The history of informed consent dates back as early as the 16th century (Selek, 2010). The current tenets of informed consent pertaining to the ethical conduct of research on human participants predominately stems from the 1947 Nuremberg Code (National Institutes of Health, 2016), which was created following the Nuremberg trials at the end of World War II. The unethical conduct of research on human participants during the Holocaust, coupled with experiments (e.g., the Tuskegee syphilis study), prompted a more formalized structure for ensuring the well-being and autonomy of human participants i

Biobanking research seeks to improve the diversity, availability, and quality of human specimens critical for translational research, including biospecimen collections from disadvantaged minorities. American rural whites are seldom represented in such initiatives as geographic isolation makes obtaining informed consent challenging. We report a case series of 83 newly diagnosed cancer patients, attending a rural community medical center, who consented to participate in cancer research. To enable pooling with population studies, we created a BioGeoBank using 2007 NCI and ISBER Best Practices, af

While it is broadly accepted that body donation for anatomical education should rely on informed consent, consent processes vary substantially. Best practice guidelines for body donation are typically published by anatomical societies and may not reflect details valued by prospective donors or the educators and students who utilize donor bodies for teaching and learning. As an initial step to designing a consent process for a proposed body donor program at Monash University in Australia, this study brought together prospective body donors, students, and educators to explore their perspectives

BACKGROUND: Informed consent is a cornerstone of modern medicine, yet the extent to which patients truly understand surgical information in the perioperative setting remains uncertain, particularly among older and vulnerable populations. Orthopaedic surgery represents a particularly challenging context, as trauma pathways are often characterized by urgency, pain, and emotional stress, whereas elective procedures allow greater opportunity for structured communication.
AIMS: To assess real-time patient comprehension of surgical informed consent immediately before orthopaedic surgery and to comp

PURPOSE: Standard consent practices in HIV research often do not facilitate truly competent informed consent. We examined a brief audiovisual intervention to enhance competence to consent to participate in a hypothetical trial aimed at promoting sexual health and reducing stimulant use among young gay and bisexual men who use stimulants.
METHODS: Between June 2024 and January 2025, we enrolled 115 young gay and bisexual men aged 16-24 years who were at risk for HIV transmission or acquisition and reported recent stimulant use. Participants were randomized to standard consent (i.e., written in

The risk posed to the community by possible xenozoonosis after xenotransplantation suggests that some form of 'community consent' is required before whole organ animal-to-human xenotransplantation should take place. I argue that this requirement places greater obstacles in the path of ethical xenotransplantation than has previously been recognised. The relevant community is global and there are no existing institutions with democratic credentials sufficient to establish this consent. The distribution of the risks and benefits from xenotransplantation also means that consent is unlikely to be f

Background: Enrollment in smoking cessation trials remain sub-optimal. The aim of this analysis was to determine the effectiveness of a modified Zelen's design in engaging hospitalized patients who smoke in a pragmatic OPT-IN versus OPT-OUT tobacco treatment trial. Methods: At bedside, clinical staff screened smokers for eligibility, randomized eligible into study arms, and delivered the appropriate treatment approach. Study staff called randomized patients at one-month post-discharge, debriefed patients on the study design, and collected consent to participate. We used frequencies and percent

Decision-making capacity in health care refers to a person's ability to understand information relevant to a decision, appreciate how the decision affects them, make a choice, and communicate that choice. Capacity is essential in ethics and professional nursing practice because it forms the basis of informed consent. Nurses encounter various medical conditions, such as dementia, that can contribute to changes in cognitive abilities and result in diminished capacity. However, having a cognitive condition such as dementia does not necessarily mean a person lacks the capacity to make a specific d

In this study, the Search Your Mind (S.Y.M., ) project aimed to collect prospective digital phenotypic data centered on mood and anxiety symptoms across psychiatric disorders through a smartphone application (app) platform while using both centralized and decentralized research designs: the centralized research design is a hybrid of a general prospective observational study and a digital platform-based study, and it includes face-to-face research such as informed written consent, clinical evaluation, and blood sampling. It also includes digital phenotypic assessment through an application-base

BACKGROUND: Interest in and use of electronic consent (e-consent) in the conduct of academic clinical trials has increased since the COVID-19 pandemic. E-consent offers advantages including increased efficiency and accessibility, and reduced burden on site staff, which can be appealing to academic trialists anticipating challenges in recruitment to complex trial designs or with limited funding. However, there are many options to consider when using e-consent in a study protocol. This paper presents five case studies from Norwich Clinical Trials Unit, demonstrating how e-consent models can be e

Next generation sequencing panels have revolutionized the diagnostic approach to patients with epilepsy. There are several commercial epilepsy panels available. We assessed the list of genes tested and consent forms for epilepsy panels available at seven laboratories. The panels varied in the number of genes included (70-465 genes). In some panels, genes not currently associated with epilepsy were included (up to 4 % of panel content). The panels also included genes for lysosomal storage disorders (6-12 %), congenital disorders of glycosylation (0-8.5 %), metabolic disorders (3.5-34 %), neurol

The shift away from socialized forms of welfare over the past twenty years has changed the symbolic basis on which bodily parts are exchanged. Titmuss viewed the newly-formed National Health Service in the United Kingdom as a vehicle for institutionalizing altruistic practices, notably the voluntary "gift" of blood to strangers represented by the transfusion service. More recent advances in medical technology have made new forms of bodily tissue donation possible, including the transplantation of whole organs. Yet the excess of demand over supply is forcing a change from the principle of volun

The obtainment, storage, and use of human tissue taken from children for research purposes is an area that is notable for its complexity and legal uncertainties. In the UK, the controversy surrounding organ retention prompted radical legislative change in the form of the Human Tissue Act 2004, which came into force from September, 2006. This Review paper explores the effect of the Human Tissue Act on consent, in the context of childhood tissue banking. We take as our case study the UK Children's Cancer Study Group tumour bank. Although the Human Tissue Act provides a new, detailed statutory fr

Fat grafting to the breasts has long been controversial among aesthetic surgeons. We have developed a new, safe, effective, and reliable lipomodeling method to be used in breast augmentation. This method grew out of our clinical and radiologic experience acquired since 1998 with fat injections to the breast. The aim of the present report is to provide facts and data concerning lipomodeling and to document our procedures for ensuring that clear, consistent, up-to-date information is given to the patients who are undergoing aesthetic lipomodeling. The key element in our preparation is our commit

PURPOSE: Informed consent for surgery can address the legal aspects of care while also being simple, informative, and empathic. We developed interactive informed consents and compared them with standard printed informed consents asking: (1) are there any factors associated with lower decision conflict or greater patient-rated clinician empathy including consent format? (2) Are there any factors associated with rating the consent process as informative, comfortable, and satisfying including consent format?
METHODS: Ninety-four adult patients accepted an offer of surgery from one of three hand

Informed consent has two aspects. First, we must give patients sufficient, precise information on the nature of their disease, natural history, possible choices of treatment, and risks of the treatment to help them make their own decisions. The estimated risks should be based on a database, not on personal impressions or limited experience. In choosing the type of prosthetic valve in young or middle-aged patients, unbiased information based on guidelines should be presented. The second aspect of informed consent is its role as a contract for providing medical service. Estimated in-hospital mor

Whole-bodies, or human cadavers, are of great value for medical education and science. The process of body donation and its regulation is, however, questionable. The Dutch legal framework is not sufficient. For example, the collaboration of anatomy departments with industry is not covered by existing regulations. Also, it is unclear what should be done in case of unexpected findings. Moreover, consent in whole-body donation does not meet specific conditions for informed consent. It takes the form of 'broad consent', allowing for unspecified use of the bodies. A monitoring system concerning the

Although sexual consent has become increasingly prominent in public discourse following the #MeToo movement, its meaning within intimate relationships often remains ambiguous. Nonconsensual sexual contact between intimate partners nevertheless represents an important form of violence requiring greater understanding. To explore men's perceptions of sexual consent in intimate relationships, we conducted semi-structured interviews with 29 men receiving community-based treatment for emotion regulation difficulties and violent behavior in intimate partner or family contexts. Thematic analysis revea

Law n. 40/2004 regulated Medically Assisted Procreation (MAP) in Italy. The case described in this article is part of the many judicial cases that have affected this legislation. Following the marital separation process, the former husband withdrew consent to the implantation of already formed embryos in the uterus of his former wife who turned to the judiciary to obtain permission to initiate such a procedure. This paper consists of an analysis of this judicial process and deals with medical-legal and bioethical issues. In contrast to what is stated in Law n. 40/2004, the subsequent Law n. 21

PURPOSE: Informed consent is a cornerstone of ethical practice. Eliciting patient questions during informed consent increases patient engagement and understanding, thus enhancing integrity of the consent process. However, a patient in visible pain can add an additional challenge to the informed consent process. The purpose of this research was to examine if and how anesthesiology residents ask for questions from a patient displaying severe pain during an informed consent simulation.
METHODS: Anesthesiology residents recruited from three anesthesia residency programs were video recorded perfor
