Courts, rights and the critically brain-injured patient.

The reality of current clinical practice in the UK is that where a patient's family refuses to agree to testing for brain stem death (BD), such cases will ultimately end up in court. This situation is true of both adults and children and reinforced by recent legal cases. While recourse to the courts might be regrettable in such tragic cases, if public trust in the medical diagnosis of BD is to be maintained all aspects of the process must be conducted in a way that is transparent and open to scrutiny. This is not an 'ineffective expenditure' of resources, but an essential element of a human ri

Pain and symptom control. Patient rights and physician responsibilities.

In considering the care of patients with incurable and terminal diseases, there are three types of interventions: (1) palliative care and symptom management; (2) experimental therapies; and (3) active life-ending interventions. Relief of pain, other symptoms, and suffering should be the basic and standard treatment; the other interventions are meant to supplement, not replace, this intervention. This means the physician's primary obligation is to inform patients about the options for palliative care and to provide quality palliative care. Thus, physicians who care for terminally ill patients h

Breast cancer screening in older women: law and patient rights.

Legal principles that apply to breast cancer in older women have been developed in judicial decisions related to other medical screening tests. There are no special legal rules for either mammography or older women, although older women seldom file malpractice suits. The general standard is that a screening test must be offered to any particular age group when it is considered "reasonably prudent" to do so, and this almost always means when the medical profession--usually speaking though its specialty boards--declares it the standard of care. The standard of care should be set by medical profe

Aspects of patient rights in a developing country: a qualitative study.

BACKGROUND: Patients' rights are integral to ensuring ethical and humane healthcare delivery. Understanding these rights helps promote patient-centered care and strengthens trust in healthcare systems. Although international frameworks outline patients' rights comprehensively, Sri Lanka lacks specific legislative recognition and public awareness on the topic. This study aims to explore perspectives on patients' rights in Sri Lanka and identify barriers and facilitators to their implementation. METHODS: A qualitative study was conducted at the National Hospital of Sri Lanka, involving individu

Enhancing neonatal vascular access: proposing a patient-centered framework based on 7-Rights.

Neonatal vascular access (VA) is a critical component of neonatal intensive care. However, VA remains a high-risk procedure associated with pain and serious complications. Despite the availability of evidence-based guidelines, variability in practice persists, leading to inconsistent patient outcomes. A standardized, patient-centered approach could enhance patient safety, experience, and outcomes. The '7-Rights Framework for Neonatal VA' emerged through international expert consensus. This framework uses the concept of patient rights, the '7-Rights' - Right Patient, Right Care Team, Right Comf

Resuscitating Patient Rights during the Pandemic: COVID-19 and the Risk of Resurgent Paternalism.

The COVID-19 Pandemic a stress test for clinical medicine and medical ethics, with a confluence over questions of the proportionality of resuscitation. Drawing upon his experience as a clinical ethicist during the surge in New York City during the Spring of 2020, the author considers how attitudes regarding resuscitation have evolved since the inception of do-not-resuscitate (DNR) orders decades ago. Sharing a personal narrative about a DNR quandry he encountered as a medical intern, the author considers the balance of patient rights versus clinical discretion, warning about the risk of resurg

Patient rights and law: tobacco smoking in psychiatric wards and the Israeli Prevention of Smoking Act.

In August 2001, the Israeli Ministry of Health issued its Limitation of Smoking in Public Places Order, categorically forbidding smoking in hospitals. This forced the mental health system to cope with the issue of smoking inside psychiatric hospitals. The main problem was smoking by compulsorily hospitalized psychiatric patients in closed wards. An attempt by a psychiatric hospital to implement the tobacco smoking restraint instruction by banning the sale of cigarettes inside the hospital led to the development of a black market and cases of patient exploitation in return for cigarettes. Medical students' experiences of professional lapses and patient rights abuses in a South African health sciences faculty.

PURPOSE: To elicit South African medical students' experiences of witnessing patient rights abuses and professional lapses during their clinical training in order to inform an appropriate and effective response. METHOD: During June and July 2009 at the University of Cape Town Faculty of Health Sciences, the authors surveyed 223 fourth-, fifth-, and sixth-year medical students in selected clinical rotations concerning abuses they had observed. Volunteers were later interviewed individually. The authors coded interview transcripts for key themes using a constant-comparative grounded theory appr

Analysis of bone healing in a postoperative patient: skeletal evidence of medical neglect and human rights violations.

This study highlights complexities associated with postsurgical trauma interpretation of a 76-year-old female patient from a psychiatric institution in Mexico. The skeletal analysis identified complications from an unsuccessful surgical operation for an intertrochanteric fracture of the femur. An improperly placed surgical plate resulted in nonunion due to limited contact between fracture margins. However, it is unclear whether this resulted from surgical complications, ineffective postoperative care, or from the decedent's limited ability to follow postoperative care instructions. Respect for Patients' Rights in Hospital Practice: Associations with Physicians' Legal Knowledge, Defensive Medicine, and Patient-Centered Care.

Background/Objectives: This study examined associations of physicians' legal knowledge, defensive medicine, and patient-centered orientation with self-reported respect for patients' rights. Methods: A single-center cross-sectional study (February-June 2026) included 96 physicians. The primary outcome was the Patients' Rights Respect Score (PRRS, 0-100). The confirmatory analysis compared PRRS between legal-knowledge groups (adequate ≥70/100). Multivariable regression was secondary; mediation and prediction were exploratory. Results: Adequate legal knowledge (34/96, 35.4%) was associated with h

Benzodiazepines for agitation in patients with delirium: selecting the right patient, right time, and right indication.

PURPOSE OF REVIEW: To provide an evidence-based synopsis on the role of benzodiazepines in patients with agitated delirium. RECENT FINDINGS: Existing evidence supports the use of benzodiazepines in two specific delirium settings: persistent agitation in patients with terminal delirium and delirium tremens. In the setting of terminal delirium, the goal of care is to maximize comfort, recognizing that patients are unlikely to recover from their delirium. A recent randomized trial suggests that lorazepam in combination with haloperidol as rescue medication was more effective than haloperidol alo

COPD Biologics: Right Patient, Right Pathway, Right Time.

Chronic obstructive pulmonary disease (COPD) is a heterogeneous disease that is entering a new era in precision medicine. Advances in disease endotyping have challenged the traditional view of COPD as a uniformly neutrophilic disorder and revealed biologically distinct subgroups in whom targeted immunomodulation may be effective. Reproducible signatures of type 2 (T2) inflammation and epithelial-derived alarmin activation have emerged as actionable pathways, reshaping therapeutic development in COPD. This narrative review synthesises mechanistic insights and clinical trial evidence for biologi

COPD: Providing the right treatment for the right patient at the right time.

Chronic Obstructive Pulmonary Disease (COPD) is a common disease associated with significant morbidity and mortality that is both preventable and treatable. However, a major challenge in recognizing, preventing, and treating COPD is understanding its complexity. While COPD has historically been characterized as a disease defined by airflow limitation, we now understand it as a multi-component disease with many clinical phenotypes, systemic manifestations, and associated co-morbidities. Evidence is rapidly emerging in our understanding of the many factors that contribute to the pathogenesis of

Defibrillators: Selecting the Right Device for the Right Patient.

Advances in the field of defibrillation have brought to practice different types of devices that include the transvenous implantable cardioverter-defibrillator (ICD) with or without cardiac resynchronization therapy, the subcutaneous ICD (S-ICD), and the wearable cardioverter-defibrillator. To ensure optimal use of these devices and to achieve best patient outcomes, clinicians need to understand how these devices work, learn the characteristics of patients who qualify them for one type of device versus another, and recognize the remaining gaps in knowledge surrounding these devices.
