Mandatory reporting on child abuse and neglect - many approaches, same name: Conceptualizing and understanding the mandatory reporting legislation.

Mandatory Reporting (MR) is a range of regulations that, in its simplest form, mandate the reporting of suspected child abuse and neglect to state authorities and is widely implemented globally. Despite the common usage of the term MR, it masks significant divergences in goals and operational definitions. This paper discusses data from previous studies and official records to understand the various elements used and how responsibilities for protecting children are conceptualized. The paper highlights three main areas of focus for the MR regulations: children's focus (children's rights, child p

ECT in Texas: 19 months of mandatory reporting.

BACKGROUND: Texas law requires that all non-federal clinical facilities providing electroconvulsive therapy (ECT) report every treatment to the state's mental health agency. The resulting data provide total population information about treating physicians and hospitals; payment source; patient age, sex, ethnicity, diagnosis, and admission/consent status; symptom severity and response; numbers and types of treatments; and untoward events occurring within 14 days after treatment. METHOD: We reviewed all reports of ECT between September 1993 and April 1995 (2583 reports, approximately 15,240 tre

Healthcare safety committee in Japan: mandatory accountability reporting system and punishment.

PURPOSE OF REVIEW: The publication of To Err is Human by the Institute of Medicine highlighted the increased international concern about patient safety. Each country has developed its own medical adverse event reporting system. In 2007, the Japanese government attempted to establish a new accountability system in medicine, after an obstetrician was arrested for manslaughter. This paper reviews how this accountability system affected Japanese physicians' behavior, and describes different types of medical adverse event reporting systems. RECENT FINDINGS: In general, reporting of adverse event s

Compliance with mandatory reporting of intimate partner violence among professionals in Norway.

BACKGROUND: Mandatory reporting is a common legislative preventative measure for several types of crimes, among them family violence and specifically intimate partner violence (IPV). Among the individuals who are mandated to report under the law are professionals working with IPV victims and perpetrators in their practice. However, little is known about which characteristics are associated with compliance with the mandatory reporting of IPV (MR-IPV) law, on the one hand, and choosing not to report IPV, on the other. METHODS: The current study sampled 357 professionals from 6 different agencie

Mandatory reporting of child physical abuse and dental neglect by Australian dentists.

Child protection measures are organized into three major themes: laws; service programs; and status of outcomes of these interventions. Contextually, mandatory reporting of child abuse and neglect is governed by a complex system of State legislation across Australia. The purpose of this review was to investigate the evidence base for the legislative obligations of Australian dentists as mandatory reporters; the functionality of dental practice in the determination of orofacial signs of abuse and neglect; and, relevant knowledge and practice demonstrated by the Australian dental work force. Preservice teachers' sources of information on mandatory reporting of child sexual abuse.

Teachers in many countries are mandated by law, professional codes, or education authorities to report child abuse and neglect, including child sexual abuse. However, teachers may not receive adequate preparation for such sensitive interventions, as preservice teacher education degrees provide very few or no compulsory courses on child protection and crucially related, lifelong health and well-being issues. So, where do preservice teachers source their information regarding the mandatory reporting of such abuse? This research examines preservice teachers' professional university education for

Violence against children: an analysis of mandatory reporting of violence, Brazil 2011.

This article aims to describe and analyze reporting of violence against children from 0 to 9 years of age, issued by the public health services, in Brazil. Data from the Violence and Accident Surveillance System (Viva-SINAN) were used. The frequency of selected variables was calculated by age group (0-1; 2-5 and 6-9 years of age) as well as their Prevalence Ratios (PR). 17.900 cases were reported: 33% in the 0-1 year group; 35,8% in the 2-5 year group; and 31,2% in the 6-9 year group. Physical violence predominated among boys (PR: 1.22; CI 95%: 1,16-1,28 ); 6-9 years old (PR: 1,19; CI 95%: 1,1

Attitudes of hospital medical practitioners to the mandatory reporting of professional misconduct.

BACKGROUND: New legislation now requires doctors to report unfit colleagues to the Medical Council of New Zealand. However, little research has examined the attitudes and willingness of doctors to report errant colleagues. AIM: To examine the attitudes of a range of hospital-based medical practitioners towards the mandatory reporting of colleagues. METHODS: House staff, registrars, and consultants at two major tertiary teaching hospitals in New Zealand were surveyed using a written questionnaire. Doctors were asked to state their level of agreement with a series of statements and to make res

Universal Mandatory Reporting Policies and the Odds of Identifying Child Physical Abuse.

OBJECTIVES: To examine the relationships between universal mandatory reporting (UMR), child physical abuse reporting, and the moderating effect of UMR on physical abuse report outcomes by report source. METHODS: We used a national data set of 204 414 children reported for physical abuse in 2013 to compare rates of total and confirmed reports by states or territories with and without UMR. We estimated odds and predicted probabilities of confirming a physical abuse report made by professional versus nonprofessional reporters, accounting for the moderating effect of UMR and individual-level char

Child sexual abuse and mandatory reporting intervention preservice content preferred by student teachers.

The importance of preservice university teacher training about child sexual abuse and its mandatory reporting intervention is addressed in educational literature, although very little is known about student teachers' learning interests and preferences in this area. In this article, student teachers refer to students in university who are training to become teachers whose training includes teaching experiences in schools. This study examines the content about child sexual abuse and its intervention that student teachers believe they should learn. Results based on quantitative analyses show the

Mandatory Reporting: An Exploration of Student Perceptions of University Response to Sexual Misconduct.

To respond to sexual misconduct many universities have implemented mandatory reporting (MR), which requires university employees to report disclosures of sexual misconduct to university officials. The current study examines student perceptions of three different approaches to MR (universal, selective, and student-directed). Results revealed that most students preferred a student-directed approach to MR over selective or universal approaches. Survivors of sexual misconduct indicated lower intent to report misconduct under the universal approach to MR compared to their nonvictimized peers. Addit

[The physician in the dilemma between confidentiality and mandatory reporting of occupational diseases].

If a physician may reasonably suspect an occupational disease after examining his or her patient he is liable by German law to report this directly to the statutory accident insurance body or the Government institution responsible for the medical safety of working places, in accordance with section 202 of the Federal German social legislation code VII. This legal obligation to officially report an occupational disease is based on weighing the pros and cons in respect of balancing out an individual's right to privacy on the one hand and the (in this case predominant) public safety interests on

Sexual Assault in the Ivory Tower: Public Opinion on University Accountability and Mandatory Reporting.

Highly publicized college sex crimes have recently captured public and policy attention. In response, greater discussion has turned to institutional accountability and controversial reforms such as mandatory reporting (MR). No study to date has measured public perceptions of campus sex assault procedures, however. This omission is notable because public opinion can directly and indirectly shape crime policy and because the topic has become increasingly politicized. Drawing on a 2015 poll of Virginia residents, this study evaluates views about campus sexual assault policy. Results indicate that

Impact of a new mandatory reporting law on reporting and identification of child sexual abuse: A seven year time trend analysis.

Child sexual abuse is widespread and difficult to detect. To enhance case identification, many societies have enacted mandatory reporting laws requiring designated professionals, most often police, teachers, doctors and nurses, to report suspected cases to government child welfare agencies. Little research has explored the effects of introducing a reporting law on the number of reports made, and the outcomes of those reports. This study explored the impact of a new legislative mandatory reporting duty for child sexual abuse in the State of Western Australia over seven years. We analyzed data a

INTRODUCTION: The best interests of the child shall be paramount in any matter concerning a child and it should be the primary consideration by any court, person, institution, or other body in any matter concerned with a child. This study sought to explore the influence of legislation on and professional commitment of radiographers towards suspected child physical abuse. METHOD: A semi-structured interview was conducted with 20 radiographers selected across all the regions in Ghana.
