,081 person-years of Blue Cross Blue Shield Massachusetts data for beneficiaries aged 1 to 19years old du

OBJECTIVES: Although considered critical to facilitate the successful transition from pediatric to adult health care, the continuity of insurance coverage for young adults with disabilities as they make the transition to adulthood has not been well characterized. The purpose of this work was to compare the continuity of insurance coverage reported by a nationally representative sample of young adults 16 to 25 years old with and without disabilities during a consecutive 36-month period.
METHODS: We performed secondary analysis of data from the 2001 Survey of Income Program and Participation. D

IMPORTANCE: Although nearly 1 in 5 persons in the United States has a physical or mental disability, little is known about the association of the Patient Protection and Affordable Care Act (ACA) with health insurance coverage among persons with a disability.
OBJECTIVE: To determine the association of Medicaid expansion with health insurance coverage among persons with a disability.
DESIGN, SETTING, AND PARTICIPANTS: Cross-sectional analysis of adults eligible for Medicaid expansion (aged 26-64 years with incomes up to 138% of the federal poverty level), using a triple-differences (difference

The report describes the legal and administrative regulations concerning the medical examination of the new Leistungstatbestand "Schwerpflegebedürftigkeit" (i.e. a situation characterized by "urgent need of nursing care"). The numbers of applicants and the results of the medical examinations during the period 1989-1992 are also reported. The main difficulties consist in clarifying the meaning of some important legal terms and the relatively vague formulations of the administrative guidelines. Another important aspect is seen in the fact that the result of the medical examination is largely dep

Aim: Individuals with intellectual and developmental disabilities (I/DD) may have an increased risk of sexually transmitted infections (STIs) due to limited sexual health education and higher rates of sexual abuse, yet little is known about the prevalence of STIs and STI testing in this population. Methods: This study compared national samples of privately insured individuals with (n = 25,193) and without I/DD (n = 25,193) on the prevalence of STIs and STI testing. Results: In multivariable models, individuals with I/DD were significantly less likely to have an STI diagnosis and no difference

BACKGROUND: Navigating the US healthcare system requires considerable health insurance literacy, especially for adults with disabilities. Limited health insurance literacy may lead to suboptimal treatment, leading to unmet need for medical care.
OBJECTIVE: We examined whether unmet need for medical care among Medicare beneficiaries differs by health insurance literacy and disability status.
METHODS: Using data from the 2010-2019 Medicare Current Beneficiary Survey, we identified 48,989 Medicare beneficiaries, including those in traditional Medicare and Medicare Advantage. Our outcomes were t

INTRODUCTION: In Australia, children with cerebral palsy and complex disability receive funded supports through the National Disability Insurance Scheme (NDIS). This individualised funding scheme requires parents to navigate and advocate on behalf of their child, supported by expert reports, recommendations, and allied health services. Supports aim to enable participation in all areas of daily life, which may be otherwise largely inaccessible to children with complex disability and their families. This study aimed to explore the experiences of families of children with complex disability after

BACKGROUND: The guiding principle of disability insurance in Switzerland is 'rehabilitation before pension'. Access to rehabilitation measures to restore, maintain or improve the earning capacity of individuals with disabilities is essential. Gainful employment enables them to be an active part of society, improves their quality of life, and may mitigate the adverse health effects of disability pension receipt. The aim of this study was therefore to identify factors for disability insurance benefit application in Switzerland.
METHODS: A novel dataset was created linking the 2010 Social Protec
