Gendered denials: Vulnerability created by barriers to legal capacity for women and disabled women.

This article explores the vulnerability that is created when legal capacity is denied to women and disabled women. It argues that vulnerability is largely contingent on social constructs - as opposed to being an inherent quality of disability or gender. It discusses barriers to the exercise of legal capacity that women and disabled women experience - such as limitations on reproductive choice, higher rates of substituted decision-making, and unique experiences with forced mental health treatment. It then explores evidence that such barriers are disempowering and can leave women and disabled wo

Measuring Contraceptive Autonomy at Two Sites in Burkina Faso: A First Attempt to Measure a Novel Family Planning Indicator.

There is growing consensus in the family planning community around the need for novel measures of autonomy. Existing literature highlights the tension between efforts to pursue contraceptive targets and maximize uptake on the one hand, and efforts to promote quality, person-centeredness, and contraceptive autonomy on the other hand. Here, we pilot a novel measure of contraceptive autonomy, measuring it at two Health and Demographic Surveillance System sites in Burkina Faso. We conducted a population-based survey with 3,929 women of reproductive age, testing an array of new survey items within

Non-consensual treatment is (nearly always) morally impermissible.

Commentators routinely urge that it is morally permissible forcibly to treat psychiatric patients (1) to preserve the patient's best interests and (2) to restore the patient's autonomy. Such arguments specify duties of beneficence toward others, while appreciating personal autonomy as a positive value to be weighted against other factors. Varying by jurisdiction, legal statutes usually require, in addition, at least (3) that there exists the threat of harm to self or others. In this paper, I argue against embracing the first two elements of this prevailing view. I also argue for a very restric

Scapegoated communities, shared struggles: A call for solidarity with people who use drugs and queer and trans people.

Efforts to control, repress, and punish drug use and queer and trans existence are rising as right-wing extremism becomes increasingly mainstream. These connected efforts are seen through the stifling of bodily autonomy and agency using criminal-legal, biomedical and political apparatuses, and have been executed similarly for people who use drugs and queer and trans people alike. This is most notable for those who exist at the intersection of these communities. Both groups have withstood attempts at manufacturing internal hierarchies - always at the expense of those who are already most margin

Palliative Obstinacy: When Care Becomes a Constraint at the End of Life.

This paper develops the concept of "palliative obstinacy" to describe situations in which palliative care, rather than alleviating suffering in accordance with the patient's wishes and values, becomes a new form of clinical paternalism at the end of life. Drawing on a case narrated by Elyse Ona Singer and Norma Alicia Ordóñez-Vázquez of a patient with cancer requesting physician-assisted death, the paper argues that some models of palliative care unjustifiably pathologize the desire to die by treating it exclusively as a symptom of untreated suffering, depression, or inadequate care. Against Offering "Faux Codes": An Ethically Problematic Workaround.

In another essay in this issue of the Hasting Center Report, an argument is made in favor of offering a "faux code" in the setting of a patient who cannot say no to her family who insists her code status remain "full." Under the proposal, an unwritten agreement is made between the patient and the clinical team to withhold cardiopulmonary resuscitation while maintaining a "full code" status in the medical record. The ethical question in this case involves how best to support and uphold the patient's autonomy while minimizing the distress of the patient's family, and the "faux code" is proposed

[A Prediction Model of Exercise Level in Patients with Ankylosing Spondylitis].

PURPOSE: This study aimed to construct and test a hypothetical model to explain the predictive factors and causal pathways for exercise levels in patients with ankylosing spondylitis based on the self-determination theory. A conceptual framework was constructed assuming that autonomy support by health care providers would satisfy the three basic psychological needs of patients, which would increase their autonomous motivation for exercise, resulting in its initiation and continuation. METHODS: This cross-sectional study included 221 patients with ankylosing spondylitis who were visiting rheum

[Ethical questions in the clinical use and research of electroconvulsive therapy].

Electroconvulsive therapy (ECT) is one of psychiatry's most long-standing and criticized treatments. Some of the criticisms come from the ethical aspect of ECT. The authors review the ethical issues of clinical application and research of ECT. ECT in the treatment of psychiatric patients is considered ethical, if it is conducted according to the four main principles of bioethics (beneficence, non-maleficence, autonomy and justice). ECT research should also comply with other international guidelines and research ethics codes. In recent decades, the principle of informed consent has become wides

Can We Communicate Autonomy Support and a Mandate? How Motivating Messages Relate to Motivation for Staying at Home across Time during the COVID-19 Pandemic.

A multi-wave study across two months tested changes in motivation for staying at home at the beginning of the COVID-19 outbreak in the UK and US in 683 living-alone older adults (mean age = 53 years), those that might experience greater psychological costs of being isolated for long periods of time. The study was focused on changes in two types of motivation: autonomous motivation- finding importance in the task of staying at home, and controlled motivation- staying at home because of felt pressure or choicelessness, as autonomous motivation predicts effective behavior change better than contr

"I Can't Eat if I Don't Plass": Impoverished Plasma Donors, Alternatives, and Autonomy.

One of the central considerations to be taken into account in evaluating the ethics of compensation for donated plasma is respect for donor autonomy. And one of the main arguments against compensated donation systems is that many donors do or would come from circumstances of poverty that restrict their alternatives in a way that compromises those donors' autonomy. In this paper, I develop and defend a novel version of this "compromised autonomy argument" which improves upon extant versions by employing a more nuanced account of the relationship between alternatives and autonomy. According to t

The Importance of Considering Personal Recovery for Eating Disorders.

OBJECTIVE: Definitions of recovery from eating disorders (EDs) have traditionally emphasised symptom reduction and functional restoration. However, growing research highlights the importance of integrating personal recovery, defined by self-acceptance, autonomy, and psychological wellbeing. This study explored the relationship between partial clinical remission and personal recovery in individuals with lived experience of an ED. METHOD: A total of 234 participants (N = 234; Mage = 28.10; 89.3% female; 49.6% non-heterosexual) were recruited online and completed measures assessing ED symptom se

Roles of Emotional Autonomy, Problem-Solving Ability and Parent-Adolescent Relationships on Self-Management of Adolescents with Type 1 Diabetes in Taiwan.

BACKGROUND: High emotional autonomy has a negative association, whereas good problem-solving ability and parent-adolescent relationships have positive association with self-management in adolescents with type 1 diabetes (T1D). Exploring roles of these variables is crucial to design specific interventions to improve self-management in such afflicted adolescents. PURPOSE: To explore the roles of emotional autonomy, problem-solving ability and parent-adolescent relationships on self-management in adolescents with T1D. DESIGN AND METHODS: Cross-sectional design was used in this study. A total of

Navigating the Transition From Adolescence to Adulthood Among Young People With Severe Haemophilia: The Qualitative Phase of the TRANSHEMO Project.

INTRODUCTION: Haemophilia causes spontaneous or prolonged bleeding due to a deficiency in clotting factor VIII (haemophilia A) or IX (haemophilia B). Although substitutive therapies and regular follow-up can prevent severe haemorrhagic events, adherence to treatment remains a challenge. Transitioning from adolescence to adulthood and from paediatric to adult care is particularly complex for young people with severe haemophilia (PwSH), as it involves gaining autonomy in health management. OBJECTIVES: This study aimed to explore factors influencing the success of the transition process in young

Home-Based Opportunities and Self-Determination in Youth: When Intellectual Disability Shapes the Impact of Context.

BACKGROUND: Home is a key context to foster self-determination. This study examined whether intellectual disability moderates the relationship between home-based opportunities to engage in self-determined actions and self-determination levels. METHOD: Middle and high school students with and without intellectual disabilities (aged 13-22) completed the AIR-S questionnaire, which evaluates self-determination capacity and opportunities at home. A moderation model was used to examine the relationship between home opportunities and self-determination, as well as the moderating role of intellectual

Pinpointing the politics of passing away. An empirical ethics case study on legislating assisted dying.

BACKGROUND: While the number of countries that have introduced or are trying to introduce statutory laws regulating the procedure of assisted dying is increasing, research has yet to address why some legislative attempts succeed and others fail. In Germany, which set out to regulate assisted suicide with an autonomy-based approach, two draft bills were unable to secure a parliamentary majority. This paper sets out to explain the underlying value disputes that contributed to the legislative failure. METHODS: We conducted an interpretative analysis of 108 speeches and 18 declarations to the vot
