[Internal fixation of the distal radius: Medical liability considerations].

Fixation of distal radius fractures is now the primary surgical procedure leading to medical liability claims for surgeons dealing with injuries to the upper limb. The main reasons for incrimination are complex regional pain syndrome and an unfavorable progression toward malunion. Infectious problems are relatively rare and, in general, well controlled. The associated capsule and ligament damage can be underestimated at the time of the initial assessment, which points to the need for complementary imaging in case of doubt. The prevention of claims inevitably requires a judicious choice of the

Legal and ethical responsibility for AI-assisted diagnostic and referral errors: a scoping review of comparative approaches with implications for Saudi healthcare.

BACKGROUND: Artificial intelligence (AI) systems are increasingly embedded in clinical diagnostics and referral pathways, yet when these tools contribute to patient harm, traditional medico-legal doctrines are strained by algorithmic opacity, automation bias, and distributed decision-making. Beyond legal uncertainty, AI integration raises fundamental ethical concerns regarding clinician moral agency, patient autonomy, and distributive justice. This scoping review maps how jurisdictions worldwide allocate legal and ethical responsibility for AI-assisted diagnostic and referral errors, identifie

Avoiding malpractice for nondental conditions. The example of human immunodeficiency virus.

BACKGROUND: Dentists are legally liable for failing to recognize medical conditions that they identify while providing dental care and for failing to refer patients for follow-up care and testing. This article suggests ways to avoid liability using human immunodeficiency virus, or HIV, infection as an example. TYPES OF LITERATURE REVIEWED: The authors conducted a review of the legal literature to determine circumstances that would cause dentists to have legal liability for failing to recognize a medical problem. The authors also conducted a review of the dental literature to identify the most

[Organizational negligence in hospitals: understanding and mitigating the risks of criminal liability].

The increasing complexity of medical treatment processes, shortages of qualified personnel, and the division of labor in modern hospitals heighten the risk of legal violations. This article examines the criminal and administrative liability of hospital managers and other persons in positions of responsibility in cases involving organizational negligence arising from deficiencies in the hospital's organizational structure and supervision (Organisationsverschulden). It demonstrates that an effective compliance management system serves not only to mitigate liability risks but also constitutes an

Mycobacterium Chimaera: Clinical and medico-legal considerations starting from a case of sudden acoustic damage.

Mycobacterium Chimaera is a microorganism that can cause nosocomial infections particularly in patients undergoing cardiac surgery. The specific case presented herein shows an original clinical presentation of the infection: sudden unilateral deafness as a result of septic embolization. Medico-legal experts appointed by the court in a civil liability dispute analyzed the case and submitted their expert opinion. This article analyzes the peculiar and innovative aspect of professional liability that can be attributed to the healthcare facility and the manufacturer of the equipment used in the op

How Often Do Pharmacists End up in Court? Analysis of Civil and Criminal Case Law in Poland.

Background: Pharmacists, as healthcare professionals of public trust, operate within a complex legal environment involving multiple forms of professional liability, particularly civil and criminal liability. Although these forms of responsibility are formally regulated by statutory law, the practical distinction between them remains largely dependent on judicial interpretation and case-specific circumstances. Objective: The aim of this study was to assess the scale and nature of judicial proceedings involving pharmacists and to identify the most common factors leading to civil and criminal lia

Medico-legal risk in the emergency department.

PURPOSE: The landscape of the medico-legal risk in emergency medicine in Canada is unknown. The objective of this study was to describe and analyze factors associated with medico-legal risk in cases in the emergency department (ED). METHODS: We conducted a descriptive analysis of closed medico-legal cases (hospital complaints, regulatory authority (i.e., College) complaints, and civil-legal actions) involving physicians practicing primarily emergency medicine in Canadian EDs. We used data from closed cases involving the Canadian Medical Protective Association from January 2018 until December

Electroconvulsive Therapy, Manufacturers' Liability, and Learned Intermediaries.

Manufacturers of drugs or devices that are prescribed by physicians are protected by the "learned intermediary rule" from having to disclose risks directly to patients. Instead, they must inform physicians of these risks. But when a company fails to disclose a known risk, how can a patient gain compensation for any resulting harm? The California Supreme Court considered this question in a case involving alleged memory impairment from electroconvulsive therapy. By broadening the ways by which plaintiffs can demonstrate that the absence of a warning caused their injury, the court made it easier

[Gambling disorder and imputability: from the nosographic revision to an expanded forensic assessment].

The gambling disorder (GD in the DSM-5) is an example of how the evolution of research has contributed to the nosographic review of complex psychopathological conditions, such as behavioral addictions, likewise other personality pathologies. Recently, the scientific and doctrinal debate has also affected the controversial issue of imputability, to assess in what terms this diagnostic picture can acquire the value of "infirmity" such as to undermine the ability to understand and the will of a subject under evaluation. However, it is always necessary to translate the clinical, and experimental,

Medical liability and orthopaedic trauma: history and current state of affairs.

Orthopaedic trauma has been associated with the history of medical liability all the way back to the dark ages and the bubonic plague. Caps on noneconomic damages and other reforms have been challenged in many states, and an innovative approach to medical liability reform must be developed within the medical profession and the various legislatures. Orthopaedic trauma surgeons have a unique perspective in that they perform a critical service to the community, however they are often deprived of the benefit of preoperative risk reduction best practices because of the critical needs of the patient

Medico-legal issues in obstetric anesthesia: what does an obstetrician need to know?

BACKGROUND: Obstetric anesthesia has become a recognized subspecialty of anesthesiology and an integral part of practice of most anesthesiologists. Perhaps no other subspecialty of anesthesiology provides more personal gratification and clinical challenges than the practice of obstetric anesthesia. However, in addition to clinical challenges obstetric anesthesia is laden with medico-legal liability. Alternative dispute resolution of medical-legal issues.

Even the most casual observer of medical-legal litigation knows that such disputes take a long time to resolve, cost too much, and often leave parties no better off than before. Litigation also has deleterious effects where the parties have an ongoing relationship outside the courtroom. Such problems plague all litigation, however, and have prompted courts and legislatures to explore alternatives to the traditional means of solving private disputes through the filing and trial of lawsuits. In Texas, this effort resulted in the 1989 passage of the Texas Alternative Dispute Resolution Act (Texas

Management issues for trauma patients with alcohol.

An estimated 20-25% of patients treated in emergency departments or as inpatients for trauma have been drinking and most of them have BACs of 0.10 gm/dL (22 mmol/L) or higher. Many are problem drinkers or alcoholics, smokers, and also abuse other drugs. Both acute ingestion and chronic abuse of alcohol increase the frequency and severity of injury, and may complicate patient management by mimicking head trauma, masking intra-abdominal injury, causing circulatory collapse, reducing immune response, altering hepatic metabolism, or causing delirium tremens. Proper management of a trauma patient w

Legal considerations in screening pregnant women for human immunodeficiency virus.

This article examines the legal implications of studies showing that the probability of maternal-to-infant human immunodeficiency virus transmission can be reduced by physician interventions. These interventions require knowledge of a pregnant woman's human immunodeficiency status. Hence the offering of human immunodeficiency virus testing has become a standard of care in pregnancy. This standard of care is examined with respect to the following: (1) the physician's legal duty to the infant, (2) negligence for failing to test, (3) liability when testing only reduces the probability of transmis

Civil Liability for Ocular Toxicity Caused by Perfluorocarbon Liquids: The MEROCTANE Case in Chile.

UNLABELLED: Perfluorocarbon liquids (PFCL) are used in vitreoretinal surgery due to their favorable physicochemical properties. However, in 2013, cases of severe ocular toxicity were reported in Chile, associated with contaminated batches of perfluorooctane (PFO) marketed under the name MEROCTANE. These events exposed critical failures in quality control mechanisms and gave rise to multiple judicial rulings in the field of civil liability. AIM: xTo analyze the biomedical and legal foundations of the MEROCTANE case in Chile from an interdisciplinary perspective, identifying the technical facto

Two Steps Backwards: Medical Malpractice in Correctional Health Care & the Texas Two-Step Bankruptcy Maneuver as a Means of Circumventing Liability.

This Note explores how correctional health care companies attempt to circumvent mass tort liability by filing for bankruptcy, further exacerbating the challenges incarcerated individuals face in accessing the legal system. In Section I, I provide background on the increasing trend of prisons outsourcing their required health care capabilities to correctional health care corporations, the high rates of medical malpractice and adverse medical outcomes in prisons that contract with correctional health care companies, and the barriers incarcerated individuals face in seeking relief for medical mal

[Not Available].

Currently, there is a growing number of lawsuits from patients, primarily those with Biocell breast implants, against the surgeons who performed the procedures. This is partly due to law firms actively seeking out affected individuals to pursue claims for damages based on allegedly inadequate disclosure of the risk of BIA-ALCL. The unsuccessful attempts to obtain financial compensation through product liability and proof of a defective medical device may also contribute to this trend. This raises the question of when a surgeon could reasonably be expected to disclose the associated risks.

The "Learned Intermediary": The Role of the Psychiatric Interventionist in Product Liability Lawsuits.

Malpractice lawsuits brought by patient-plaintiffs alleging damages from medications or medical devices may entangle both the prescriber and the biomedical manufacturer. In this scenario, the prescriber may be viewed as a defendant, or alternatively as a "learned intermediary" (LI) between the patient and biomedical company. Recent legal actions in the United States involving manufacturers of electroconvulsive therapy devices have invoked the principle of the LI in the arguments. The plaintiff argued that the manufacturer held a major responsibility for providing to device operators warnings w
