Advance directives and the Patient Self-Determination Act: what is a nurse to do?

Since the Patient Self-Determination Act was enacted in 1991, asking patients whether they have advance directives (eg, a Living Will and a Durable Power of Attorney for Health Care Decisions) has become part of the admission procedures at health care facilities. However, questions may still remain about what exactly is the role of the health care provider in this part of the admission process. In many health care settings, the nurse has the responsibility to ask the patient about advance directives. If this occurs during preparation for surgery or other medical procedures, it adds responsibil

Advance care planning and surrogate health care decision making for older adults.

Older adults have a legally recognized right to determine and control the health care they receive and are legally presumed to possess the capacity necessary to make health care decisions. However, older adults are at major risk for life-threatening and serious health problems leading to a loss of their capacity to make end-of-life and other health care decisions. Advance care planning is a process that enables older adults to specify who they want to act as a surrogate decision maker and what decisions they want made for them in the event of incapacitation. Geriatric nurses can play a signifi

Assessing Decision Making Capacity for Do Not Resuscitate Requests in Depressed Patients: How to Apply the "Communication" and "Appreciation" Criteria.

The Patient Self Determination Act (PSDA) of 1991 brought much needed attention to the importance of advance care planning and surrogate decision-making. The purpose of this law is to ensure that a patient's preferences for medical care are recognized and promoted, even if the patient loses decision-making capacity (DMC). In general, patients are presumed to have DMC. A patient's DMC may come under question when distortions in thinking and understanding due to illness, delirium, depression or other psychiatric symptoms are identified or suspected. Decisional Capacity in Amyotrophic Lateral Sclerosis.

The cognitive and behavioral changes that can be observed in the neurodegenerative terminal disease amyotrophic lateral sclerosis (ALS), once characterized as purely a motor neuron disease, have become increasingly recognized over the past century. Detecting cognitive deficits earlier and identifying continued changes at regular intervals can lead to improved care, proactive treatments, and earlier discussions about end-of-life wishes. Although medical decisional capacity is required for every treatment decision made, its importance becomes paramount when making decisions on complex medical tr

Recent developments in health law relevant to health care providers.

Because health law is changing continually, clinicians must be updated periodically. This article discusses two significant legal developments: the defeat of court-ordered cesarean sections and the new Patient Self-Determination Act. A decision reached by the Court of Appeals for the District of Columbia asserted that medical decisions on behalf of a woman and her fetus should be made by the pregnant woman if she is conscious and alert. Although this decision does not supply all the answers, it reiterates judicial support for the primacy of a woman's rights when her welfare is endangered by a

Adolescent Brain Development and Medical Decision-making.

With a few notable exceptions, adolescents do not possess the legal authority to provide consent for or refuse medical interventions. However, in some situations, the question arises regarding whether a mature minor should be permitted to make a life-altering medical decision that would be challenged if made by the minor's parent. In this article, I explore what we currently know about the adolescent brain and how that knowledge should frame our understanding of adolescent decision-making. The prevailing approach to determining when adolescents should have their decisions respected in the medi

The effectiveness and ethical justification of psychiatric outpatient commitment.

Studies link involuntary outpatient commitment with improved patient outcomes, fueling debate on its ethical justification. This study compares inpatient utilization for committed outpatients in the 1990s with those who were not under outpatient civil commitment orders. Findings reveal committed outpatients had higher utilization of inpatient services and restraint episodes prior to their commitment compared with a control group. Committed outpatients also were more likely to have been on discharge status at the time of admission, have been admitted involuntarily under emergency legal procedur

Giving up on the objective of providing goal-concordant care: Advance care planning for improving caregiver outcomes.

The merits and effectiveness of advance care planning (ACP) continue to be debated a full 30 years after the passage of the Patient Self-Determination Act. This act gave patients the right to create advance directives, with the objective of ensuring that the care they received at the end of life was consistent with their preferences and goals. ACP has definitively moved beyond the completion of advance directives to encompass the identification of a healthcare agent and the facilitation of communication among patients, surrogates, and clinicians. Nonetheless, the provision of goal-concordant c

In Germany, there are approximately 70,000 prison spaces (criminal and pre-trial detention), which are currently over 90% full. Medical care is organized by the judicial administration. Section 63 of the Bremen Prison Act (BremStVollzG) regulates medical care. It stipulates that prisoners are entitled to "necessary, sufficient, and appropriate medical services, observing the principle of cost-effectiveness and taking into account the general standards of statutory health insurance."The European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) ident

Is it ethically permissible for GPs to promote non-directed altruistic kidney donation to healthy adults?

Doctors hold coexisting ethical duties to avoid causing deliberate harm to their patients (non-maleficence), to act in patients' best interests (beneficence), to respect patients' right to self-determination (autonomy) and to ensure that costs and benefits are fairly distributed among patients (justice). In the context of non-directed altruistic kidney donations (NDAKD), doctors' duties of autonomy and justice are in tension with those of non-maleficence and beneficence. This article examines these competing duties across three scenarios in which general practitioners (GPs) could promote NDAKD

Matters to address prior to introducing new life support technology in Japan: three serious ethical concerns related to the use of left ventricular assist devices as destination therapy and suggested policies to deal with them.

BACKGROUND: Destination therapy (DT) is the permanent implantation of a left ventricular assist device (LVAD) in patients with end-stage, severe heart failure who are ineligible for heart transplantation. DT improves both the quality of life and prognosis of patients with end-stage heart failure. However, there are also downsides to DT such as life-threatening complications and the potential for the patient to live beyond their desired length of life following such major complications. Because of deeply ingrained cultural and religious beliefs regarding death and the sanctity of life, Japanese

The Impact of Patient Characteristics on Their Attitudes Toward an Online Patient Portal for Communicating Laboratory Test Results: Real-World Study.

BACKGROUND: Patient portals are promising tools to increase patient involvement and allow them to manage their health. To optimally facilitate patients, laboratory test results should be explained in easy language. Patient characteristics affect the usage of portals and the user satisfaction. However, limited research is available, specified for online communicating laboratory test results, on whether portal use and acceptance differ between groups. OBJECTIVE: The aim of this study was to assess the effect of patient characteristics (gender, age, education, and chronic disease) on the self-ef

Family cohesion and expressiveness promote resilience to the stress of pediatric bone marrow transplant: a preliminary report.

The effect of perceived family environment as a determinant of adjustment in children undergoing bone marrow transplant (BMT) was assessed in a prospective, longitudinal study. Measures of patients' social competence, behavior problems, and self-esteem, along with perceived family conflict, cohesion, and expressiveness, were obtained before hospital admission for BMT and again in the period 6 to 12 months post-BMT. Significant declines were observed in post-BMT social competence and overall self-concept. Before BMT, perceptions of family conflict showed a moderate inverse correlation with pati

The role of proopiomelanocortin (POMC) in sequentially dependent self-injurious behavior.

Self-injuring behavior (SIB) is a life-threatening behavior exhibited by many species, including humans, and has no known cause and no agreed upon treatment. The role of the stress axis in the maintenance of this mysterious behavior was examined in subjects with life-long SIB. Over a 6-year period, 40 hr of direct observations of behavior and the environment were recorded on palmtop computers while 36 residential subjects (28 target and 8 control subjects) conducted their daily activities. Blood samples were collected in morning and evening for all subjects and within minutes after a self-inju

Health and Wellness Projects Created by Student Pharmacists during Advanced Pharmacy Practice Experiences: Exploring the Impact on Professional Development.

A curricular expectation of pharmacy educators is to equip students with strategies for the promotion of health and wellness. The impact on student professional development with involvement in such health promotions has been sparsely documented. The specific aim of this project was to explore the impact on student learning and professional development when they create, implement, and reflect upon a Health and Wellness Project (HWP). In 2022-2023, each student completing a Community Advanced Pharmacy Practice Experience created and implemented an HWP with the goal of serving as a "health promot

Validation of the McIntyre And Rosenblat Rapid Response Scale (MARRRS) in Adults with Treatment-Resistant Depression Receiving Intravenous Ketamine Treatment.

BACKGROUND: Depression severity and efficacy measurement scales employed for rapid-acting treatments (e.g., ketamine) were initially validated in adults receiving conventional monoamine-based antidepressants. The emergence of rapid-acting antidepressants in psychiatry provides the impetus for outcome measures that have been validated as sensitive to change with rapid-acting treatments. Herein, we provide results validating the McIntyre and Rosenblat Rapid Response Scale (MARRRS). METHODS: Adults with treatment-resistant depression (TRD) receiving intravenous (IV) ketamine had depressive sympt
