Health courts: an alternative to traditional tort law.

The current adversarial tort-based system of adjudicating malpractice claims is flawed. Alternate methods of compensation for birth injuries related to oxygen deprivation or mechanical injury are being utilized in Virginia and Florida. Although utilization of both of these schemes is limited, and they are not without problems in application, both have been successful in reducing the number of malpractice claims in the tort system and in reducing malpractice premiums. While the Florida and Virginia programs are primarily focused on compensation, other models outside the US focus include compens

Safety of MRI in patients with implanted deep brain stimulation devices.

OBJECTIVE: To survey the safety of MRI in PD patients implanted with DBS devices. BACKGROUND: MRI in patients with DBS implants is useful to confirm electrode placement, optimize programming and investigating complications. However, several medical centers do not perform MRI studies in DBS patients because of safety concerns. The safety profile of MRI in DBS patients has not been documented in large clinical series. METHODS: 42 NPF Centers of Excellence (COEs) were asked to complete a questionnaire on MRI use and DBS. RESULTS: Investigators from 40 of 42 (95%) NPF COEs completed the survey

Sexual harassment and hostile environments in the perioperative area.

Nursing has dealt with sexual harassment since the era of Florence Nightingale. Despite legislation and increased media attention, perioperative nurses continue to experience frustration, embarrassment, and psychological and economic repercussions because of sexual harassment. Prevention of sexual harassment must encompass individuals, employers, and the health care profession as a whole. Individuals can take steps to stop sexual harassment by reporting the incidents and confronting the harassers. Employers have a legal responsibility to maintain work environments that discourage sexual harass

Criminal responsibility and solvent exposure.

This case report contains the history of a man's exposure to benzene, trichloroethylene, and toluene. J suffered acutely from classic symptoms of toxic exposure to these compounds, such as fatigue, clumsiness, staggering, and hematopoietic depression. During his medical hospitalization, he was exposed to further organic insults, such as being treated with medications like Cytoxan and medications to treat an abscess in his right parietal lobe. After the acute exposure and after the abscess had resolved, his functioning on neuropsychological testing was still depressed, as he had a Full Scale IQ

Solving the Opioid Epidemic in Ohio.

On May 31, 2017, Ohio Attorney General Mike DeWine took a step in fighting Ohio's opioid epidemic, bringing the first of many lawsuits against five top pharmaceutical companies. However, under Federal and State law, there is an exception called the Learned Intermediary Doctrine, which can absolve drug manufacturers of liability from any misconduct that might be found and transfer that liability to a treating physician. This exception is the way many drug manufacturers were able to avoid being held responsible in the past. This Note proposes that with the current pending lawsuit in the State of

Forensic aspects of drug-induced violence.

Violence is unfortunately a part of society. The causes of violence are not completely understood, but it involves sociological, genetic, financial, biological, and environmental factors. Drugs can cause aggression by altering the neurotransmitters dopamine, norepinephrine, gamma-aminobutyric acid (GABA), and serotonin. Specific drugs associated with aggression include alcohol, anabolic steroids, cocaine, amphetamines, sedatives, opiates, and hallucinogens. Aggression can be categorized into impulsive and predatory aggression. Drugs under certain conditions cause impulsive aggression. Sometime

Liability related to peripheral venous and arterial catheterization: a closed claims analysis.

BACKGROUND: Serious complications after peripheral IV and arterial vascular cannulations have been reported. To assess liability associated with these peripheral vascular catheters for anesthesiologists, we reviewed claims in the American Society of Anesthesiologists Closed Claims database. METHODS: Claims related to peripheral vascular catheterization were categorized as related to IV or arterial catheters. Complications related to IV catheters were categorized as to type of complication. Patient and case characteristics, severity of injury, and payments were compared between claims related

[Risks and liability in complications with respect to implant-supported suprastructures].

Despite high survival percentages of oral implants and suprastructures, various risks threaten the success of oral implant treatments. Four risk categories can be distinguished: complications during surgical treatment, loss or impending loss of the implant, fracture or wearing out of (parts of) the suprastructure, and patient dissatisfaction with the treatment outcome. The question is when a complication can be expected on the basis of present-day knowledge in a certain percentage of cases and when one can speak of negligence. In cases where treatment is carried out in accordance with the most

"Wrongful life" claims.

On 9 May 2006, the High Court of Australia dismissed "wrongful life" claims brought on behalf of two patients. One of the cases involved the alleged negligent failure by a general practitioner to diagnose prenatal rubella and to advise the mother of the risks to the fetus associated with rubella. This article outlines the case and discusses the nature of "wrongful life" and "wrongful birth" claims.

Chronic pain management: American Society of Anesthesiologists Closed Claims Project.

BACKGROUND: The practice of chronic pain management has grown steadily in recent years. The purpose of this study was to identify and describe issues and trends in liability related to chronic pain management by anesthesiologists. METHODS: Data from 5,475 claims in the American Society of Anesthesiologists Closed Claims Project database between 1970 and 1999 were reviewed to compare liability related to chronic pain management with that related to surgical and obstetric (surgical/obstetric) anesthesia. Acute pain management claims were excluded from analysis. Outcomes and liability characteri

Necessity and death: lessons from Latimer and the case of the conjoined twins.

The availability of the defence of necessity in cases of homicide is a complex issue in both Canadian and British jurisprudence. This article examines the divergent judicial and academic views and argues that, while necessity may be available for certain kinds of homicide, it should be rejected as a legitimate defence to intentional killings. The author looks closely at two recent cases in which the question arose as to whether or not killing a human being is ever justifiable or excusable on the basis of necessity: the Canadian case of R. v. Latimer and the British case of Re A (Children). The

Unexplainable nondermatomal somatosensory deficits in patients with chronic nonmalignant pain in the context of litigation/compensation: a role for involvement of central factors?

OBJECTIVE: To address the prevalence and characteristics of nondermatomal somatosensory deficits (NDSD) in subjects with chronic pain in the context of compensation/litigation. METHODS: Data were collected via standardized history, examination, and patient- as well as physician-drawn body maps in a consecutive series of 194 subjects seen for the purpose of an independent medical examination. RESULTS: Forty-nine subjects (25.3%) with primarily widespread pain (often diagnosed as fibromyalgia) presented with hemisensory or quadrotomal deficits to pinprick and other cutaneous stimuli on the sid

[Chronic gastritis: Instructions for use of medications].

The paper highlights the features of drug use in the legal aspect. It analyzes instructions for medical use of proton pump inhibitors (PPIs) and gastric protective agents. Taking into account the characteristics of indications registered in the instruction, the authors discuss the possibility of using various PPIs. The instruction for medical application is an official document approved by the Ministry of Health, the basis of which is the data of trials carried out by a manufacturer, and it should be a key or fundamental source for a physician in choosing a medication. The use of a drug with n

An uncommon skin condition illustrates the need for caution when prescribing for friends.

PURPOSE: A dual-focused case study written to discuss the legal and medical hazards of informally writing prescriptions for friends or family members and to provide knowledge of early-stage mycosis fungoides (MF), its course, and treatment. DATA SOURCES: A review of the prescribing practices of clinicians, the cognitive processes needed in diagnosis and treatment, the current ethical guidelines, and a review of MF, its course, and treatments. CONCLUSIONS: Treating acquaintances and family informally places clinicians at risk for liability and patients at risk for inaccurate diagnosis and tre
