Holding the Guardrails on Involuntary Commitment.

In response to the increasing number of mentally ill people experiencing homelessness, some policy-makers have called for the expanded use of involuntary commitment, even for individuals who are not engaging in behaviors that are immediately life-threatening. Yet there is no evidence that involuntary commitment offers long-term benefits, and significant reasons to believe that expanding the practice will cause harm. In addition, these proposals ignore research showing that most people with mental illness have the capacity to make medical decisions for themselves. Rather than expanding the use

[Compulsory outpatient treatment can prevent involuntary commitment].

Compulsory outpatient treatment (co-pt) has been possible in Denmark since 2010. The aim is to secure necessary treatment, reduce involuntary commitment and improve quality of life for patients with a severe psychiatric illness. Co-pt has been brought into use in 33 cases. This case report describes a patient with paranoid schizophrenia who several times developed severe psychotic symptoms shortly after discharge due to lack of compliance with treatment. Within one year of co-pt the patient was not admitted to hospital and improved in overall functioning. After terminating co-pt the patient ra

Involuntary commitment and detainment in adolescent psychiatric inpatient care.

OBJECTIVE: To evaluate whether adolescents committed to psychiatric inpatient care are the most disturbed, and whether psychosocial factors other than psychiatric symptoms are associated with commitment to and detainment in psychiatric care among adolescents. MATERIALS AND METHODS: The case histories of 187 13- to 17-year-old adolescents consecutively admitted to the study clinic were scrutinized with the help of a structured data collection form. Psychiatric, demographic and family-related characteristics of those referred involuntarily (n = 93) and voluntarily (n = 94), and those detained i

The Other Infodemic: Media Misinformation about Involuntary Commitment for Substance Use.

BACKGROUND: As drug-related deaths have surged, the number and scope of legal mechanisms authorizing involuntary commitment for substance use have expanded. Media coverage of involuntary commitment routinely ignores documented health and ethical concerns. Prevalence and dynamics of misinformation about involuntary commitment for substance use have not been assessed. METHODS: Media content mentioning involuntary commitment for substance use published between January 2015 and October 2020 was aggregated using MediaCloud. Articles were redundantly coded for viewpoints presented, substances menti

Involuntary outpatient commitment and homelessness in persons with severe mental illness.

This study took preliminary steps to explore the relationship between involuntary outpatient commitment (OPC) and the risk of homelessness among individuals with severe mental disorders. Involuntarily hospitalized patients were randomly assigned to be released or maintained under OPC following hospital discharge. Multivariate analyses demonstrated that involuntary OPC was associated with a significant decrease in the risk of homelessness during the first 4 months following hospital discharge for participants with severe functional impairment at baseline. OPC did not appear to affect risk of ho

Perceived Benefits and Harms of Involuntary Civil Commitment for Opioid Use Disorder.

Involuntary civil commitment (ICC) to treatment for opioid use disorder (OUD) prevents imminent overdose, but also restricts autonomy and raises other ethical concerns. Using the Kass Public Health Ethics Framework, we identified ICC benefits and harms. Benefits include: protection of vulnerable, underserved patients; reduced legal consequences; resources for families; and "on-demand" treatment access. Harms include: stigmatizing and punitive experiences; heightened family conflict and social isolation; eroded patient self-determination; limited or no provision of OUD medications; and long-ter

Gun-Related and Other Violent Crime After Involuntary Commitment and Short-Term Emergency Holds.

This article presents a survival analysis of long-term risk of firearm-related and other violent crime in a large sample of adults with serious mental illness in Florida, comparing those who received a gun-disqualifying civil commitment after a short-term hold, those who were evaluated for commitment but were released or hospitalized voluntarily, and a third group with no holds or commitments. Among 77,048 adults with a diagnosis of schizophrenia-spectrum disorder, bipolar disorder, or major depression, 42.7 percent were detained for psychiatric examination under Florida's Baker Act; of that d

Criminal behavior prior and subsequent to involuntary commitment and detainment in adolescent psychiatric care.

PURPOSE: To investigate the connections between young people's criminal behavior and involuntary psychiatric treatment. MATERIALS AND METHODS: A registry-based follow-up study, using data of all Finnish individuals with first ever psychiatric inpatient treatment at ages 13-17 between 1996 and 2010 (n = 12,725). Information on inpatient treatment periods was extracted from the National Care Register for Health Care (HILMO) and data on criminality from the Register of Prosecutions, Sentences and Punishments maintained by Statistics Finland. The subjects were followed for 10 years after the end

Grave Disability, Basic Needs, and Welfare and Protection: Statutory Definitions for Involuntary Commitment Across States.

OBJECTIVE: The authors aimed to identify and describe standards, across U.S. states and the District of Columbia (DC), for involuntary commitment of people experiencing a psychiatric disability that impairs their ability to live independently. METHODS: Statutes pertaining to involuntary commitment were compiled for all 50 states and DC. The authors focused on commitment criteria other than those regarding a person's danger to themselves or others and identified types and components of these standards, allowable evidence for meeting commitment standards, and other requirements and exclusions.

North Carolina resident psychiatrists knowledge of the commitment statutes: do they stray from the legal standard in the hypothetical application of involuntary commitment criteria?

Objectives are to examine North Carolina (NC) resident psychiatrists knowledge of commitment statutes and their willingness to involuntarily admit hypothetical patients who do not meet statutory criteria. It is hypothesized that the need for transportation may be a salient factor. In one vignette the patient had schizophrenia and the other alcohol dependence. The respondents were asked to make a decision about commitment and to rate how 9 specified factors affected their decision. Sixty-one residents responded. Thirty percent answered incorrectly about statutory provisions for 'mental illness'

Views and experiences of involuntary civil commitment of people who use drugs in Massachusetts (Section 35).

BACKGROUND: Involuntary civil commitment (ICC) is a court-mandated process to place people who use drugs (PWUD) into substance use treatment. Research on ICC effectiveness is mixed, but suggests that coercive drug treatment like ICC is harmful and can produce a number of adverse outcomes. We qualitatively examined the experiences and outcomes of ICC among PWUD in Massachusetts. METHODS: Data for this analysis were collected between 2017 and 2023 as part of a mixed-methods study of Massachusetts residents who disclosed illicit drug use in the past 30-days. We examined the transcripts of 42 par

Effects of involuntary outpatient commitment and depot antipsychotics on treatment adherence in persons with severe mental illness.

This study examines potential improvement in treatment adherence during a study of involuntary outpatient commitment among individuals with severe mental illnesses. Involuntarily hospitalized subjects, awaiting discharge under outpatient commitment, were randomly assigned to be released or continue under outpatient commitment after hospital discharge. A nonrandomized group with a recent history of serious violence was also studied under outpatient commitment. Randomized control and outpatient commitment groups did not differ significantly in group comparisons of treatment adherence. However, a

Involuntary Commitment as "Carceral-Health Service": From Healthcare-to-Prison Pipeline to a Public Health Abolition Praxis.

Involuntary commitment links the healthcare, public health, and legislative systems to act as a "carceral health-service." While masquerading as more humane and medicalized, such coercive modalities nevertheless further reinforce the systems, structures, practices, and policies of structural oppression and white supremacy. We argue that due to involuntary commitment's inextricable connection to the carceral system, and a longer history of violent social control, this legal framework cannot and must not be held out as a viable alternative to the criminal legal system responses to behavioral and

Integrating Psychiatric and Hospice Services: Legal and Clinical Considerations for Involuntary Commitment in Multimorbid End-of-Life Care.

Multimorbid patients at the end-of-life face complex medical, psychosocial, and psychiatric challenges. Hospice care aims to address physical, emotional, and spiritual needs; however, psychiatric comorbidities, particularly acute crises, remain under-recognized and inconsistently managed. The intersection of psychiatric intervention, hospice care, and legal frameworks such as involuntary commitment presents significant clinical and ethical challenges. We describe a 76-year-old male with multiple chronic conditions, including hypertension, coronary artery disease, diabetes, hyperlipidemia, gast

Competence and Involuntary Commitment of Patients with Anorexia Nervosa: A Qualitative study on the Perceptions and Performance of Psychiatrists and Clinical Psychologists.

INTRODUCTION: Anorexia nervosa poses an important bioethical dilemma, since patients often refuse treatment despite the danger that this poses to their health, and it is not clear that their decision is autonomous. The aim of this study was to investigate the perceptions/performance of psychiatrists and clinical psychologists regarding the capacity and involuntary hospitalisation of patients with anorexia nervosa. METHODS: Seven psychiatrists, four clinical psychologists, and one third-year resident psychologist were interviewed. A qualitative research approach based on grounded theory was us

Profile of children placed in residential psychiatric program: Association with delinquency, involuntary mental health commitment, and reentry into care.

This study examined characteristics and profiles of youth receiving services in 1 of Florida's Medicaid-funded residential mental health treatment programs--State Inpatient Psychiatric Program (SIPP)--between July 1, 2004, and June 30, 2008 (N=1,432). Latent class analysis (LCA) was used to classify youth, and 3 classes were identified: Children With Multiple Needs, Children With No Caregivers, and Abused Children With Substantial Maltreatment History. The results of LCA showed that Children With Multiple Needs experienced the greatest risk for adverse outcomes. Compared with youth in the othe

[German practice of involuntary commitment at both federal and state level after introduction of the Guardianship law (1992-2009)].

BACKGROUND: Given the steady rise of psychiatric coercive measures in Germany, the question arises whether this development is significantly influenced by the corresponding legal basis or through epidemiological, socio-economic or socio-structural factors. METHODS: Based on full surveys of the Federal Ministry of Justice we examined the development and associations of 10 indicators of coercive psychiatric measures over a period of 18 years. Time trends of all indicators have been descriptively analysed. Statistical associations between time trends and between involuntary and admissions econom

Characteristics and experiences of people who use drugs with involuntary civil commitment (Section 35) histories in Massachusetts: 2017 to 2022.

Massachusetts law permits involuntary civil commitment (ICC) of people who use drugs (PWUD) into drug treatment. We sought to characterize experiences of PWUD with and without ICC histories by exploring the associations of one or more ICC experiences by sociodemographics, substance use, and subsequent health outcomes. We analyzed survey data of 714 PWUD, collected from multiple mixed-methods rapid assessments conducted between 2017 and 2022, with further examination of the 209 (29.3 %) participants who reported experiencing ICC and have since returned to use. We computed univariate and bivaria

Mental health professionals' attitudes towards mental competency and involuntary commitment in anorexia nervosa: Construction, validation and results of the ACINOVAN questionnaire.

INTRODUCTION: Anorexia nervosa is a serious disorder that causes high rates of morbidity and mortality. Involuntary treatments are only legally admissible if the patient is not competent. However, assessing their capacity can be really complex. This implies that the final decision can be influenced by the individual attitudes of the physician. OBJECTIVE: To create and empirically validate a questionnaire in Spanish that makes it possible to measure the attitude towards capacity and involuntary commitment and compare between categorical groups. METHODS: The sample consisted of 338 mental heal
